This is a 'Limited Sources' justification. Purchase request number is F1L1HD4283A001.

II. Nature and/or description of the action being processed.

This is a new order requesting the purchase of 280 Tactical Aid to Flotation devices and 440 Padded Ballistic Inserts to be used for their First Spear Aviation Body Armor Vests (ABAV).

III. Description of supplies/services required to meet agency needs.

The First Spear Aviation Body Armor Vest (ABAV) is a specialized vest intended to protect CV-22 aircrew from preventative injuries/loss of life that has been tested and approved for use by HQ Air Force Special Operations Command (AFSOC). These vests are utilized by CV-22 pilots and Special Mission Aviators performing in-flight duties, including but not limited to: aircraft egress, human factors in the CV-22 cabin, aerial gunnery, hoist and alternate insertion/extraction operations, vehicle and cargo loading, scanning, and evasion.

The Tactical Aid to Flotation and Padded Ballistic Inserts for this vest are essential components to the vests. They provide a consistent level of protection from potential hazards CV-22 aircrew may encounter during missions and routine flights.

IV. Identification of the justification/rationale for limiting sources and demonstration of the contractor's unique qualifications to provide the required supply/service.

FAR 8.405-6 requires an ordering activity to justify its actions when restricting consideration of schedule contractors to fewer than required in FAR 8.405-1 or FAR 8.405-2. FAR 8.405-6(b)(1), “The item is peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.”

In accordance with (IAW) Assumption of Risk , the First Spear ABAV's and its accessories are the only tactical vests approved for wear for AFSOC non-ejection aircrew members. The current requirement is for padded ballistic inserts that go inside these vests. Due to the construction of the vests, First Spear branded inserts are the only ones that are compatible and approved for use by HQ AFSOC. Procuring First Spear inserts will ensure we adhere to the guidance in , while maintaining the integrity and operability of the vests we currently own.

V. Determination by the ordering activity Contracting Officer that the order represents the best value consistent with

FAR 8.404(d).

In accordance with FAR 8.404(d), GSA Advantage! was surveyed and the ordering activity found multiple vendors who had schedules/price lists available that provide the required First Spear items, or had the ability to obtain them via the open market. An RFQ will be posted on GSA eBuy under the NAICS 339113, as a brand name requirement with a 100% small business set-aside.

VI. Description of the market research conducted and the results, or explain why market research was not conducted.

Market research began by checking mandatory sources; UNICOR, AbilityOne, AF LaunchPad, and GSA Advantage.

After checking mandatory sources, the ordering activity continued conducting market research by reviewing a recent report for an identical requirement, which led to a short list of vendors. Furthermore, 142 additional small businesses were found on GSA advantage with GSA contracts under the NAICS 339113. Tactical & Survival Specialties, LLC (TSSI) is the only vendor on GSA that has a contract directly with First Spear that contains all the required products.

However, multiple other vendors on GSA were identified to have the necessary capabilities to provide the items through the open market.

IAW FAR 8.405-1(e), this requirement will be solicited as an RFQ via GSA eBuy as a 100% small business set aside.

Additionally, since this is a brand name requirement, this justification will be posted along with the RFQ.

VII. Other facts supporting the justification.

The Squadron conducted an Operational Utility Evaluation (OUE) of the First Spear ABAV's in February 2022. Report outlines the OUE that was conducted and the successful results of the evaluation. This report was critical in the decision to mandate the wear and use of First Spear ABAV's across AFSOC. It is imperative that we adhere to this mandate, which includes ensuring the procurement of approved and compatible accessories (i.e. padded ballistic inserts).

VIII. Actions the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services.

27 SOCONS will continue to survey the commercial market in an effort to locate additional sources for similar requirements.

Actions to further remove barriers consist of research to evaluate other tactical vests and/or accessories compatible with First Spear ABAV's, as well as, products in congruence with the health and safety standards upheld by AFSOC for the wear and use by non-ejection aircrew members. Should this be identified, future competition would be possible.
