1 INTRODUCTION

This is a non-personal services contract to provide pest control Services to the Federal Communications Commission (FCC).

2 BACKGROUND

The FCC, an independent agency of the United States Government established by the Communications Act of 1934, is charged with regulating non-Government interstate and international communications by radio, television, wire, satellite and cable. The FCC’s jurisdiction covers the 50 states, the District of Columbia, and U.S. possessions.

The FCC is led by a Chairman and up to four Commissioners appointed by the President with the advice and consent of the U.S. Senate. The Chairman delegates management and administrative responsibility to the Office of the Managing Director (OMD). The Commission staff is organized into seven (7) Bureaus (including the Enforcement Bureau (EB)), several offices (including OMD and the Offices of Engineering and Technology, Strategic Planning & Policy, and General Counsel), and numerous field offices (including the Livermore, CA field office).

The agency’s responsibilities include, but are not limited to, processing applications for licenses and other filings, analyzing complaints, conducting investigations, developing and implementing regulatory programs, and taking part in hearings.

The Office of Managing Director (OMD) is delegated responsibility for administering all management and administrative policies, programs, and directives for the Commission. Of particular note for this order, OMD Administrative Operations (OMD-AO) is responsible for planning, organizing, implementing and administering Commission programs for: office space management and utilization; facility leasing; building operations and maintenance; security operations, real property management; and procurement of goods and services (through its Enterprise Acquisition Center (EAC)). While OMD-AO supports is responsible for overall administration of the FCC, the Enforcement Bureau (EB) has fill authority of Field Office operations.

3 OBJECTIVES

The FCC’s objective is to obtain, under this contract, pest control services at the FCC’s Livermore (CA) Field Office location. The Government’s objective is for the vendor to provide all services described in this performance work statement.

4 SCOPE OF SERVICES

The scope of this contract encompasses the following facility management support service areas:

a. Pest and animal control services

5 GENERAL INFORMATION

5.1 TYPE OF ORDER

The Government will award a firm fixed price purchase order for monthly pest control and inspections.

5.2 PERIOD OF PERFORMANCE

The period of performance shall be for one, twelve (12) month, base period, and four (4) twelve

(12) month option periods.

5.3 PLACE OF PERFORMANCE

The services to be provided under this order are to be provided at the FCC’s Livermore Field Office located at 3320 Lorraine Street, Livermore, CA 94551.

5.4 HOURS OF OPERATION

Vendor support shall occur during Government business hours which are 0800 to 1630 (8:00 AM to 4:30 PM PST), Monday through Friday, except observed Federal holidays. Exceptions to the regular hours of operation are detailed in subsequent sections of this PWS.

5.4.1 OTHER THAN GOVERNMENT BUSINESS HOURS

The Contractor shall schedule work so as not to interfere with performance of Government business. Excluding routine or requested furniture moves/maintenance and emergency efforts, work that cannot be accomplished during Government business hours shall be coordinated with, and approved by, the COR least 48 hours prior to execution. The Contractor shall not be entitled to additional compensation for work performed outside Government business hours.

5.4.2 RECOGNIZED HOLIDAYS

Unless expressly required in this PWS or directed by the CO, the Contractor shall not perform services on federal holidays, which include:

5.5 GOVERNMENT-FURNISHED PROPERTY AND EQUIPMENT

None.

5.6 VENDOR-FURNISHED PROPERTY

All supplies, equipment, facilities, services, and other items that the vendor requires to perform the work under this order are the responsibility of the vendor and shall be at the vendor’s expense.

6 PERFORMANCE REQUIREMENTS

The Enforcement Bureau (EB) is responsible for providing support operations critical to the Livermore Field Office. The EB is responsible for providing services which include, but are not limited to, grounds maintenance, integrated pest & animal control management, refuse and recycling services, and housekeeping / custodial services. As such, the work outlined in the PWS and performance requirements are crucial to the ongoing FCC mission. Therefore, it is crucial that the vendor work closely with the EB to ensure that the organizational objectives are accomplished throughout the period of this order. It is also imperative that the vendor’s staff provide superior customer service, in a spirit of cooperation and accompanied by uniformly positive attitudes.

The vendor shall obtain and maintain all applicable state and municipal licenses, insurance and permits required in order to perform all the services required under the order. The vendor shall provide required proof of insurance and licenses along with the pricing proposal.

6.1 INTEGRATED PEST & ANIMAL CONTROL MANAGEMENT

The vendor shall develop and implement a Pest Management and Animal Control Program in accordance with (IAW) all federal, state, local laws and regulations and provide the full range of licensed professional pest and animal control services to maintain a reasonably safe environment for employees. The Pest and Animal Control Management Plan for Livermore, CA shall be complete thirty calendar days (30) after order award and coordinated with the COR and EB.

Services, certifications/licenses and training shall be IAW all federal, state, local laws and regulations. Special emphasis shall be placed on areas frequented by employees and visitors (Table 1: Main Building, Storage Building, Garage, Hut – Please see Technical Exhibit 1).

Services shall include, but are not limited to: prevention and control of nuisance pests such as cockroaches, ants, arachnids (spiders, mites, ticks, etc.), stink bugs, lady bugs, other arthropod pests, bees and wasps, flies, gnats, mosquitoes, rats, mice, nuisance birds, stray dogs and cats, skunks, ground squirrels, raccoons, snakes, foxes and other occasional invaders.

The vendor shall be responsible for removal and disposal of animal carcasses discovered within the Livermore, CA boundary with the disposal performed IAW California and Alameda County laws and regulations (Alameda County Vector Control, Alameda County Agriculture Department, etc). Removal of an eagle or other threatened or endangered species carcasses shall be coordinated with the Livermore, CA Game Warden and the COR.

Please note: the Livermore Field Office has had a historical issue with nuisance ground squirrels. The vendor shall have experience and certifications, if applicable, to dispense ground squirrels. The vendor shall maintain and pull appropriate permits if poisons are to be utilized.

6.1.1 INSPECTIONS AND SERVICES

The vendor shall perform the following routine inspections and services, as a minimum:

a. Inspection and required eradication of pests and nuisance animals within the Main Building, Storage Building, Garage and Hut areas. This inspection and eradication shall take place monthly. Refer to technical exhibits 2, 3, and 4 (attached). Special attention shall be placed on the eradication of insects in the main building, as this area is staffed by FCC personnel.

b. Quarterly inspection of mechanical rooms, roofs, and other exterior areas as necessary;

and

c. Quarterly inspections for any pests and nuisance animals that pose a threat to the structural integrity of the facilities.

6.1.2 LIMITATIONS

Inspections, crack and crevice spraying, exterior treatments, and rodent control may generally be performed during Government business hours although, the Government reserves the right to require after-hours services when necessary based on mission requirements.

6.1.3 MATERIAL SAFETY DATA SHEETS (MSDS)

The vendor shall provide a list of all MSDS materials to the COR no more than thirty calendar

(30) days after order award. MSDSs shall have the trade names and chemical names of the chemical used and a label showing the contents, the use strength of the chemical, as applied, and the antidote thereto. No pesticides shall be used before approval by the FCC Health and Safety Offices. The FCC strongly encourages the use of organic products.

6.1.4 STORAGE AND DISPOSAL

The vendor shall transport, mix, dispense, and dispose of all pesticides and chemicals IAW all Federal, State, and local laws, regulations, and guidelines. The Contractor shall rinse or clean equipment offsite to the maximum extent practicable. When required to rinse/clean onsite, the vendor shall not exceed septic discharge limitations. On-site storage of pest control materials or equipment shall be limited to the minimum amount required for monthly order performance.

Bulk storage of pesticides is not authorized, and all pest control materials shall be properly inventoried, stored and secured, allowing access only to authorized personnel.

7 PERSONNEL REQUIREMENTS

The vendor shall provide sufficient personnel, both in number and qualifications to perform all work required.

7.1 OVERSIGHT OF VENDOR PERSONNEL

The vendor shall provide sufficient oversight to ensure that: all contractor personnel are functioning in accordance with their designated labor categories and at acceptable levels of professional performance; all order activities are performed in accordance with order requirements; and all positions are filled promptly and kept filled with qualified, competent, and trained personnel. The vendor shall be responsible for the activities of all vendor personnel and, if applicable, subcontractor personnel.

7.2 REMOVAL OF CONTRACTOR PERSONNEL

If the FCC finds a vendor prospective employee to be unsuitable or unfit for duties under the terms and conditions of the contract, the vendor will be advised immediately that such employee can no longer work under this contract. The vendor shall remove the employee from performing any work under this contract the same business day that it receives notification from the FCC.

8 QUALITY ASSURANCE AND QUALITY CONTROL

The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards applicable to this order. It defines how the performance standards will be monitored, the frequency of surveillance, and the procedures for addressing performance issues(s). The Quality Assurance Surveillance Plan (QASP) for this order is included as Attachment A, and the Performance Requirements Summary (PRS) is included as Appendix 1 to Attachment A.
