About this file

This document is a U.S. Coast Guard Justification for Other Than Full and Open Competition under Simplified Acquisition Procedures (SAP) for FAR 12.102(a).

The Coast Guard Engineering and Logistics Center (ESD) seeks to purchase two items on a brand name basis directly from D-2 Incorporated (CAGE Code 4EKX8), the original equipment manufacturer: a PEAK Kit (Part Number JF-PEAK-M) and a 5-Year Calibration service (Part Number JF-PEAK-CA-M), each with an initial quantity of one unit. The PEAK Kit is used for quality surveillance standards established by USCG Aeronautical Fuels to replace outdated equipment and performs ASTM testing requirements with user-friendly functionality and expeditionary protection. The justification for brand name procurement is based on FAR 5.201(c)(3), FAR 11.204, and FAR 12.102(a), citing that the items are highly specialized and specifically designed by D-2 Incorporated, the OEM that owns all technical data and specifications. The Government does not possess the technical data rights or plans to develop them, making it uneconomical to pursue alternative sources or develop adequate purchase descriptions. The suggested source is D-2 Incorporated located at 6 Otis Park Drive, Suite 1, Bourne, Massachusetts 02532 (UEI: FTJNCKQVZHT5). The contracting officer is utilizing a current price list as the fair and reasonable price determination method. A combined synopsis/solicitation will be posted to the Contract Opportunities section of sam.gov, allowing responsible sources to submit capability statements, proposals, or quotations for agency consideration.
