Justification for Brand Name Products
Date: 5/18/2024
Project: Purchase New Skid Steer for Grant-Kohrs Ranch National Historic Site
1. Identifications
a. Agency: National Park Service
b. Contracting Office: NR MABO
2. Description of the action being approved:
The National Park Service (NPS) shall be soliciting for a Bobcat S64 T4 and 86” HD Snow Blade. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).
3. Description of supplies and services:
Procurement of one (1) S64 T4 Bobcat Skid Steer and 86” HD Snow Blade
4. Authority:
a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.
c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition:
The compact size and versatility of this machine will allow the Maintenance and Resource Management divisions to remove manure and debris from historic livestock pens, shelters, and barns. Its light weight will minimize surface impact and allow it to be used in fragile areas for trail maintenance and for various tasks in historic pastures and grasslands. Additionally, the compact size paired with high horsepower will allow for snow removal, ice mitigation, historic structure stabilization, and support throughout an extensive historic district and in visitor use areas. This machine will also be used for large object or pallet moving within park grounds. The Bobcat S64 T4 will allow the park to use a variety of park owned bobcat attachments already in inventory (Auger, Grapple, Broadcaster, Snow Bucket, Grading Bucket, Rock Bucket totaling $20,000 in estimated value) the added comfort package will equip it with a fully enclosed, heated, and air-conditioned cab to allow for safe operation during inclement weather.
6. Efforts to obtain competition:
a. Efforts to ensure offers are solicited from as many potential sources as is practicable:
For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.
b. Presolicitation notice per FAR 5.2:
For acquisitions over $25,000 a presolicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:
Exhaustive market research has been performed on this product as well as any like-kind alternatives. Funded price is based on average fair market value of the listed items.
8. Description of the market research conducted:
While other products on the market perform a similar function, this product is unique in its size (small/powerful) and has the ability to fit and operate our significant inventory of Bobcat attachments. Its versatility, visibility, and safety features are significantly better than competition, which is of utmost criticality in a National Park. Various vendors in surrounding area have been contacted for quotation.
9. Other facts supporting other than full & open competition:
a. Reason why documents suitable for full & open competition have not been developed:
Numerous Hydraulic attachments already owned by GRKO would not work with other name brand equipment of a similar style.
b. Data, estimated costs or other rationale as to the extent or harm to the Government:
GRKO would be required to purchase all new hydraulic attachments (grapple, auger, forks, broadcaster, and various buckets totaling $20,000 or more) in order to use a similar machine of a different brand.
10. Interested Sources:
Suggested vendor Bobcat of Helena 812 Chestnut St, Helena, MT, 59601 (406) 422-6558 (see attached quotation). Product may be acquired from any secondary source, this is not advocating for sole source, just for Brand Name.
11. Actions to remove barriers to competition in the future for similar acquisitions:
This will be a one-time acquisition; I do not intend to purchase in-kind again.
