About this file

This document is a Provisions, Clauses, and Terms and Conditions attachment for DHS Coast Guard (USCG) Indefinite Delivery Requirements contract 70Z03826QB0000014 for the procurement of aviation parts and components. The contract is awarded to responsible vendors certified under the FAA AC 0056 program who can provide either a Certificate of Airworthiness (COA) with FAA 8130 documentation (preferred), equivalent EASA-1 certification, or a Certificate of Conformance (COC). Parts must have no more than two ownership changes after the original equipment manufacturer. Evaluation is conducted on three factors: Technical Acceptability (pass/fail based on FAA AC 0056 certification and documentation requirements), Price (fair and reasonable based on FAR 12.204 techniques), and Past Performance (evaluated using USCG past contracts, AMMIS delivery data, PPIRS/CPARS, and Federal Government sources, with neutral rating for vendors lacking relevant history). Only the lowest-priced offer is initially evaluated for technical acceptability; if unacceptable, evaluation continues sequentially until an acceptable, technically qualified offer with acceptable or neutral past performance is identified.

The contract includes a one-year base period with four optional one-year extensions (five-year maximum duration). Deliveries ship FOB Destination to USCG Aviation Logistics Center in Elizabeth City, North Carolina, with all packaging, marking, and shipping costs included in quoted prices. Quality Assurance requirements mandate immediate notification of non-conformances, counterfeit/suspect parts, supply changes, or material defects; all changes require USCG approval before implementation. Invoicing must include Certificates of Conformance or Airworthiness with full traceability documentation; invoices submit to ALC-Fiscal@uscg.mil with payment via electronic funds transfer within five days of shipment once all items are received. Large businesses under NAICS code 336413 must submit Small Business Subcontracting Plans. Offerors must maintain FAA AC 0056 certification, comply with all FAR and HSAR clauses regarding security prohibitions, debarment certifications, whistleblower protections, and sustainable products requirements, with 120-calendar-day price firm period from offer receipt date.

(i) The Offeror and/or any of its Principals—

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:

(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility.

Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror non-responsible.

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default. (End of provision)

52.212-2 Evaluation – Commercial Products and Commercial Services (Aug 2025) (DEVIATION 25-21) (Effective November 28, 2025)

(a) The Government will award a contract(s) resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. Quotations will be evaluated in accordance with RFO 12.203(a) based on the factors listed below and on page 5.

Factor 1:

Technical Acceptability:

Technical Acceptability will be evaluated as either “acceptable” or “unacceptable.”

To be rated acceptable, the offeror must be a vendor certified under the FAA AC 0056 program and be able to provide one of the following:

· A Certificate of Airworthiness (COA):

· (1) FAA 8130 documentation (preferred)

· (2) Equivalent European Aviation Safety Agency (EASA-1) certification

· (OR) A Certificate of Conformance (COC)

Parts must have no more than two ownership changes after the OEM: manufacturer to distributor, distributor to sub-distributor, and sub-distributor to ALC.

Offerors not certified under the FAA AC 0056 program are subject to USCG Engineering review for acceptance.

The offeror will be evaluated with the following description:

Acceptable Meets Technical Acceptability Requirements

Unacceptable Does not meet Technical Acceptability Requirements

Factor 2:

Price:

The contractor shall provide pricing as requested in the attached spreadsheet titled “Schedule of Supplies 70Z03826QB0000014”. Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quote will be evaluated using one or more of the techniques defined in FAR 12.204, in order to determine if it is fair and reasonable.

Factor 3:

Past Performance:

The Government may use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS). Offerors are advised that more recent performance is more relevant than less recent performance and will be given greater weight in the evaluation process. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be given a neutral past performance rating.

Evaluation Method:

Only the lowest priced offer will be evaluated for Technical Acceptability. Should the lowest priced offer not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced offer until the lowest priced, technically acceptable offer with acceptable or neutral past performance is identified.

52.216-1 Type of Contract (OCT 2025) (DEVIATION 26-04) (effective November 28, 2025) The Government contemplates award of an Indefinite Delivery Requirements-Type contract resulting from this solicitation.

(End of provision)
