STATEMENT OF WORK

Title: AM-241 source removal, AKRON Location

1. Background:

The mission of the Central Great Plains Resources Management Research Unit located in Akron, Colorado is to enhance the economic and environmental well-being of agriculture by development of integrated cropping systems and technologies for maximum utilization of soil and water resources. Emphasis is on efficient use of plant nutrients, pesticides, water, and soil conservation/preservation. The Central Great Plains Resources Management Research site is located at 40335 County Road GG, Akron, Colorado 80720.

2. Objective:

2.1. The intention of this solicitation is the packaging, transport, and disposal of a 100 mCi Americium- 241 sealed source from the USDA/ARS Central Great Plains Research Station.

3. Scope:

3.1 The contractor shall coordinate and arrange work at the Central Great Plains Resources Management Research Unit located in Akron. The contractor will inspect, leak test, encapsulate, and provide complaint shipping containers for transport of the source to a DOE Off-Site Source Recovery Program (OSRP) facility for disposal.

3.2. The contractor must be licensed to fabricate sealed sources that meet NRC and/or DOT requirements for special form. Must be able to obtain all required permits from the State of Colorado and Federal regulators, as necessary, to conduct this work.

3.3. The contractor shall verify the radioisotope contained in the source and estimate the radioactivity of the radioisotope. The contractor shall encapsulate the source and certify the source as special form and package the encapsulated special form source for transport in a Type A container. The contractor shall provide special form source certificates for the new source created by the encapsulation.

3.4. The contractor shall ensure that facility radioactive contamination is maintained as low as reasonably achievable during the encapsulation process, clean-up any radioactive contamination to the facility resulting from the contractor’s activities and dispose of any radioactive waste created during the encapsulation process, and provide a written report of removable and area radiation level surveys confirming that no radioactive contamination or residual radioactive materials remain at the facility after the source is prepared for transport or removed from the facility. The contractor shall comply with State and Federal security regulations, as appropriate, and USDA will assist in preventing unauthorized access to the contractor’s work area during encapsulation and other operations, as appropriate.

3.5. The contractor shall provide their own dedicated tools and equipment.

3.6. The contractor will provide all safety barriers and signs needed to comply with all Federal/State/Local regulations required for encapsulation, removal, and transport of the source.

3.7. The contractor will acquire and have in hand all required packaging, permits and documents required for shipping hazardous waste.

3.8. The contractor shall have the source packaged and shipped in a timely matter following the evaluation and encapsulation of source. The contractor shall return completed/signed material transfer forms as soon as possible and no later than one month of source receipt by the OSRP site.

5. Recognized Holidays:

5.1. Holidays to be observed are as follows. When scheduled services fall on an observed federal holiday contractor shall perform services on next business day.

5.2. HOURS OF OPERATION: The contractor is responsible for conducting business between the hours of 0730 to 1630 hours Monday through Friday, except Federal holidays or when the Government facility is closed due to local, national emergencies, administrative closings, or similar Government directed facility closings. The contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor is responsible for an adequate workforce for uninterrupted performance of all tasks.

5.3. Campus closures. When an unforeseen port closure occurs on a regularly scheduled day of work, the Government shall have the following options:

5.3.1 Reschedule the work to be performed the following workday.

5.3.2 Reschedule the work on any day mutually satisfactory to both the contractor and Contracting Officer or his/her designated representative.

6. Delivery:

6.1. Contractor must show all required permits and documents required to the COR and or the POC on site before any work can commence.

6.2. Any mobile lab or area related to this project will be coordinated with local staff and Safety officer before setup.

7. Government Furnished Property (GFP):

SUPPLIES AND MATERIALS FURNISHED BY THE CONTRACTOR: It is the responsibility of the contractor to furnish or supply all equipment, material, safety equipment, and material related to project.

No government equipment, tools, material are to be supplied by government personnel or agency.

Contractor is responsible for removal of any/ all material and debris from site.

8. Responsibilities:

8.1 SUPERVISION OF EMPLOYEES. Contractor shall provide for supervision of employees. Prior to commencement of services under this contract, the Contractor shall furnish to the COR a list of employees who will work on-site performing the services, and the name of the individual who will be responsible for supervision of such employees and who will function as the Project Manager. The Project Manager shall:

8.1.1 Have the Contractor’s full authority to act on matters pertaining to the performance of services.

8.1.2. Be on-site or on-call whenever work is being performed.

8.1.3. Report damage to Government property, loss of keys, personal injuries and/or hazardous conditions to the COR within twelve work hours after occurrence.

8.1.4. All work shall be performed in a skillful manner. The COR may require the Contractor to remove from work any employee the COR deems incompetent, careless, or otherwise objectionable.

8.1.5. The Contractor shall supply PPE such as gloves, goggles, and face masks, hearing protection, hard hats, steel toe boots, etc. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR).

8.2 PROPERTY. Except for reasonable wear and tear, the Contractor assumes full responsibility for and shall indemnify the Government for any and all loss or damage of whatsoever kind and nature to any and all Government property including any equipment, supplies, accessories, or parts furnished while in the Contractor’s custody and care for storage, repairs or services to be performed under the terms of this Contract, resulting in whole or in part from the negligent acts or omissions of Contractor, and subcontractor, or any employee, agent or representative of Contractor or subcontractor.

8.3 PERSONS. The Contractor will be responsible for any negligent or wrongful acts or omissions of the Contractor, his employees or agent’s incident to the performance of this contract. The Contractor will hold and save the Government harmless from all liability for any death or damage to all persons (other than the liability of the contract as provided under the Federal Employees Compensation Act) or to real or personal property, which results from the operation of, or incident to, equipment furnished by the Contractor. The Contractor will not be responsible for any negligent or wrongful acts or omissions of the U.S. Department of Agriculture; its employees, the U.S. Department of Agriculture’s Cooperators, or their employees.

8.4 LIABILITY INSURANCE. The Contractor shall maintain such insurance as will protect him/her from claims under Workmen’s Compensation, General Liability, Property Damage and from any other claims for damages for personal injury including death which may arise from operations under this Contract, whether such operation by himself or by any subcontractor or anyone directly or indirectly employed by either of them.

9. Security Considerations:

9.1. SECURITY: Only authorized Agricultural Research Service, Agricultural Research Service Cooperator employees, the Contractor and Contractor’s employees shall be allowed in the building during performance of this contract. The Contractor will close any open windows, turn off lights (except those left on for security), and lock designated interior and all exterior doors. The building is considered closed for business from 4:30pm to 7:30am daily, all weekend hours, and Federal Holidays.

9.2. CONDUCT OF CONTRACTOR AND EMPLOYEES: All federal government facilities are considered smoke and drug free. Contractor personnel shall not smoke in the building or areas except for designated areas. Contractor personnel shall comply with the installation traffic laws and other regulations and instructions pertaining to conduct of persons on Government facilities.

9.3. Contractor shall place his/her employees on notice that infraction of any of the above rules, regulations or prohibitions may be grounds for removal from Federal Property.

10. Inspections

10.1 Definition: “Services” includes services performed, workmanship and materials furnished or utilized in the performance of services.

10.2. The COR will review the performance of services and receive complaints related to non-performance. The COR, or other designated representative, will make random inspections of parts of the building where services are to be performed. Inspections will not interfere with or delay the Contractor’s work.

11. Deficiencies

If any service performed does not conform to the contract, the Government may require the Contractor to perform the services again to conform to requirements, at no increase to the contract amount. When defects in performances cannot be corrected by re-performance, ARS may (1) require the Contractor to take necessary action to ensure that future performance conforms to requirements, and (2) terminate the contract for default.

12. Payments

Payments shall be made monthly, in arrears, upon electronic submission of invoices to the Invoice Processing Platform (IPP).

13. Travel: Not applicable for this contract.

14. Special Material Requirements: Not applicable for this contract.

15. Other Unique Requirements and Considerations:

Due to precautions relate Covid-19 pandemic, the contractor will be responsible for supplying material to ensure the safety of the contractor’s employees and subcontractors working on Federal facilities such as Akron. All personnel are required to wear these items while working on site. The Contractor shall supply PPE such as nitrite gloves, goggles, and face masks.

16. Place of Performance:

The work to be performed under this contract will be performed at the Akron location. The physical address 40335 County Road GG, Akron, CO 80720

17. Period of Performance:

The period of performance shall start approximately 30 days after Contract award for installation. The period of work will be 180 days. Contract Officer will make determination if additional time will be needed for long lead time relating to the purchase of equipment.
