PERFORMANCE WORK STATEMENT (PWS)

FOR

CLEAN AND SERVICE OIL WATER SEPARATORS (OWS)

Project# JLSQ242008

Date: 24 July 2024

1.0 General:

1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary to clean and service the OWS, as defined in this PWS.

1.2 Background: The OWS are sampled and analyzed annually for their product/sludge amounts and waste characterization. The OWS to be cleaned will be identified based on the annual sampling results for that year. A list of all the OWS that have the potential to be cleaned and serviced are listed in Technical Exhibit 3. Cleaning and servicing of the OWS shall consist of pumping out and disposal of all sludge/ contents, inspect anodes and cathodes effectiveness, inspect alarm/indicator/monitor devices, inspect for leaks, replace all cover gaskets and seals, and refill OWS.

1.3 Period of Performance (PoP):

This requirement is for an Indefinite Delivery / Indefinite Quantity (IDIQ) contract. The period of performance shall be from contract award and will consist of five (5), twelve

(12) month ordering periods where prices are based on the specific ordering period of the delivery order.

1.4 General Information:

1.4.1 Place and Performance of Services: The two sites for this service work are:

• 171st Air Refueling Wing (ARW) Pennsylvania Air National Guard base located at the Pittsburgh International Airport, 300 Tanker Road, Coraopolis, PA 15108.

• 258th Air Traffice Control Squadron (ACTS) located at 258 Airport Road Johnstown, PA 15904, across from the Johnstown-Cambria County Airport.

1.4.1.1 The contractor shall provide services between the hours of 0700-1630 on Monday through Friday. The contractor shall not work on recognized Federal holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or Government-directed facility/installation closings.

1.4.1.2 The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. Contractor shall field verify all site conditions, quantities, measurements, and project requirements. Contractor shall protect and barricade all work areas at all times to protect workers and the public from injury. Contractor shall protect all structures, utilities, vegetation, sidewalks and vehicles from damage at all times. Replace all damaged materials with new materials to the satisfaction of the Government, at no additional cost to the Government.

1.4.1.3 Unscheduled gate closures by the Security Police may occur at any time causing all personnel entering or exiting a closed installation to experience a delay. This cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges.

1.4.1.4 The contractor’s employees shall become familiar with and obey the regulations of the installation; including fire, traffic, safety and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contractor employees shall carry proper identification with them at all times, and shall be subject to such checks as may be deemed necessary. The contractor shall ensure compliance with all regulations and orders of the installation, which may affect performance. The Government reserves the right to direct the removal of an employee from Government property or revoke access to Government systems for misconduct, security reasons, or any overt evidence of communicable disease. Removal of contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.

1.4.2 Quality Control (QC): The contractor shall develop and maintain an effective QC Plan (QCP) to ensure services are performed in accordance with this PWS.

1.4.3 Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s).

1.4.4 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with FAR Subpart 42.5. The KO, COR and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor’s performance. At these meetings, the KO will apprise the contractor of how the Government views the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced. The contractor shall resolve outstanding issues raised by the Government. Contractor attendance at these meetings shall be at no additional cost to the Government.

1.4.5 Contract Manager (CM): The contactor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO.

The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the COR, to resolve issues, receive technical instructions, and ensure adequate performance of services. The CM shall ensure that contractor employees do not perform any services outside the scope of the contract without an official modification issued by the KO. The CM shall ensure contractor employees understand that services performed outside the scope of the contract are performed wholly at the expense of the contractor.

1.4.6 Combating Trafficking in Persons: The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract; procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United States Government’s zero tolerance policy, the actions that will be taken against employees for violations of this policy. The contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at

FAR 22.17.

2.0 Definitions and Acronyms:

2.1 Definitions:

2.1.1 Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

2.1.2 Contracting Officer (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3 Contracting Officer Representative (COR): An employee of the U.S.

Government designated by the KO to monitor contractor performance. Such appointment will be in writing and will state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4 Defective Service: A service output that does not meet the standard of performance associated with the PWS.

2.1.5 Deliverable: Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.

2.1.6 Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the

PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7 Physical Security: Actions that prevent the loss or damage of Government property.

2.1.8 Quality Assurance: The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10 Quality Control: All necessary measures taken by the Contractor to ensure that the quality of an end product or service shall meet contract requirements.

2.1.11 Subcontractor: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.2 Acronyms:

3.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S): No Government furnished property will be provided under the performance of this contract.

4.0 Utilities: The Government shall provide at no cost to the Contractor reasonable amounts of water and electricity to support the contract. Hook up will be to existing electrical outlets and existing water shut off valves and will be the contractor's responsibility. Any contractor requirement to connect to the base water system will need to be coordinated through the COR and will require a backflow prevention device.

5.0 Requirements:

5.1 Clean and Service OWS:

5.1.1 The contractor shall pump out all sludge, oil, and water from the OWS and ship the waste for off base recycling, treatment, and disposal at a permitted TSDF (Treatment, Storage and Disposal Facility). Reference Technical Exhibit 3 of this PWS for the full list of OWS with capacities and sampling observations.

5.1.2 The OWS to be cleaned are listed in Technical Exhibit 3. The following OWS require confined space entry to access OWS or to clean OWS: 113-1S, 304-1S, 320- 1S, 400-1S, and 404-1S. OWS 400-1S and 320-1S are located in vaults. Reference Technical Exhibit 4 for a map of the OWS locations.

5.1.3 Contractor shall provide photos of each OWS before and after cleaning.

5.1.4 Contractor shall inspect each OWS, record their condition and note any issues or discrepancies.

5.1.5 Contractor shall water jet the discharge lines of the OWSs.

5.1.6 Replace OWS Seals/Gaskets: The contractor shall replace all manway access cover gaskets, fill line seals, and oil-water cover seals removed to perform required cleaning service.

5.1.7 Removal of Rust and Replacement of Corroded Hardware: The contractor shall remove rust / scaling from manway riser and replace broken and/or corroded bolts with stainless steel bolts. The contractor shall perform this work for any OWS that requires it.

5.2 Inspect OWS: After cleaning out the OWS and prior to refilling with water, the contractor shall inspect each OWS, record their condition and note any issues or discrepancies. After refilling the OWS, the contractor shall inspect for leaks. The contractor shall inspect the magnesium anodes for cathodic protection effectiveness and report any problems. The contractor shall inspect the OWS level alarms and indicators and interstitial monitors for proper operation and make recommendations if problems are found.

5.3 Refill OWS: The contractor shall refill the following OWS with clean, oil-free water to the proper level.

5.4 Site Clean-Up: The contractor shall ensure that the OWS job sites are left in a neat and orderly condition upon completion of the work. All debris shall be removed from the site and disposed of off-site in accordance with local, state, and federal regulations. The contractor shall clean up and dispose of all waste from spills that occur during pumping and refilling of the OWS and during transportation and disposal of the waste. The contractor shall report spills to the Contracting Officer immediately, regardless of on or off base occurrence, and shall report any spills to the proper authorities in accordance with all applicable local, state, and federal regulations and requirements.

5.5 Waste Disposal: Contractor shall report the quantity of hazardous and non-hazardous waste that is disposed of to the COR (to be forwarded to the base Environmental Management office). The waste shall be shipped using a properly licensed waste transporter. The waste shall be manifested and shipped in accordance with all applicable local, state, and federal regulations and requirements (also reference Section 6.0 of this PWS). All waste shipping manifests shall be processed through and signed by a representative from the base Civil Engineer Office or Environmental Office.

The contractor shall provide unit totals for the waste in both pounds and gallons.

5.6 Training and Certifications: The contractor shall certify that all workers have all required training for handling Residual or Hazardous Waste and Confined Space training for any work that requires entry into confined spaces. The contractor shall provide applicable worker training certificates as part of the acceptance package. The contractor shall coordinate any confined space entry work with the base Safety and Fire offices. Allow 2 weeks for coordination efforts. These offices shall be contacted through coordination with the COR.

5.7 Scheduling: The contractor shall provide a sampling schedule to the COR for approval before starting work.

5.8 Close Out Report:

5.8.1 The close out report shall include a detailed summary of all work completed to include OWS sampling, cleaning, seals/gasket replacement, rust removal, hardware replacement, refilling, and inspections.

5.8.2 The report shall include before and after photos of the cleaning activites for each OWS. The report shall also include all photos outlined in paragraph 5.1.4.

5.8.3 The report shall document, using written discriptions and photos, any problems found, and provide recommendations of any additional repairs / maintenance required.

5.8.4 The contractor shall provide cost estimates within the report for any additional repairs / maintenance identified.

5.8.5 The report shall include contractor’s training certifications and documents.

5.8.6 The report shall include unit totals for the any waste disposed in both pounds and gallons.

5.8.7 The contractor shall submit the report electronically as well as provide two (2) hard copies. The hard copies may be provided in 3-ring binders or spiral bound reports.

5.9 Ordering: Orders for cleaning and servicing of OWS shall be issued in accordance with the terms and conditions of this IDIQ contract. Each order will specify the OWS to be cleaned and serviced, the location of the OWS, the date by which the work is to be completed, and any other relevant information. The Contractor shall provide a price per cleanout for each OWS, which shall be fixed for the term of this IDIQ contract.

5.10 Payment: Payment shall be made to the Contractor in accordance with the terms and conditions of each order. The Contractor shall submit an invoice to Wide Area Workflow (WAWF) within 30 days after completion of the work specified in each order.

The invoice shall include a description of the work performed, the date of completion, and the amount claimed.

6.0 Security: Security Forces shall monitor the incoming and outgoing of work personnel during the duration of the project. All deliveries shall be coordinated with the COR to arrange for their entrance onto Base property. Contractor Vetting - Contractor shall provide a completed Wing Form 128 two weeks prior to start of work.

6.1 Escorts:

6.1.1 Photo Identification: All Contractor personnel shall have a minimum of one (1) form of photo identification with them at all times.

6.1.2 Escort: A Government representative will escort the contractor while on base unless a long term visitor request is processed through the base Security Forces Squadron for “unescorted access” privileges.

6.1.3 Unescorted Access: For this project, CE will request “unescorted access” privileges for the contractor (and sub-contractors) working on this project. The Contractor shall complete the Wing Form 128 for all personnel working on base for this project. The information required includes full legal name, social security number, date of birth, gender, and race. Allow up to 2 weeks for the approval process.

Performance Requirements Summary (PRS)

This PRS includes performance objectives the Government will use to determine contractor performance and will compare contractor performance to the Acceptable Quality Level (AQL).

The Government has the right to inspect all tasks within the PWS, not just the Performance Objectives (POs) listed below. Performance Ratings or Acceptable Quality Levels are as follows: E – Exceptional, VG – Very Good, S – Satisfactory, M - Marginal, U – Unsatisfactory.
