About this file

This document is Attachment 2 to a federal solicitation, containing additional U.S. Customs and Border Protection (CBP) clauses to be incorporated into a purchase order. It includes two primary sections: Contracting Officer's Authority and Electronic Invoicing and Payment Requirements. The Contracting Officer's Authority clause establishes that only the Contracting Officer can approve changes, accept nonconforming work, waive requirements, modify terms, or legally obligate government funds. The Electronic Invoicing and Payment Requirements section mandates that payment requests for new awards must be submitted electronically through the U.S. Department of the Treasury's Invoice Processing Platform (IPP) beginning April 11, 2016, with contractor assistance available for enrollment.

The document also includes a Government Consent of Publication/Endorsement section prohibiting contractors from referencing supplies, services, or equipment in news releases or commercial advertising without explicit written consent from the Contracting Officer. Additionally, it contains a standard evaluation provision for commercial products and services (52.212-2), which outlines the government's approach to awarding contracts based on the most advantageous offer, considering factors such as technical capability, price, and past performance. The provision allows for evaluation of options by adding total prices and notes that a written notice of award can result in a binding contract without further action by either party.

52.212-2 Evaluation—Commercial Products and Commercial Services.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
