About this file
This document is Attachment 2 of a solicitation containing Additional Instructions and evaluation criteria for a federal contract award.
The Government intends to select one contractor to provide NIC Transportation services commencing April 1, 2026, under a Lowest Price Technically Acceptable (LPTA) selection methodology. The contract includes a 6-month base period, four 1-year option periods, and an optional 6-month extension. The resulting contract will be firm-fixed price with Economic Price Adjustment (EAP) on an Indefinite-Delivery Requirement basis, with fuel representing approximately 15% of the Contract Line Item Number (CLIN) price. EPA adjustments apply only if fuel prices change by ±10% and may be employed only at the time of quarterly task orders, using U.S. Energy Information Administration Rocky Mountain PADD 4 Diesel retail prices as the reference point. Total evaluated price includes all proposed CLINs and option prices. The Government reserves the right to award no contract based on proposal quality and may reject unrealistic offers, including those with materially unbalanced pricing.
Evaluation comprises three factors: Technical Acceptability, Past Performance, and Price, evaluated on an acceptable/unacceptable basis with no technical tradeoffs permitted. Technical requirements mandate that the contractor provide one 21-passenger mini coach bus and one 55-passenger large coach bus, both air-conditioned and heated with backup vehicles for breakdowns, Federal Motor Vehicle Safety Standards compliance, communication devices for all vehicles and personnel, required Colorado state licenses and permits, and Class C licensed drivers. Offerors without relevant past performance records will be rated as having "unknown" past performance, considered acceptable. Each proposal must clearly address all Statement of Work requirements and identify any exceptions with complete rationale.

Additional Instructions
General
Award will be made to the lowest priced, technically acceptable, responsive and responsible Offeror. This is a competitive LPTA selection in which technical acceptability is considered the most important factor. By submission of its offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Offerors must clearly identify any exception to the solicitation and conditions and provide complete accompanying rationale. The Government intends to select ONE contractor for award. The contractor shall commence full performance of services under this contract on April 1, 2026.
The contract will include a 6-month base period, with four (4) one year option periods and an optional 6 month extension.
1. Number of Contracts to be awarded:
The Government intends to select one contractor to provide the services covered herein. However, the Government reserves the right to award no contract, depending on the quality of proposals and prices submitted.
2. Rejection of Unrealistic Offers:
The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions or unrealistically high or low in price when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of program.
Evaluation
This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures. Failure to meet a requirement may result in an offer being determined technically unacceptable. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the acceptable Offeror with the lowest evaluated price, which is deemed responsible and whose proposal conforms to the solicitation requirements.
The Government reserves the right to award without discussions.
Therefore, each initial offer should contain the Offeror’s best terms from a price and technical stand point. However, the Government reserves the right to conduct discussions if determined to be in the Government’s best interest by the Source Selection Authority (SSA).
Evaluation Factors
The Government will evaluate the factors and subfactors described below:
Factor 1 – Technical Acceptability Factor 2 – Past Performance Factor 3 – Price
1. Evaluation Methodology:
A technical evaluation will be performed on all offers. The lowest priced offer will be evaluated for past performance. The offeror’s response will be evaluated on an acceptable / unacceptable basis. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards.
2. Price
The offeror’s price proposal will be evaluated based upon the total evaluated price. The total evaluated price will be calculated as the sum of the proposed prices for both CLINS and all options. Evaluation of options is not a guarantee that the option will be exercised by the government.
The Government may also determine a proposal unacceptable should the proposed prices, be materially unbalanced.
Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more items is significantly overstated or understated as indicated by the application of price analysis techniques.
Proposed prices will be evaluated for reasonableness. For a price to be reasonable, it shall represent a price to the Government that a prudent person would pay when consideration is given to prices in the market. Price reasonableness may be established by adequate price competition and/or price analysis techniques.
The resulting contract will be a firm-fixed price (FFP) with Economic Price Adjustment (EAP)Indefinite-Delivery Requirement type contract. Contract pricing shall include all charges to the Government for the provision of the NIC Transportation services (e.g. overheard, profit, maintenance, etc.).
This solicitation indicates that, solely for the purpose of the EPA, fuel represents about 15% of CLIN price. The initial reference point is U.S. Energy Information Administration (eia) for Rocky Mountain PADD 4 Diesel retail prices on the effective date of contract award, EPA applies only if fuel prices change is +/- 10% and Government will allow EPA to be employed only at the time of quarterly task orders. The link to eia is http://www.eia.gov/petroleum.
3 Past Performance
The government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of this RFP. In the case of an offeror without a record of relevant and recent past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.
Therefore, the offer shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable.”
Past performance information shall be obtained from any sources available to the Government.
4 Technical Factor:
Technical proposals will be evaluated for acceptability in accordance with the criteria set forth in this section. The offeror’s technical proposal must convey to the Government that the Offeror is capable, possesses adequate technical expertise and experience, possesses sufficient resources, and is able to plan, organize, and use those resources in a coordinated and timely fashion to meet the needs of the Government.
Proposal’s technical requirements will be evaluated on acceptable / unacceptable basis:
• Contractor must be able to accommodate transportation to and from a hotel within 30 miles of the NCA Training Center for all of the training programs.
http://www.eia.gov/petroleum
• Contractor shall provide a mini coach 21 passenger bus.
