About this file
This is a federal certification provision template for the Buy American—Balance of Payments Program Certificate, effective February 2024. The provision applies to all line items in solicitations subject to the Buy American and Balance of Payments Program—Basic clause and requires offerors to certify the country of origin and domestic content status of end products being offered.
Offerors must certify whether each end product is a domestic end product, a qualifying country end product, or a foreign end product. For domestic end products, offerors must identify which ones contain critical components or critical items. For foreign end products that do not consist wholly or predominantly of iron or steel, offerors must indicate whether they exceed 65 percent domestic content, with an exception for commercially available off-the-shelf (COTS) items. If domestic content percentage is unknown, offerors must select "no." The Government will evaluate offers in accordance with Part 225 of the Defense Federal Acquisition Regulation Supplement and will evaluate qualifying country end products without regard to Buy American statute or Balance of Payments Program restrictions. The provision includes four certification sections requiring line item numbers, countries of origin, domestic content percentages, and identification of products containing critical components or items. The certificate must be signed by an authorized company representative with printed name, title, and date.
