About this file
Summary: Attachment 1 - Terms and Conditions (70Z03826QJ0000359)
This document establishes the contract terms and conditions for a Department of Homeland Security (DHS) acquisition of commercial items and commercial services, effective November 28, 2025. The evaluation criteria prioritize non-price factors (technical acceptability and delivery) over price, with technical acceptability as the most important factor. Offerors must provide manufacturer CAGE codes with clear traceability to Original Equipment Manufacturers (OEM Mason Electric, CO, Cage Code 81579), confirm all parts are NEW approved parts, furnish a Certificate of Conformance per FAR 52.246-15, and specify F.O.B. Destination as the delivery point with estimated shipping costs included. Delivery will be evaluated based on three confidence levels: High Confidence (within 60 days after receipt of award), Satisfactory Confidence (61-90 days), and Low Confidence (91+ days).
The contract incorporates multiple FAR and HSAR clauses addressing commercial product acquisition requirements, including provisions on Buy American supplies, security prohibitions and exclusions (covering telecommunications equipment, FASCSA orders, Sudan and Iran restrictions), sustainable products and services, contractor whistleblower rights, DEI discrimination compliance, and basic safeguarding of covered contractor information systems. Quality assurance requirements mandate immediate notification of supply changes, defects, or non-conformities, with USCG approval required before disposition of non-conforming products. Packaging must prevent damage during shipment and storage for one year, exclude prohibited materials (popcorn, shredded paper, Styrofoam, peanut packing), and label containers with National Stock Number, Part Number, Serial Number, Quantity, Nomenclature, Purchase Order Number, and Line-Item Number. Items ship to USCG Aviation Logistics Center in Elizabeth City, North Carolina, with inspection at destination for count and condition, and a Certificate of Conformance required for all deliveries. Invoicing must be submitted to the billing office after receiving fully executed purchase orders with ACTIVE status in the System for Award Management (SAM), with electronic payment via FAR 52.232-33.
