About this file
Attachment 2 is a document containing additional U.S. Customs and Border Protection (CBP) clauses to be incorporated into a purchase order for a federal contract. The document includes three key sections: Contracting Officer's Authority, Electronic Invoicing and Payment Requirements, and Government Consent of Publication/Endorsement. The Contracting Officer's Authority clause emphasizes that only the Contracting Officer can approve changes, accept nonconforming work, waive requirements, or modify contract terms. The Electronic Invoicing section mandates that payment requests must be submitted electronically through the U.S. Department of the Treasury's Invoice Processing Platform (IPP) beginning April 11, 2016.
The document also includes a provision for 52.212-2 Evaluation of Commercial Products and Commercial Services, which outlines the government's approach to awarding contracts based on the most advantageous offer considering price and other factors. The Government Consent of Publication/Endorsement clause prohibits the contractor from referencing the supplies, services, or equipment in news releases or commercial advertising without explicit written consent from the Contracting Officer, and prevents implying government endorsement or preference for the product or service.

52.212-2 Evaluation—Commercial Products and Commercial Services.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors shall be used to evaluate offers:
________________________________________________[Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the
Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.]
