A. INTRODUCTION
Pinon Community School’s goal is to provide quality education to meet the mandates of the Navajo Nation and Federal Government by promoting unity and harmony within the schools and community, this will place a positive impact on the students and give them the incentive of self-discipline and to be independent.
This isolated Navajo Nation community, located in Low Mountain, AZ with its poverty, 60% unemployment, low school achievement among parents and siblings, an increasing use of drugs and alcohol by siblings and parents, single parent and grandparent homes (according to Census 2010 figures, 26% of our households are female headed households with no husband present). A high level of domestic violence among family members all contribute to an educational crisis.
JES students are faced with access issues and lack of healthy lifestyle options. There are no recreational centers, well-equipped libraries, or tutorial centers in the area. The nearest communities that offer such amenities are located either one hundred fifty (150) miles east or one hundred eighty (180) miles west of Low Mountain. With the economic hardships faced by many of our families and the rising cost of gasoline, transporting children to these neighboring communities to participate in recreational or academic support activities is not a viable option. Therefore, accessibility to resources is another major factor in stressing the need for this turf project.
Mission: To prepare students for the choices and challenges in a multi-cultural society by providing a safe positive, healthy, social, and educational environment relevant to Dine’ knowledge and language.
B. PURPOSE & OBJECTIVE
The successful vendor shall be responsible for the assessment of the existing infrastructure, associated auxiliary devices, supports, electrical, and general conditions to provide a proposal for the implementation of task identified in paragraph “F”. The installation will be located at:

The final Scope of Work will be a coordination of effort between the school and the successful Contractor, based on the successful Contractor’s proposal and final contract negotiations.
The Government intends to select a Contractor based on the best value, most functionality, greatest reliability, and the vendor’s ability to execute a contract of this size and scope successfully including any warranty work.
C. SCOPE

1. The Contractor shall furnish technical, supervisory, and administrative personnel to insure the expeditious accomplishment of the work. Additionally, the contractor shall furnish all services, materials, supplies, equipment, and travel required in connection with this work.
2. Contractor shall utilize a design-build construction methodology to install the following:
a. The Contractor shall furnish all supervision, materials, equipment, tools, and personnel necessary to manage and accomplish the work. The Contractor shall provide sufficient technical support and project management to assure quality, the accuracy of estimates, accommodate several concurrent "active" projects, and provide flexibility to the staff. Additionally, the Government will rely on the Contractor's expertise in recognizing and addressing problematic issues and successful execution. It is the Government's expectation that work executed against this order shall exhibit superior quality, responsiveness, and customer service.
b. The Contractor's work responsibility shall include all planning, administration, coordination, and management necessary to provide all work as specified. The work shall be conducted by the Contractor in strict accordance with the contract and all applicable Tribal, Federal, State, and local laws, regulations, codes, or directives as applicable. The Contractor shall ensure that all work provided meets or exceeds critical reliability rates or tolerances specified or included in applicable documents.
3. The following general work requirements shall also apply:
a. It shall be the sole responsibility of the Contractor prior to bidding, to conduct field verification of actual equipment, dimensions, materials, and all existing conditions shall be the sole responsibility of the Contractor.
b. Field verifies all existing conditions, utilities, dimensions, and clearances impacted by the work.
c. Notify the Facility Manager and COR of any deficiencies or other conditions encountered.
d. Coordinate work with applicable codes and school requirements.
e. If classes are in session, the Contractor may be required to complete a construction integration phasing plan, or work before or after normal work hours and potentially on weekends. The Contractor will be required to sign in at the work site during normal/school hours. After normal/school hours, the Contractor will notify Security when they leave for the day.
f. The Contractor shall provide all labor and materials required to complete the work to Section “F” below, Task Identification.
g. All waste materials shall be removed and disposed of in a manner as specified by mechanical plans, COR, local, State, and Federal regulations.
D. MILESTONES
The Contractor will provide the COR within ten (10) business days from the Notice to Proceed (NTP) a detailed work schedule outlining how the Contractor will meet the conditions of this

contract and identify key milestones.
E. GOVERNMENT- FURNISHED RESOURCES
The Contractor can request with approval and coordination of the COR a request for the facility’s staff to assist with access to site areas and coordination of as-built development.
F. TASK IDENTIFICATION
1. 8' biking/walking track 3,000 ft to circle around the perimeter of the track and skating area, with directional markings , vehicle blocking bollards, an Stop sign with crosswalk striping, see attachment 1.
2. Emergency Hot Asphalt Paved access road from staff quarters to bus garage. This will give provide emergency vehicle access for an additional level of safety for students and staff. Road - length 375’ x 12’wide x3” thick , see attachment 2, for routing.
3. Landscaping to make the field and skating area beautiful. Total area 52,621 yd2 for coverage area. Synthetic Grass California Gold 55 or equivalent, see attachment 3 for specifications.
4. Main Entrance Brickwork with electronic billboard, school logo, and Flagstone wall, see attachment 4 for proposed design.
1. Post Contract Award Prerequisites
a) Insurance Certificates as required/in conformance with BIE Contracting provisions.
b) Contractor's Itemized Schedule of Values in the applicable CSI Divisions acceptable by
Owner, if applicable.
c) 100% Performance and Payment Bonds with BIA approved Surety, if applicable.
d) Detailed Contractors Project Schedule.
e) Site specific narrative work plan delineating how, where, when, whom of overall undertaking.
f) Other Information/Documents as required by the BIE.
2. Obtain all Materials and Permits
The Contractor shall ensure that all materials necessary to perform this statement of work are ordered promptly upon Notice to Proceed (NTP). To avoid delays, all parts and equipment must be on hand or readily accessible for a given phase prior to the

commencement of work. The Contractor shall also ensure that all work permits, licenses, bonds, accident prevention plans, scheduled products used, and safety data sheets (SDS) are provided (and approved) prior to beginning construction.
3. Provide a Work Breakdown Schedule (WBS)
The Contractor shall provide the COR within ten business days of the Notice to Proceed (NTP) a detailed work schedule outlining how the Contractor will meet the conditions of this contract.
Demolish Existing:
a) The Contractor is to verify with the school that asbestos is not present before the start of work. If asbestos is encountered the Contractor shall inform the COR.
b) School personnel and students shall not be disturbed in any way during construction. The Contractor is to confine the work to the immediate area concerned; maintain cleanliness and wet down demolished materials to eliminate dust. Debris accumulated in the area to the detriment of plant operation is prohibited. Perform all flame cutting to maintain the fire safety integrity of this facility. The Contractor is to employ a fire watch and ensure no flammable gases are stored at the school. Adequate fire extinguishing facilities shall be always available.
Perform all work in accordance with recognized fire protection standards.
Inspection will be made by personnel of the Support Services Division, and Contractor shall follow all directives of the COR regarding rigging, safety, fire safety, and maintenance of operations.
c) Unless specified otherwise, all piping, wiring, conduits, and other devices associated with the equipment not re-used in the new work shall be completely removed from Government property. This includes all concrete pads, pipe, valves, and fittings. The structural integrity of the building system shall be maintained. Reference shall also be made to the contract documents of the other disciplines in the project for additional facilities to be demolished or handled. Lockout tag out (LOTO) practices shall be employed for safety.
4. Conduct Punch List Walk Through
The Contractor shall conduct a pre-punch list prior to conducting a joint punch list walk-through with the COR. The Contractor is to correct all deficiencies to the satisfaction of the
COR.

5. Change orders
The change orders request shall be forwarded to the Contracting Officer by memorandum outlining the need and a justification for the change order. Upon receipt of a change order request, the Contracting Officer will request a cost proposal from the Contractor. All cost proposals shall be in detail and itemized, showing price breakdown in sufficient detail to permit an analysis of cost for material, labor, equipment, hours, taxes, insurance, bonds, overhead costs, profit, and complete description of work involved in the change order, including any time extension.
6. Provide Training
a. Provide services of the Manufacturer's Representative for one day to instruct, the Maintenance Representative(s) in the operation and maintenance of all installed equipment.
b. Schedule training with the school and provide at least 4-day notice to the school of the training date.
7. Equipment Standards
a. No changes/substitutions/modifications to the list of equipment provided in the proposal may be made without approval.
b. SCHOOL/ COR will only accept proposals for new original equipment from the manufacturer (less than 1 year from the date of manufacture) without blemish or defect.
No used or refurbished equipment or parts will be accepted.
c. Where a specific piece of equipment has been discontinued and/or replaced by a new model, submission of the new model does not guarantee acceptance. If the Contractor is proposing a model other than that specified, the Contractor must provide descriptive literature with the proposal to ensure the product offered follows specifications as detailed in paragraph 10.(d) Data and submittals.
8. Execution of Work at the Site
a. Upon receipt of the Notice to Proceed (NTP) the Contractor shall survey the existing site conditions and agree with the COR to a phasing plan. In no event shall the work of the Contractor interfere with the operations of the school.
b. The Contractor shall promptly notify the Contracting Officer, in writing, of subsurface or any physical conditions different from those indicated in this contract or unknown unusual physical conditions at the site before proceeding with the work.
c. The Contractor shall make sure that all the working personnel shall be well trained & equipped to carry out the job.

d. Provide Ground Fault Circuit Interrupter (GFCI) receptacles for all outlets as required by code.
e. The Contractor shall have limited access to the compound only to the areas designated for the project. The Contractor shall be responsible for safeguarding all materials and equipment required for the work.
f. It shall be the Contractor’s responsibility to protect and keep the surrounding work area clean and free from spills & debris. Contractor’s responsibility shall include traffic control; fall protection; deliveries; notifications/filings; permits, control measures on dust, noise, contamination; general ground/soil restoration; daily & final site cleanup;
housekeeping; trash/debris disposal. All costs to repair, patch, finish, replace and fixes shall be the responsibility of the contractor and will carry or warrant no time extensions or contract modifications.
g. No work shall begin at the site until all equipment & materials for that part of the work are 100% available at the site and temporary barricades have been installed to isolate the area as agreed with COR.
h. The Contractor shall make sure that the working space is kept free of safety hazards and is cleaned at the completion of work in each shift. All the equipment body shall be thoroughly cleaned without any damages to the satisfaction of COR or the designated person.
i. The Contractor shall ensure all workers have passed criminal background checks to be able to work on this project. The documentation required to initiate a background investigation shall be completed for any Contractor employee that will be onsite during the contract’s performance or have access to Personally Identifiable Information (PII). The complete submittal of the background investigation paperwork to the BIA/BIE will be accomplished within 14 days after contract award for service contracts or, for construction contracts, before a Notice to Proceed (NTP) is issued by the Contracting Officer.
j. The work is to be completed in a safe manner per OSHA rules and regulations.
Including the use of proper PPE (personal protective equipment). And provide the school with SDS (Safety Data Sheet) sheets as required. Any discoveries of hazardous and contaminant materials shall be reported immediately.
k. The Contractor must comply with the school’s security procedures, policies, and COVID-19 protocols as enforced by the school.
l. Any rework due to Contractor’s fault shall be promptly rectified by the Contractor at no additional cost to the school.
m. The Contractor shall partake in inspection and punch list walk-throughs with school (or appointee of school) and rectify identified deficiencies promptly.

n. Seismic forces for equipment shall be incorporated.
9. Product Data and Submittals
a. Provide manufacturer's certification that products comply with referenced standards.
b. Submit complete phasing plan/schedule with manpower levels prior to commencing work. The phasing plan shall be detailed enough to provide milestones in the process that can be verified.
c. Contractor shall make all necessary field measurements and investigations to assure that the equipment and assemblies will meet contract requirements, and all equipment that requires regular maintenance shall be identified. The Contractor shall promptly notify the Contracting Officer, in writing, of subsurface or any physical conditions different from those indicated in this contract or unknown unusual physical conditions at the site before proceeding with the work.
d. It is the Contractor’s responsibility to ensure all submittals meet the BIA School Facilities Design Handbook specifications as provided in the following link https://www.bia.gov/sites/bia.gov/files/assets/as-ia/raca/pdf/idc008030.pdf.
e. The Contractor shall provide submittals to the COR for approval within ten business days from the Notice to Proceed (NTP). If at any time during the project, it is found that any item does not meet the BIA School Facilities Design Handbook specifications and there was no variance approval, the Contractor shall correct such deficiencies at no additional cost or time to the Government even if a submittal was approved.
f. The contractor shall not perform any of contingent sum work, until the Contracting Officer issues a contract modification authorizing performance of work in accordance with FAR.
g. Review time for technical and material submittal compilation and submission to the BIE Contracting Officer's Representative for approval prior to any work or installation, which includes RFIs.
h. Construction work shall not start on any system until the submittals, safety plans, and coordination/shop drawings have been approved by COR.
10. Drawing Submissions
a. No equipment shall be fabricated or delivered until the receipt of approved shop drawings from the COR or approved representative.
b. Equipment manufacturer shall provide the following information with each shop drawing/product data submission:
1) Dimensioned arrangement drawings for each piece of equipment including a plan and elevation view of the assembled units with overall dimensions, lift points, unit shipping split locations and dimensions, installation and operating weights, and installation, operation, and service clearances.
2) Each component of the unit shall be identified, and mechanical specifications shall be provided for the unit and accessories describing construction, components, and options.

c. Design/ Drawing Submittals:
1. Initial Project Assessment (10%) o Site visit(s) for field investigation and meet with functional area users & technical staff.
o Prepare a study and investigative report verifying the project scope, any existing conditions and/or design considerations unique to the project area.
2. Design Development (35%) o Initial concept design, incorporating at least two alternative plans with phasing strategy, feasibility studies, analysis of infrastructure systems and recommendations defining the design approach.
o Response to Clients 10% design review comments, if applicable.
3. Mid-Design (60%) o Advanced design and engineering scheme of selected alternative plan.
o Outline specifications, (including table of contents) o Cost estimate, schedule of material submittals and finish schedule.
o Response to Clients 35% design review comments, if applicable.
4. Pre-Final Design (95%) o Complete submittal of design drawings and specifications including material.
o Submittal listing and finish schedule. If applicable.
o Response to Clients 60% design review comments, if applicable.
5. Final Design (100%) o Submittal of final design drawings, specifications including material submittal.
o Final listing and finish schedule, and cost estimate.
o Final design drawings will be prepared in .DWG, and .PDF format.
o Response to Clients 95% design review comments, if applicable.
d. The Contractor shall list any exceptions to this SOW.
e. The Design-Build shall be prepared and submitted with complete construction documents for review and approval by the Government. The documents and drawings shall be

11. Contractor Field Quality Control
The Contractor shall develop and maintain a Quality Control Plan (QCP) to ensure services are performed in accordance with the contract and this SOW. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is how they ensure that all work complies with the requirements of the contract. The finalized QCP will be accepted by the Government at the time of the award of the Task/Delivery Order. The Contracting Officer may notify the Contractor of required modifications to the plan during the period of performance. The Contractor then shall coordinate suggested modifications and obtain acceptance of the plan by the Contracting Officer. Any modifications to the program during the period of performance shall be provided to the Contracting Officer for review no later than 10 business days prior to the effective date of the change. The QCP shall be subject to the Governments review and approval. The Government may find the QCP "unacceptable" whenever the Contractor’s procedures do not accomplish quality control objective(s). The Contractor shall revise the QCP within ten (10) business days from receipt of notice that the QCP is found "unacceptable."
12. Manufacture’s Field Services
The manufacturer’s representative shall provide technical assistance and guidance for installation. The quality of all work shall be the responsibility of the Contractor. Sufficient inspections and tests of all items of work, including that of subcontractors, to ensure conformance to applicable specifications and drawings with respect to the quality of materials, workmanship, construction, finish, functional performance, and identification shall be performed on a continuing basis.
13. Omissions
Omissions from the drawings or specifications or the misdescription of details of work which are manifestly necessary to carry out the intent of the drawings and specifications, or which are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work but they shall be performed as if fully and correctly set forth and described in the drawings and specifications.
14. Schedule
The work may begin immediately upon BIE contract approval, signatures of the contract

and NTP is given. The Contractor will provide the COR within ten business days of the Notice to Proceed (NTP) a detailed work schedule outlining how the Contractor will meet the conditions of this contract. The work to be performed for this contract will take place after school to avoid any conflicts with day-to-day operations. All work shall conform to BIA School Facilities Design Handbook: Coordinate all work activities and anticipated interruptions with the site Facility Manager:
a) The project shall be completed according to submitted schedule.
b) The Contractor shall furnish product data and review the submittals for materials that will be used as part of the construction with COR.
c) The Contractor shall provide all close-out documents, copies of certifications, warranties, etc., as required by the contract.
d) Submit deliverables to Contracting Officer Representative (COR).
15. Contract Administration
a) The Contractor shall not perform work that is outside the SOW (included) unless directed in writing by the Contracting Office (CO). Any work done by the Contractor outside the SOW without direction from the Contracting Officer will be at the Contractor's own risk.
b) The CO shall provide a Notice to Proceed (NTP) to begin the performance of work after the contract has been awarded.
c) Contracting Officer's Representative (COR) or Facility Manager at the Jeehdeez’a Elementary School shall be designated for the administration of this contract. The COR shall coordinate the schedule for each phase, approve technical submittals, inspect work, monitor progress, accept completed work, review invoices, review change orders, and issue/receive Government Furnished Items. The COR has the authority to direct the Contractor to stop the performance of work if unsafe work conditions are observed.
e) The laws regulating wages and hours of workers employed under this contract are subject to the Davis-Bacon Act.

16. Project Deliverables
The Contractor will provide the COR with all appropriate Original Equipment Manufacturers (OEM) and user manuals for new equipment:
a) Warranty for equipment.
b) Installation and operating manuals for each piece of equipment.
c) Shop drawings and wiring diagrams.
d) Structural analysis and drawings as applicable for new equipment installations.

e) Training Material.
f) Equipment Preventive maintenance schedule.
g) CAD or other recognized industry standard drawings.
17. Warranties
a) The Contractor shall be providing a comprehensive warranty that covers a period of one year from substantial completion. This warranty shall cover all parts, labor, shipping, and expenses, such that no additional cost is incurred by the school for warranty work.
b) Warranties shall start from the final completion date or Owner's acceptance, but not limited to defective materials, workmanship, malfunctions, etc. Manufacturer warranty document shall contain school name and building number(s).
18. Packing and markings
a) All shipments of materials, equipment and/or supplies to the project site shall be addressed to the Contractor and not the Government. Preservation, packaging and packing shall be in accordance with standard practices for commercial packaging.
b) Government personnel are not authorized to accept deliveries for the contractor, nor are they responsible for off-loading shipments. A contractor representative must be present to accept deliveries.
19. Temporary Facilities & Utilities
Contractor shall provide a secure staging and storage area near the building. No part of the BIE or Jeehdeez’a Elementary School building, or facilities will be used for storage or administrative purposes by the contractor without the review and approval by the School Principal
20. Emergency
In an emergency, a telephone approval may be granted by the Contracting Officer, and immediately the Contractor shall follow through by submitting a written cost proposal to the Contracting Officer.
The Contracting Office will issue a contract modification to authorize the work for the "emergency".
21. Tribal Taxes, Requirements and / or Restrictions
a) Special attention is called to FAR Clause 52.236-7, Permits and Responsibilities and FAR Clause 52.229-3, Federal, State, and Local Taxes. Offerors are responsible for contacting the tax authorities and tribe or tribal organization involved with regard to any requirements regarding state taxes, tribal taxes, royalties and/or other applicable tribal

laws or ordinances. Any costs associated with this section shall be included in the contractor’s proposal.

22. Close out Requirements As requisite for final payment, the Contractor shall provide to the BIE's Contracting Officer and its COR the following:
1. Specified quantities of extra/spare materials for each of the different materials, products used.

3. Record of maintenance training, a dated sign-in sheet(s) with signatures is acceptable.
4. Documentation shall include all certified payroll reports and release of claims.
23. Codes and Standards
The Contractor shall provide a multi-disciplined team to furnish the services required to complete the work. Each responsible team member must be knowledgeable of and provide work in compliance with the most current editions of all applicable codes, standards, and guidelines as adopted by BIA.
