The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with (IAW) FAR 12.201 constitutes acceptance of all terms and conditions contained herein.
(a) Provisions
52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Aug 2025) (DEVIATION 25-21) (effective November 28, 2025)
52.212-2 Evaluation—Commercial Products and Commercial Services (Aug 2025) (DEVIATION 25-21) (effective November 28, 2025)
(a) Evaluation Factors. The provision at FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (August 2025 – FAR Deviation 25-21) is applicable to this requirement. The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government utilizing the tradeoff process with the factors listed below. The following factors will be used to evaluate offers and are listed in descending order of importance. Non-price factors, when combined, are more important than price.
Factor 1: Technical Acceptability Factor 2: Delivery Factor 3: Price
Factor 1: Technical Acceptability.
Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. The Government will assess the information submitted with the offeror’s quotation to determine their ability to provide the item in the solicitation and meet the requirements listed below and on “Attachment 2 – Technical and Packaging Requirements – 70Z03826QJ0000324”.
Offerors MUST be able to satisfy the technical and packaging requirements as outlined below and on “Attachment 2 – Technical and Packaging Requirements – 70Z03826QJ0000324”. Confirmation must be provided by checking the boxes on “Attachment 2 – Technical and Packaging Requirements – 70Z03826QJ0000324” and submitted with their quotation. Failure to submit the requested attachment will result in an “unacceptable” rating for technical acceptability and the offeror’s quote will not be further evaluated.
1. Offerors must be able to provide the Manufacturer Company, Cage Code, type of coating applied to the wire, and number of strands and strand size applicable to wire order.
2. Wire and Cable shall be manufactured and inspected in accordance with (IAW) SAE Standards per wire/cable. Please include manufacturer’s Quality Assurance Testing Report including “Finished Wire Resistance Check”, OEM’s Data Sheet, and results of the test IAW SAE specifications with shipment.
3. The Contractor shall furnish a Certificate of Conformance (COC) in accordance with Federal Acquisition Regulation (FAR) clause 52.246-15. COC must be submitted in the format specified in the clause. Offerors must be able to provide necessary certification including traceability to the manufacturer, manufacturer's (COC) to ensure parts are in airworthy condition, suitable for installation on USCG aircraft.
4. All wire shall be NEW approved wire. The Contractor shall provide documentation with a statement verifying that all wire shall be NEW approved wire, in response to this RFQ. (For example, no wire outer insulation containing PVC), for this wire would be disqualifying for aerospace standards.
5. Each reel of wire shall be a full spool when possible. Spools shall be a continuous run with no break. Multiple segments per spool are not authorized and will be rejected by Quality Assurance. Wire must be marked IAW SAE AS22759 and/or NAVAIR 01-1A-505-1 and manufactured within last 12 months.
6. Wire and Cable marking should show the part number (e.g., M22759/12-20-9) and manufacturer Cage Code (e.g., 12ABC). Marking is typically every 12 inches, but may be every 6 to 60 inches apart, in black or green color. (Exception to include when outer jacket requires a stark contrast to identify wire number, such as black jacket and white lettering). The lack of proper marking is reason for rejection. NOTE: Wire size 26 gauge and smaller does not require marking. The date of manufacture shall be listed on every spool data label as well as the type of coating applied to the wire.
7. QA requires access to both ends of Wire and Cable on the spool for inspection. All Wire and Cable must be terminated correctly, for example, heat shrink on bitter end of wire. Each spool of wire needs to be identified with (example: 1 of 6, or use manufacturers assigned name), National Stock Number, Part Number, manufacturer lot number of wire order, and date of manufacturer listed on tag of spool (usually the wire comes with the manufacturers assigned name “LRB” already designated on the spool).
8. The FOB Shipping Point (Destination or Origin) and Estimated Shipping Cost if FOB Origin. All quotes will be considered FOB Destination unless FOB Origin is clearly stated, and shipping costs are included.
9. Offerors acknowledge that any wire that is delivered and that does not adhere to these technical and packaging requirements may fail inspection and be rejected by Quality Assurance.
The offeror will be evaluated with the following description:
Acceptable Meets Technical Acceptability Requirements
Unacceptable Does not meet Technical Acceptability Requirements
(Remainder of Page Intentionally Left Blank)
Factor 2: Delivery.
The offeror shall state the delivery for the item quoted. Delivery will be reviewed and based on the following requirements:
High Confidence The offeror can deliver within sixty (60) days
After Receipt of Order (ARO).
Satisfactory Confidence The offeror can deliver between sixty-one (61) to ninety (90) days ARO.
Low Confidence The offeror can deliver ninety-one (91) or more days ARO.
Factor 3: Price The offeror shall provide pricing as requested for the item in the synopsis description. Any quantity price discounts should be included. The offeror’s quotation will be evaluated using one or more of the techniques defined in FAR 12.204(a), in order to determine if it is fair and reasonable.
(b) Acceptance of FAR 52.217-6: The contractor shall indicate whether they will accept the inclusion of FAR clause 52.217-6 in any order awarded as a result of this solicitation. If yes, the contractor should indicate whether they will honor the clause through one year after date of award or provide the last date they will honor pricing for additional orders. For reference, the full text of this clause is included on page 29 of these Terms and Conditions.
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
