Re: Pre-Renovation Asbestos Survey and Lead-in-Paint Screening (8/20/12)

NUWC

Newport, RI Location: Building # 114

Dear Mr. Karoli:

As requested, Mystic Air Quality Consultants, Inc. conducted a pre-renovation survey of accessible materials at the address above on August 20, 2012. This survey was conducted by Christopher Muller, a Connecticut State licensed asbestos inspector (license #000215), to determine the presence of asbestos-containing materials. The samples were analyzed by polarized light microscopy at Environmental Hazards Services (NVLAP # 101882-0) in Virginia.

In addition to the asbestos survey, a lead in paint screening of painted surfaces using a calibrated Niton XRF Spectrum Analyzer. The testing involved placing a calibrated X-ray fluorescence analyzer against representative painted surfaces to measure the concentration of lead in the paint at that location. The analyzer measures a square centimeter of surface area. Should there be more than I milligram of lead (0.9 mg/cm2to allow for equipment variation) detected in that location, the surface is considered by State law to be lead painted. Lead-painted surfaces are considered toxic to children under the age of six and to women who are pregnant.

Summary of the Asbestos Findings-

Upon testing by polarized light microscopy, the samples of peg board wall panels and green floor tile collected and analyzed from the above location were found to be asbestos containing.

Non-asbestos containing materials

The roster of suspect materials (Enclosure 2), lists the materials tested. Those that are not already referred to as asbestos containing or assumed asbestos, can be categorized as non-asbestos containing materials.

Implications of the fmdings

As required by state and federal regulations prior to renovation or demolition, any asbestos-containing materials listed above that could be disturbed by a renovation, will need to be removed by a licensed asbestos abatement contractor employing trained and certified personnel who follow all pertinent asbestos abatement regulations.

Limitations of the Asbestos survey

This survey and report oniy deal with accessible areas of the building. Additionally, there may be other non-accessible materials above ceilings, behind walls, and below floors that become evident during your renovation activity. Should the requisite EPAJOSHA competent person working for the contractor discover such materials they will need to be tested for asbestos content so determinations of their abatement and disposal (if required) can be made.

Summary of Lead-In-Paint Screening

The results of the testing have determined that all of the radiators and door cases were found to be lead painted. See Enclosure (5) for the lead screening results.

OSHA and lead in construction

In addition there are requirements concerning employee exposure to lead in the workplace that apply to this property (OSHA lead standard 1926.62). Essentially these are federal OSHA standards that contractors you might hire to do renovations, repairs, remodeling/demolition are required to follow.

Regardless of the test results, please note that OSHA does not consider lead-in-construction pre testing of paint in place as indicative of exposure potential because certain types of work procedures can actually release harmful levels of lead by separating it from the paint and making it airborne as dust. Activities such as dry scraping, sanding or abrading painted surfaces are typical workplace procedures that can create this situation.

Sincerely, D j

Information on Lead Testing

Lead-Based Paint Survey

Testing Equipment: Niton XL 309-U31 1285

For the lead based paint survey, measurements were taken with a calibrated XRF (X-ray Fluorescence) Spectrum Analyzer, using the State of Connecticut testing protocol for spectrum analyzers. Measurements were taken in each area of at least one accessible painted wall, ceiling, window, door, baseboard, and any other painted surface (except factory painted metal surfaces in good condition).

Locations of these areas is indicated alphabetically, with (A) being the street side of the building andJor room, and (B), (C) and (D) respectively following in a clockwise direction.

If the accompanying report sheets have more than one measurement listed per substrate, the last measurement is the definitive one for that surface.

Measurements at or above 0.9 mg/cm2 are considered to be lead paint.

Limitations and Uses of Inspection Data

This inspection for lead base painted surfaces is a “representative areas” survey as indicated on page 1 of this enclosure.

Limitations of this report

This report does not make any claims about the surfaces in the structure that are of the same type of material, but which were not themselves tested.

As a specific example of this limitation, if only one window in a room were tested, its results can not be presumed to be applicable to other windows in that (or any other) room. If any assumptions are to be made from the results of this report, they would have to be made in favor of treating an area as if it were lead-base painted (in a “universal precaution” approach).

Use of this report

This report can not be used as a lead abatement or management plan.

The data in this report could only become part of a lead abatement or management plan if it were to be augmented by

(a) assumptions that all non-tested areas were lead based or

(b) with additional testing to determine each specific area as it will be addressed in the lead abatement or management plan.

Next step for lead based paint

Subsequent steps to this “representative areas” inspection include creation of a written lead abatement plan, or a lead management plan, in cases where lead based paint was detected and the authority initiating the inspection considers the presence of lead based paint cause for instituting an abatement andlor management activity.
