52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Aug

2025) (DEVIATION 25-21) (effective November 28, 2025)

(a) Submission of offers. Offerors shall submit their quotations electronically to Steven Goodwin at Steven.A.Goodwin@uscg.mil. Quotations shall be properly identified with the Request for

Quote number, company name, address, telephone number, and cage code. Offerors shall provide pricing for all Contract Line Item Numbers (CLINs) specified in the 70Z03827QL0000005

Schedule of Services. Questions regarding this solicitation should be submitted in writing to

Steven.A.Goodwin@uscg.mil.

As a minimum, offers shall include—

(1) The solicitation number;

(2) The name, address, telephone number of the Offeror;

(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer

(EFT) indicator;

(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;

(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(c) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers and any modifications or revisions to the

Government office designated in the solicitation by the time specified in the solicitation.

(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and mailto:Steven.A.Goodwin@uscg.mil mailto:Steven.A.Goodwin@uscg.mil the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.

(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed

Offeror’s offer.

52.212-2 Evaluation—Commercial Products and Commercial Services (Aug 2025)

(DEVIATION 25-21) (effective November 28, 2025)

(a)The Government will award a contract from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

This evaluation will assess the offerors based on the proposals submitted in response to the

HC-144 Paint Services Request for Quotation, using the following factors.

Factor 1 – Technical Acceptability

Factor 2 – Past Performance

Factor 3 – Delivery

Factor 4 – Price

The evaluation factors listed above are listed in order of importance. All non-price factors when combined are more important than price. Award will be made to the offeror whose proposal represents the best value to the government.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of Superior, Satisfactory, Marginal or Unsatisfactory. This will be determined by evaluating the ability of the offeror to provide an adequate proposal that meets all requirements listed in the

Performance Work Statement (PWS) and demonstrates a thorough knowledge and understanding of the requirements. The offeror must provide the following minimum information and documentation with their proposal:

Minimum Requirement:

• The offeror’s proposal shall clearly demonstrate compliance with all requirements outlined in the Performance Work Statement (PWS). Offeror must provide a detailed explanation of any requirement listed in the PWS that cannot be successfully accomplished. If not addressed, the

USCG will assume that the offeror does not take exception to any terms or conditions.

• Provides an acceptable overhaul/repair turnaround time to include Paint, De-Paint, and Scuff, sand and Paint procedures.

• Demonstrates a thorough knowledge and understanding of the paint services work to be performed.

Past Performance: Past Performance will be evaluated to determine whether it is Superior, Satisfactory, Marginal, Unsatisfactory or Neutral. Only offerors with Superior or Satisfactory

Past Performance will be considered eligible for award. Offerors shall provide completed Past

Performance Questionnaires (Appendix C).

Minimum Requirement:

• The Government intends to use information available from past contracts, purchase and delivery orders with the USCG, delivery information found in the USCG’s Asset Logistics Management

Information System (ALMIS) system, and any information found using sources such as Federal

Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor

Performance Assessment Reporting System (CPARS).

• If an offeror does not have a record of past performance or past performance information is either unavailable or so sparse that no meaningful rating can be reasonably assigned, the offeror will receive a Neutral rating.

Delivery: The offeror’s delivery schedule will be evaluated to determine whether it is Superior, Satisfactory, or Unsatisfactory. Only offerors with a Superior or Satisfactory delivery rating will be considered eligible for award. The evaluation will be based on Section 5.0 of the Performance

Work Statement, which states the following delivery requirements:

• The Offeror shall complete scuff/sand/paint within twenty four (24) calendar days after receipt of the aircraft.

• The Offeror shall complete the de-paint process within ten (10) calendar days after receipt of the aircraft.

• The Offeror shall complete the paint process within seventeen (17) calendar days after receipt of the aircraft.

Price: The Government intends to award one Firm Fixed Price Indefinite Delivery requirements contract. The Government intends to evaluate offers and award the contract without discussions.

Therefore, the offeror’s initial offer should contain the offeror’s best terms from price and technical standpoint. Pricing should be proposed separately for all CLIN(s), for the base year and all option years as specified in the schedule. The Government will evaluate pricing for all part numbers for all years. The Government may determine that an offer is unacceptable if the base and option year prices are significantly unbalanced. Evaluation of options shall not obligate the

Government to exercise the options(s).

The contractor shall provide pricing as requested in Attachment 2 titled “Attachment 2 - Schedule of Services”. Any quantity price discounts and discounts for prompt payment should be included in this section. Price proposals will be evaluated to determine completeness and fair and reasonableness.

Minimum Requirement: Price proposals will be reviewed to verify pricing was provided for the base and all four (4) option periods. Failure to propose pricing for the base year and all option periods on individual line items may result in a proposal being excluded from further consideration. The government will also evaluate prices for each contract period of performance.

Items with a “TBD” (To Be Determined) quantity will be evaluated using a quantity of 1 each for determining fair and reasonableness and determining the best value to the government offer. The

Government may determine that a proposal is unacceptable if the option year prices are significantly unbalanced.

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:

(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility.

Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an

Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the

Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
