JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

PROJECT NAME:

NextGen

The following Justification for Other than Full & Open Competition (JOFOC) is prepared in accordance with FAR Subpart 13.5.

1. ORGANIZATION:

Federal Energy Regulatory Commission Office of Executive Director Acquisition Services Division 888 1st Street, NE Washington, DC 20426

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

FERC needs to renew the maintenance and license for NextGen Software that we currently own and is about to expire.

3. DESCRIPTION OF REQUIREMENT & VALUE:

The Division of Pipeline Certificates (DPC), which is in the Office of Energy Projects, utilizes commercially available pipeline simulation software packages for hydraulic modeling purposes.

NextGen is a steady-state and transient software which provides increased functionality regarding the flow dynamics of natural gas through the nation’s extensive interstate pipeline grid.

The software allows DPC engineering staff to analyze the operational designs (under both steady-state and transient conditions) of regulated, interstate natural gas pipelines systems which is a core responsibility of the DPC in analyzing certificate applications.

ANTICIPATED DOLLAR VALUE: $603,039.77 (including base year & 4 option years)

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2) in accordance with:

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

Gregg Engineering has been an industry leader in pipeline hydraulic software for nearly 30-years. During that time, Gregg Engineering has used its pipeline hydraulic software to provide pipeline simulation software to the gathering, transmission and distribution markets. Gregg Engineering’s NextGen Simulation Suite represents a new standard in pipeline modeling, brining enterprise-level integration and performance to streamline everything from design to management.

6. SOURCES SOUGHT EFFORTS:

There are no other pipeline simulation programs that can be compared to Gregg Engineering’s acceptance in the market place. Further, there is no compatibility options available to allow a hydraulic model to be imported from or to another software package. As it currently stands, rarely does a regulated pipeline company provide pipeline hydraulic models which are not compatible with Gregg Engineering.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

SMEs conducted market research and determined their fair and reasonable value by reviewing previous contract pricing, pricing for similar services and current market pricing.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:

Market research indicates that this is not available through any other means or resellers. There is only one vendor that can provide the functionality of NextGen to the interstate pipeline companies that have already made the financial commitment to purchase the NextGen software from Gregg Engineering. There are no other pipeline simulation software programs that can import a pipeline system. Without NextGen, FERC will not be able to conduct hydraulic analyses on nearly 50 percent of the FERC regulated interstate pipeline systems.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

We have licensed the NextGen software from Gregg Engineering for over25-years. Due to the length of time FERC pipeline engineers have used these software programs, we have continued to invest in training our engineers every few years in order to keep our software knowledge up to date. This has allowed our engineers in our division to keep their analysis skills sharp. If we don’t move forward with this acquisition, we will not be able to provide answers to the Commission in a timely manner. Further, FERC will need to re-invest into pipeline simulation software that the engineers have never seen or used before. Lastly, there is no substitute for Gregg Engineering’s NextGen software. There pipeline simulation programs are not interchangeable due to the proprietary formats used by Gregg Engineering and the other pipeline simulation software packages currently available.
