2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:

This action is to request the approval of a Brand Name Justification (BNJ). The United States Air Force (USAF), Air Combat Command's (ACC), 363rd Intelligence, Surveillance and Reconnaissance (ISR) Wing, headquartered at Joint Base Langley-Eustis, Virginia, requires a brand name only Firm Fixed-Price PO for information technology (IT) equipment items listed in Section 3 below.

The 363rd ISR Wing requires procurement of audio-visual IT items in support of their mission in new Military Construction (MILCON) projects located at Nellis AFB, NV to conduct lethal, resilient, and ready operations across four key mission areas: analysis of air, space, and cyber operations;

full-spectrum targeting; special operations ISR; and ISR testing, tactics development and advanced training. The 363rd ISRW is comprised of the following subordinate units: 361st ISRG

Brand Name Justification FAR 13.501(a), Sole Sources (including brand name) Acquisitions

Hurlburt Field FL, 363rd ISRG Joint Base Langley-Eustis, VA, and 365th ISRG, Nellis AFB, NV.

The 363rd ISRW continues to design, procure, configure, integrate, test and fit-out the Nellis and Langley MILCON mission systems. The required items listed in this BNJ satisfy the 363rd ISRW’s IT fit-out requirements and meet the stringent IT Risk Management Framework (RMF) and Authority to Operate (ATO) screening and approval processes. See paragraph 4 below for further details.

It is anticipated that an open market PO will be competed and evaluated in accordance with FAR 13.106-2 (Evaluation of quotations or offers).

3. A DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS(INCLUDING THE ESTIMATED VALUE):

The equipment must be brand new in original equipment manufacturer (OEM) packing shipped from an authorized federal reseller for each of the brand name items required. The government does not require the equipment to be Trade Agreements Act (TAA) compliant, as per FAR 25.401(a)(1), which exempts small business set-asides from TAA requirements. Therefore the FAR reverts back to the Buy American Act (BAA) which does apply to this procurement; however, the exception under FAR 25.103(e) applies. This exception states that the BAA is not applicable to information technology that is a commercial product, which includes the specified equipment in this procurement. This decision was reached after thorough market research, which revealed that maintaining TAA compliance across all required products would limit our vendor pool (see section 8 for additional information). The use of standardized AV hardware brands plays a crucial role in ensuring operational efficiency, consistency, and overall effectiveness. Using the same AV hardware brand ensures a consistent user experience across all locations. Standardized hardware means that once an employee is trained on the system at one location, they can easily support the same system at any other location. This reduces the time and effort required for additional training, the organization can develop a single, comprehensive training program. This is more efficient and cost-effective compared to creating multiple training modules for different hardware. The AV team can specialize in troubleshooting specific hardware, making it easier and faster to resolve issues. This also means that support resources (manuals, guides, troubleshooting steps) can be standardized. Standardizing ensures that the chosen hardware is reliable and compatible with the organization's existing infrastructure. This minimizes the risk of integration issues and incompatibilities that could arise from using different brands and reduces the likelihood of system failures and downtime. Lastly, standardizing on a particular brand allows for coordinated and streamlined upgrade paths. New features and improvements can be rolled out uniformly, ensuring that all locations benefit from the latest technology advancements. Different hardware brands may not integrate seamlessly with existing systems, causing potential compatibility issues and operational disruptions. In conclusion, standardizing AV hardware across all locations in an organization is crucial for maintaining consistency, simplifying training and support, achieving cost savings, and ensuring reliable and efficient operations. The equipment needed to meet the government's requirements can be found in the equipment list below.

The USAF 363rd ISR Wing has provided adequate funding by MIPR to GSA for obligation against the PO.

Shipping and handling terms are F.O. B. Destination. Inspection and acceptance shall be at a CONUS location.

Period of Performance/Delivery for this PO will consist of 120 days ARO.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY AND SUPPORTING RATIONALE:

The statutory authority for applying the FAR 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services is 41 U.S.C. § 1901 and the authority for restricting competition on this procurement is implemented by FAR 13.106-1(b)(2). No other like and/or similar products will meet the needs of the Government.

For purchases exceeding the simplified acquisition threshold, the requirements at FAR 13.501(a) apply. The need for a brand name requirement is justified in writing utilizing the format at FAR 6.303- 2 properly modified to reflect that the procedures at FAR 13.5 were used in accordance with 41 U.S.C. 1901. This justification will be approved at the levels specified in accordance with FAR 13.501(a)(2)(ii) and be posted with the solicitation in accordance with FAR 13.501(a)(iv).

The requested items are being procured by the GSA on behalf of USAF 363rd ISRW in support of the ACC mission. The ACC supports global implementation of national security strategy and assists national agencies with command, control, communications, and intelligence systems. The ACC also conducts global ISR operations to provide intelligence information to Government agencies.

All brand name equipment has been included in the DoD mandated Risk Management Framework (RMF) process. Only the requested brand name equipment meets the unique combination of interoperability, commonality, and cybersecurity approvals, with existing network equipment integrated at other ACC and 363rd ISRW mission system locations; Nellis AFB on MAS 47QTCA21A002G awarded on 29 September 2023; Langley AFB on MAS 47QTCA21A001J awarded on 30 September 2023; Beale Air Force base, ordered on contract N6833519F0542 by the

Naval Air Warfare Center on 22 July 2019. No other equipment can meet the cybersecurity, interoperability, and commonality requirements. The brand name equipment is included in the existing 363rd ISRW Non-classified Internet Protocol Router Network Cybersecurity Authority to Operate (ATO) issued April 1, 2021, the Secret Internet Protocol Router Network ATO issued April 1, 2021, and the Joint Worldwide Intelligence Communication System network ATO issued 01 October 2020.

All equipment has gone through testing and cybersecurity evaluation and provides the unique combination of capabilities, features, and prior DoD approvals required for use on DoD networks and approval in ATO for operation up to Top Secret / Sensitive Compartmented Information TS/SCI. The peripheral and ancillary products listed under this requirement are integral to the 363rd’s success in standing up their audio and visual facilities, and represent a total solution that has been rigorously vetted, tested and approved (at a systems level inclusive of Brands and products) for inclusion and operation within DoD IT infrastructure systems. All products associated with this requirement have been preapproved through the RMF and ATO framework. Any deviation, substitution or alternative product solution will result in a total revaluation of these pre approved brands and products. This would lead to unacceptable mission delays and ultimately failure of this project and the 363rd’s mission requirements. Therefore, it is necessary to view this requirement as a total products solution at a systems level (based on the ATO framework) versus an individual line by line product buy. Any deviation from the ATO approved equipment would result in fielding equipment delays and negatively impact continued mission support activities due to the (45–90) day lead time it takes to obtain ATO approval for IT solutions inclusive of specific brands and product types through the RMF process.

Therefore, no other like and/or similar products will meet the needs of the Government.

Given the Government’s unique requirements, the authority cited under FAR 13.501(a)(1) limiting items peculiar to one manufacturer is justified.

5. DEMONSTRATION THE NATURE OF THE ACQUISITION REQUIRES USE OF THE

AUTHORITY CITED):

The designated brand name products have been selected based on their proven reliability and performance. Using these products ensures that all operational aspects run smoothly without unexpected downtimes, which is crucial for mission-critical tasks. Consistent performance across all locations ensures that the organization's operations are predictable and reliable, essential for planning and executing mission-critical activities. Other brands may not have the same track record of reliability, leading to increased risks of equipment failures and operational downtime, which can critically impact mission success. Other brands may introduce compatibility issues that may not integrate seamlessly with existing systems, causing operational disruptions and inefficiencies.

Designated brands often come with robust security features and certifications that comply with governmental and industry standards. Using other brands might introduce vulnerabilities and non-compliance risks. Other brands might not have the same level of security features, making the organization's systems more vulnerable to cyber threats. This is particularly critical for sensitive operations. Sticking to designated brand name products for AV hardware and peripheral equipment is essential for maintaining operational consistency, reliability, and security. Allowing "other" brands may introduce significant risks, including operational downtimes, increased costs, security vulnerabilities, and compliance issues.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM, AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A

NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT,

WHICH EXCEPTION UNDER 5.202 APPLIES:

The government plans to post a Request for Quotation (RFQ) on SAM.gov as a 100% small business set-aside since market research indicates there is a reasonable expectation of receiving quotes from at least two small business concerns after first considering small business socioeconomic contracting programs (i.e., 8(a), HUBZone, SDVOSB, or WOSB programs). Due to the diverse nature of the products included in this procurement, the government intends to allow Joint Ventures (JVs) and collaborative vendor arrangements as defined in FAR Part 19 to encourage collaboration among companies to offer comprehensive solutions. This approach is expected to increase competition by enabling companies to combine their respective strengths and expertise, ensuring that the government receives competitive quotes that meet its diverse requirements.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The contracting officer has determined the establishment of this PO represents the best value (as defined in FAR 2.101) to the Government and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

The Contracting Officer shall ensure that all quotes received are fairly considered and award is made in accordance with the basis for selection in the RFQ. After competing this requirement amongst the open market, a best value determination for award will be documented. Prior to awarding the PO, the Contracting Officer will seek price reductions from any qualified vendor quoting the required part numbers listed above (Section 3).

The Contracting Officer anticipates the use of a variety of price analysis techniques using FAR 13.106-3 to substantiate price reasonableness and evaluation of the items requested. These techniques included, but are not limited to the following:

(1) Whenever possible, base price reasonableness on competitive quotations or offers.

(2) If only one response is received, include a statement of price reasonableness in the contract file. The contracting officer may base the statement on-

(i) Market research;

(ii) Comparison of the proposed price with prices found reasonable on previous purchases;

(iii) Current price lists, catalogs, or advertisements. However, inclusion of a price in a price list, catalog, or advertisement does not, in and of itself, establish fairness and reasonableness of the price;

(iv) A comparison with similar items in a related industry;

(v) The contracting officer’s personal knowledge of the item being purchased;

(vi) Comparison to an independent Government estimate; or

(vii) Any other reasonable basis.

HEAD OF CONTRACTING ACTIVITY CERTIFICATION
