RFI Questions and Responses for Solicitation # W911S222R8000

Question 1: FAR Clause 52.228-1 Bid Guarantee is only incorporated by reference in the solicitation documents. Therefore, the blanks for the “____ percent of the bid price or $_____, whichever is less,” have not been filled in. Are we correct in assuming that the bid guarantee should be for 20% of $22,000,000, or $3,000,000, whichever is less?

Answer 1: FAR Clause 52.228-1 Bid Guarantee should be included by Full Text, not by reference, Solicitation has been amendment to incorporate this change.

Question 2: Please confirm that one (1) original hard copy of the proposal and one (1) CD, containing Sections I – IV are required.

Answer 2: Yes. Proposals shall be submitted in accordance with Section 00100, PART I –

INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS, paragraph 3.

Question 3: Would the Government prefer one (1) binder, with each section clearly marked with a cover page and tabs, or a separate binder for each Section?

Answer 3: Proposals shall be submitted in accordance with Section 00100, PART I –

Question 4: Is position of SSHO allowed to be a dual position? In other words, may the SSHO also be the QC Manager or similar position?

Answer 4: Yes, as long they meet the requirements of SOW paragraph 1.3.3 and SECTION

00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph 42.3.

Question 5: In the RFP Section 52.4.1. The CCI for task orders at Fort Drum, NY will use the

Weighted Average Total CCI published for Watertown, NY, updated at option exercise concurrent with the Annual Database. Can the Government confirm if the CCI quarterly updates would be applied in the UPB? For example, given the current economic impacts to pricing, specifically at Watertown, NY the 2022 Weighted Average Cost for 2022 is 97.60, however the

2022 Q1 Weighted Average Cost is 111.80. Quarterly updates within the UPB with respect to

CCI will greatly impact contractors coefficients upon submission.

Answer 5: Quarterly updates within the UPB with respect to CCI will not be used. The annual

CCI for Watertown, NY shall be used. The 2022 Weighted Average Cost for 2022 is 97.60.

Subsequent option years shall also use the annual CCI for Watertown, NY; concurrent to the year in which the option is exercised.

Question 6: Section 00800 – Additional Contract Requirements, paragraph 9.1 states, “The

Contractor shall maintain a web-based database of all approved submittals, searchable by division, task order number, and submittal number. Registry/Division shall follow the layout of the technical specifications.” To meet the contractual requirements and comply with DFARS

Clause 252.204-7012, what software has been utilized historically?

Answer 6: The system is web based and shall be accessible by any standard web browser. It shall only include submittals and DFARs 252.204-7012 does not apply.

Question 7: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

6, page 17 of 98 lists a number of bulleted items that are included in the Offeror’s coefficients.

Bullet #16 notes costs associated with “Shipping of all materials to the jobsite” are to be included in the coefficient. Section 00100, Bidding Schedule/Instructions to Bidders, paragraph 6, page 10 of 98 contains a section entitled “Bare costs are defined as:”, the first bulleted paragraph defines as a bare cost “Material costs, which may include freight…”

Page 10 or 98 indicates freight is a component of the material base cost and page 17 of 98 indicates freight is part of the coefficient that is to be applied to the bare costs. Please clarify, however in our opinion the best approach would be to allow the freight cost to be a component of the material bare cost as the freight is typically included in the material cost or quoted as an adder to the material cost

Answer 7: Offerors are encourage to see Section 00100. BID SCHEDULE, paragraphs 1.0 through 2.2, paragraph 4.2, paragraph 6, and SECTION 00800 – ADDITIONAL CONTRACT

REQUIREMENTS, paragraphs 52.0 thru 52.8.2. Questions regarding weather a particular cost should be included into the coefficient need to be answered by the Offeror reviewing the Unit

Price Book. All line items in the Unit Price Book are allowable unless this solicitation prohibits its use and as long as the line item is being used for its intended purpose, as defined in the Unit

Price Book. Each project awarded from this contract will be priced by multiplying the summation of the unit price book line items by the Offerors coefficient. The Offeror will not be allowed any adjustments to the coefficient or any allowance at time of Task Order award due to failure to appropriately price its coefficient. This solicitation has provided information to assist the Offeror in preparing its coefficient. However, the Offeror assumes 100% of the risk ensuring its coefficient is accurate.

Question 8: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

Please clarify the meaning of the 9th bullet “Phase In/Phase Out”

Answer 8: Phase In/Phase Out are the initial costs to setup the office site, other associated costs, and to close out after contract is complete.

Question 9: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

The 10th bullet is “Site cleanup”, does this component include the disposal costs associated with the site cleanup?

Answer 9: No. See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph 52.6.

Question 10: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

The 14th bullet is “Quality Control”, please clarify what elements of quality control are included in this cost category. Is it only the on-site QC staff or does it include quality control elements such as on-site material testing, special inspections, etc.?

Answer 10: Shall include all costs associated with the day-to-day tasks of Quality Control. See

SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph 52.6.

Question 11: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

The 22nd bullet is “Any markups for materials and contingencies”, please clarify what are considered to be contingencies. Would weather related contingencies such as winter construction requirements (hot water in concrete, enclosures, heaters, etc.) be considered to be contingencies?

Or are these contingencies specific to materials? More definition of “contingencies” is required.

Answer 11: The Government will not modify or increase costs due to weather, so the contractor needs to account for weather related contingencies in its coefficient. See SECTION 00800 –

ADDITIONAL CONTRACT REQUIREMENTS, paragraph 52.6.

Question 12: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

The 25th bullet is “General Conditions”, the cost data reference information includes specific

“General Conditions” line items, an example would be portable toilets. To clarify this cost category should it be entitled “General Conditions items not specifically listed in the cost data references”?

Answer 12: See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph

52.6.

Question 13: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

The 27th bullet is “Compliance with EPA/OSHA regulations and protection and safety laws”, this is a broad description that could include such items as asbestos containment, trench excavation shoring, task specific training such as HAZWOPER. Please clarify this cost category.

Answer 13: See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph

52.6.

Question 14: Section 00100, paragraph 3, page 8 of 98, “BONDS”; requires a payment and performance bond in the amount of $22 Million at contract award and award of the option years.

Question #14.1 - With the issuance of the bonds at award and each year the bonding company will require payment for the full bond premium of the $22 Million bond which depending on the awardees bond program could be anywhere from low $100,000 to over $200,000. Will the

Government permit this premium to be billed at the onset of the contract and with each option year or will the Government require the contractor to finance the cost of the bonds for the contract period? If not allowed to bill for the bond premium at the onset, premium recovery will only occur through the award of individual task orders.

Question #14.2 – The bond premium rates differ dependent if the task orders include a design component or if the task order is pre-designed (design-build vs. design-bid-build). Will the task orders be considered to be design-build or design-bid-build?

Answer 14.1: Yes. See Section 00100 BID SCHEDULE, paragraph 3 and AFARS 5117.9004-

2(g).

Answer 14.2: They could be either or based on the information provided in the Scope of Work.

See AFARS 5117-9002(b). For AFARS website see FAR Clause 52.252-2.

Question 15: Section 00100, ‘Bid Schedule’, paragraph 6.0 includes a CLIN table that requires the bidding contractor to input coefficients for:

0001a – Normal Working Hours

0001b – Emergency Work Hours

0001c – Accelerated Work Conditions

0001d – Non-Prepriced Items

For CLIN 0001d it is noted in the table that the coefficient is to be a decimal less than 1.00, representing “…all overhead and profit for non-prepriced items…”. Please confirm that this coefficient will be multiplied by the non-prepriced work subtotal (representing the total overhead and profit) and then added to the non-prepriced work subtotal to obtain the grand total cost for the non-prepriced work.

Answer 15: See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph

29.2.

Question 16: Section 00100, Part I, paragraph 2.3.3.2, utilizes the included price evaluation table to obtain a total price that is used by the Government to determine low price for evaluation purposes. The Work Conditions included in the evaluation table are Normal, Emergency and

Accelerated.

The Section 00100, ‘Bid Schedule’, paragraph 6.0, CLIN table includes coefficients for the above listed Work Conditions and also includes a non-prepriced overhead and profit markup percentage.

The Section 00100, Part II, paragraph 2.3.3 Factor 3: Price evaluation criteria does not include an evaluation, for purposes of award, of the non-prepriced overhead and profit markup percentage.

Please confirm that the non-prepriced overhead and profit markup percentage is not evaluated for purposes of award.

Answer 16: See Bid Schedule Table under Section 00100, PART II – EVALUATION

FACTORS FOR AWARD, paragraph 2.3.3.2.

Question 17: Can the numbering of the various 00800 sections be updated to allow better reference between the several 00800 sections.

Answer 17: No.

Question 18: Section 00800, paragraph 52, Unit Price Book (UPB); the 2022 Means data is used for the Base contract period and is the Means Cost Data is updated annually and used for each subsequent option period. It is unlikely that the year-to-year contract term will coincide with the date that the Means Cost Data is updated. From a pricing perspective how is this difference between contract term and Means Cost Data update handled?

52.

Question 19: Section 00100, Bid Schedule, paragraph 3.0 – Proposal Format; for Section I please confirm the following:

“Executed Request for Proposal” – please confirm that this is the SF1442

“Filled out Section 00600” – please confirm that this is Representations and Certifications in

Section 00600

Answer 19: See Section 00100, PART I – INSTRUCTIONS, CONDITIONS AND NOTICES

TO OFFERORS, paragraph 3.

Question 20: Section 00100, Part 1, paragraph 6 Factor 3: Price; states the “JOC IDIQ price proposal shall consist of the Bid Schedule, Paragraph 6 Table”. The last sentence of this first paragraph states “The Bid Schedule Table is also shown below in Part II, paragraph 2.3.3.2”. The

Bid Schedule Table in Part II is not the same as the Bid Schedule Table in paragraph 6. Please clarify.

Answer 20: See Section 00100, PART I – INSTRUCTIONS, CONDITIONS AND NOTICES

TO OFFERORS, paragraph 6. There are two different tables referenced in paragraph 6.

Question 21: Section 00100, Part 1, paragraph 6 Factor 3: Price; in the second paragraph of instruction states in part “The sum of all working hours will equal the grant (sic) total and will be entered for the NET AMOUNT under CLIN 001.”. Please clarify this sentence as it does not seem to apply to the paragraph 6 Table.

Answer 21: See Section 00100, PART I – INSTRUCTIONS, CONDITIONS AND NOTICES

TO OFFERORS, paragraph 6. Grand total is applied to each CLIN 0001 through 4001 on the

NET AMOUNT line.

Question 22: Reference Section 00100, Part I, Factor 2: Past Performance, paragraph 5.1.

Question #22.1 – What is the maximum number of past projects that can be submitted

Question #22.2 – A “Performance Assessment Questionnaire” form has not been included in the

RFP documents.

Question #22.3 – Please provide more specific project relevancy criteria. The evaluation section

Part II, paragraph 2.3.2.1 only states “To be relevant, the Offeror’s work experience must be similar in nature of work, size, magnitude, complexity and scope to that required under the solicitation.”. The Statement of Work, paragraph 1. Scope of Work lists the type or work tasks by trade but does not indicate any size, magnitude or complexity attributes.

Question #22.4 - according to the Past Performance criteria the past experience of “major subcontractors” will be considered for evaluation. What does the Government consider to be

“major subcontractors”?

Question #22.5 – according to the Past Performance criteria the past experience of “major subcontractors” will be considered for evaluation. Where in the proposal are “major subcontractors” to be identified and is a letter of commitment to/from these major subcontractors required to confirm the mutual commitment for utilization on this contract?

Answer 22.1: See Section 00100, PART I – INSTRUCTIONS, CONDITIONS AND NOTICES

TO OFFERORS, paragraph 5.4.

Question 23: Reference the Statement of Work document, in various locations within the

Statement of Work there is an Exhibit D referenced. This Exhibit is not included in the Draft

RFP documents.

Answer 23: Exhibits were never included in the draft RFP, only the solicitation and the SOW.

Exhibit A has been included in the solicitation. Any references to Exhibit D will be changed to

Exhibit A in the SOW.

Question 24: Reference the Statement of Work document, SOW Part 4, reference is made to e4Clicks software. There is no other reference to the use of this software in the RFP documents.

Will e4Clicks software be required to be used on this contract?

Answer 24: Yes.

Question 25: Statement of Work, paragraph 1. Scope of Work, last sentence states “Ft. Drum will not provide any office or government space on the installation.” Will a location be provided on Ft. Drum for a temporary field office (trailer) to be placed?

Answer 25: No.

Question 26: Draft Solicitation paragraph 5.2 Maximum Value (page 10 of 103), states “The estimated dollar value of each annual ordering period is $22,000,000.00 or $110,000,000.00 total estimated amount of the base and option periods”. For bidding purposes when developing the bid coefficients, can the Government clarify how many task orders are expected within a single annual ordering period?

Answer 26: See Section 00100, BID SCHEDULE, paragraph 1.1.2.

Question 27: Please provide further clarification as to a ‘typical’ task order that may be priced as part of this JOC. For bidding and estimating purposes, can the Government provide a sample project with an assumed scope of work and quantities to be used for developing and refining the requested bid coefficients?

Answer 27: No. See Section 00100, BID SCHEDULE, paragraph 1.1.2.

Question 28: Section 00100 Part I, Instructions to Offerors, paragraph 4.1.2 states in part

“Provide an organizational chart that includes job category/title with qualifications/skills and resumes for all key personnel listed in Attachment 1”. Referencing Attachment 1, Statement of

Work, paragraph 1.3.3 for the On-site Quality Control (QC) Manager; will it be necessary to provide a resume for the Alternate QC Manager at this time considering this individual is not necessarily a “key” member for the management team?

Answer 28: No.

Question 29: How will liquidated damages for each task order be established? The RFP includes

FAR 52.211-12 but the liquidated damages amount is not stated. Bonding companies would need to know how the liquidated damages would be calculated to determine the limits of exposure.

Answer 29: Liquidated Damages will apply, as needed, to the individual task order. Historically over the last four years liquidated damages were one percent of the obligated amounts in Section

00100, BID SCHEDULE, paragraph 1.1.2.

Question 30: The SF1442, Block 13.B indicates a bid guarantee is required. Section 00100, Instructions to Offerors paragraph 1.3 (page 11 of 98) states a bid guarantee is required, see FAR

52.228-1. Referencing FAR 52.228-1 the limits are not provided. Please clarify the bid guarantee requirements.

Answer 30: FAR Clause 52.228-1 Bid Guarantee should be included by Full Text, not by reference, Solicitation has been amended to incorporate this change.

Question 31: Attachment 1, Statement of Work, paragraph 1.3.1 through 1.3.5 include past project experience requirements for the key personnel. As an example, for the Contract Manager with a Bachelor’s degree requires 5 years of experience on multiple construction projects totaling over $20 million. Please clarify if the $20 million project total has to occur over the 5 years of experience or if the experience time period is independent of the project cost total.

Answer 31: The $20M is a combined total over the 5 years.

Question 32: In review of the RFP referenced 2022 pricing guides that are to be used for pricing the individual task orders it appears that the material costs do not accurately reflect the current material price spikes and rapid inflationary and supply chain trends that have been experienced into 2022. How are these unpredictable material price increases and decreases fairly reflected in the coefficient pricing considering the quoted coefficient will be in place throughout the entire base and option year periods?

Answer 32: See SECTION 00800 – CONTRACT ADMINISTRATION DATA, paragraph

52.4.1.

Question 33: For bidding purposes, please clarify the assumed amount of individual task order awards that may be made in a typical annual ordering period? If a single assumed number of task orders isn’t available, can the Government provide a range of potential task order awards within a typical annual ordering period?

Answer 33: See Section 00100, BID SCHEDULE, paragraph 1.1.2.

Question 34: Section 00100, Part I – Instructions, Conditions and Notices to Offerors, paragraph

Please clarify the meaning of the 24th bullet “Waste and excess material”. Does this item only include incidental waste (for example incidental concrete waste when ordering concrete, or excess wire/cabling when ordering bulk quantities)?

Answer 34: Yes. See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph 52.6.

Question 35: Please confirm that excess soil material requiring removal due to excavating/backfilling or general site grading does not classify as ‘Waste and excess material’, and that costs due to exporting excess soil material will be directly handled by the pre-priced line items.

Answer 35: See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph

52.6.

Question 36: Please confirm offerors do not need to complete Section 00010.

Answer 36: Yes, Offerors shall complete Section 00010. See Section 00100, PART I –

INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS, paragraph 6, Factor 3:

Price.

Question 37: Section 00100, paragraph 1 lists equipment rental among the items included in the coefficient. However, the list of coefficient inclusions on page 17 includes only “incidental tools and equipment.” Please confirm that only small, incidental equipment is included in the coefficient, and that the contractor may include larger equipment rental line items in their estimates (provided that equipment is not already included in the installed line item).

Answer 37: Confirmed. See SECTION 00800 – ADDITIONAL CONTRACT

REQUIREMENTS, paragraph 52.6.

Question 38: Please confirm offerors are to complete and submit both the Coefficient Table on page 10 (in Section 00100) and the Bid Schedule Table on page 21.

Answer 38: Yes.

Question 39: Please confirm that the “Grand Total” coefficient from the Bid Schedule Table will be multiplied by $22,000,000 to determine the evaluated price.

Answer 39: Yes. See Section 00100, PART II – EVALUATION FACTORS FOR AWARD, paragraph 2.3.3.3.

Question 40: Please confirm the total price of a non-prepriced item is “subcontractor quote +

(NPI coefficient x subcontractor quote).”

Question 40: See SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS, paragraph 29.2.

Question 41: Please confirm that any work performed between 4 PM and 7:30 AM that is neither

Accelerated nor Emergency work will be priced using the Normal Working Hours coefficient.

Answer 41: That is correct.

Question 42: Approximately what percentage of work on the previous contract performed during other than normal working hours has used the Normal Working Hours coefficient?

Answer 42: Historically, as requested by the Government, less than one percent.

Question 43: Will Emergency Work apply only to immediate remediation of emergency conditions (i.e. make safe), or will it also apply to the follow up work to repair the affected area?

Answer 43: Emergency Work will be all-inclusive to that Task Order and Scope of Work.

Question 44: Additional Contract Requirements, paragraph 50 states in part that the Contractor shall “be responsible for providing all necessary traffic control (e.g., street blockages, traffic cones, flagmen), as required for each specific Task Order at no additional cost to the

Government.” On the few projects where traffic control is required, items such as jersey barriers and traffic control signs are a significant task order expense. Would the Government consider excluding traffic control from the coefficient and allowing the contractor to include these costs on task orders as needed?

Question 44: Paragraph 50 has been updated in the Solicitation. See SECTION 00800 –

ADDITIONAL CONTRACT REQUIREMENTS, paragraph 52.6.

Question 45: Additional Contract Requirements, paragraph 52 states, “The RSMeans Cost Data will be updated on an annual basis, at option exercise, using the Annual Database.” This means that contractors will be using in the base year, for example, pricing from the 2022 RSMeans data

(published in December 2021) for task orders through at least June 2023. Considering the recent volatility of material prices, would the Government consider utilizing the most current RSMeans data and quarterly CCI at the time the task order proposal is submitted to ensure more accurate estimates?

Answer 45: No. Quarterly updates within the UPB with respect to CCI will not be used. The annual CCI for Watertown, NY shall be used. The 2022 Weighted Average Cost for 2022 is

97.60. Subsequent option years shall also use the annual CCI for Watertown, NY; concurrent to the year in which the option is exercised.

Question 46: Additional Contract Requirements, paragraph 52.2 states, “Unless specifically omitted in the UPB line item description, testing, adjusting, balancing, and start-up of installed equipment is included in the unit price line number cost found in the UPB.” Balancing is significant cost associated with HVAC installation and often requires a separate contractor to perform these services. Answer 46: The RS Means UPB has separate line items for balancing HVAC systems that may be used as needed on individual task orders.

Question 48: Is it the Government’s intent that each proposal section be submitted in a separate binder / separate CD, or may a single binder and single CD be used, provided each section is clearly identified and separated?

Question 49: Please confirm that the reference to an Executed Request for Proposal in Section I is intended to include only the SF 1442, any amendments, Section 00600, the Bid Bond, and any

Question 51: May an 11x17- inch page (folded to 8.5x11-inch size in the hard copy version) be used for the organization chart if it improves readability?

Answer 51: Yes.

Question 52: In the Statement of Work, is the volume of work provided for the Key Personnel intended as an annual amount or an aggregate amount across the required length of service? (e.g.

For the contract manager, it states “5 years of specialized experience managing/supervising… multiple construction projects …totaling over $20 million”. Is this 5 years, with each year demonstrating a minimum volume of $20 million (for a total of $100 million or more) or is it a total of $20 million spread across five years?)

Answer 52: It’s a total that exceeds the $20 million over that 5 year period.

Question 53: Section 1.3 on page 11 of 98 of the RFP states the bid bond is to be submitted in accordance with FAR Clause 52.228-1. However, it does not provide the value of the bond. Please provide the missing values in “The amount of the bid guarantee shall be ______ percent of the bid price or $________, whichever is less”. Please also confirm that the bid price is $110 Million.

Answer 53: FAR Clause 52.228-1 Bid Guarantee should be included by Full Text, not by reference. Solicitation has been amendment to incorporate this change.

Question 54: Is the Bid Bond to be provided on SF 24 or is another format requested?

Answer 54: Yes.

Question 55: Please confirm the performance and payment bonds are issued as a blanket bond in the amount of $44 million, and that individual bonds will not be required for each task order.

Question 56: Page 15 of 98 states that offerors must “demonstrate their per task order

($22,000,000) and annual aggregate maximum capability ($44,000,000) for construction bonding”. However, FAR 52.216-19 ORDER LIMITATIONS on page 34 states that contractors are not obligated to honor a single order over $5,000,000. Please clarify the “per task order” bonding limit if required.
