Specific contractor responsibilities include: locating disposal sites and managing transportation and disposal costs for asbestos-containing materials (estimated weight to be reported to the Contracting Officer Representative); obtaining all necessary permits and fees; performing field measurements to ensure secure installation without leaks; providing a detailed work plan two weeks before the proposed start date and 48-hour advance notice before beginning work; submitting digital copies of all submittals for BIA approval; contacting the local TERO Office before work begins; providing auxiliary heating during construction; removing and disposing of all project-generated debris; submitting daily construction reports weekly to the COR; obtaining State of Montana licensing for all boiler installation personnel; providing a 365-day warranty with electronic warranty files; and conducting all work during normal business hours (7am-5pm). The work area must be free of visible dust and fugitive emissions, with all materials adequately wetted to prevent particulate release. Asbestos remediation must be performed by a state-accredited remediation contractor with OSHA-trained competent person oversight, and EPA notification is required at least ten working days prior to the asbestos remediation project. The award basis is lowest price, with no contract vehicle or set-asides specified in the SOW.

Asbestos Remediation

MUSEUM OF THE PLAINS INDIANS

BROWNING, MONTANA

1.0 DEFINITIONS AND ACRONYMS:

“BIA” means Bureau of Indian Affairs “CONTRACTOR” means commercial vendor “A/E” means the Architectural-Engineering firm “CM” means Construction Management “ECCAA” means estimated construction contract award amount “QC” means Quality Control “RFI” means Request for Information “SOW” means Statement of Work “NFPA” means National Fire Protection Association

1.1 INTRODUCTION AND OVERVIEW

The Bureau of Indian Affairs (BIA), through a contract, will provide for the repair of the existing boiler heating system, work to be performed in this Statement of Work (SOW). All work will adhere to the approved drawings/plans and specifications provided under the SOW. The contractor will provide professional and contracted services for the boiler repair of the Bureau of Indian Affairs, Museum of the Plains Indians building #90. In addition, Asbestos Contained Material (ACMs) and Regulated Asbestos Contained Material (RACM)is found within the building. The contractor must abate the RACM pipe insulation in the basement and reinsulate the piping which had RACM. Any additional work must be through an addendum to this agreement based upon the availability of funds and required prior approval.

1.2 BACKGROUND:

Museum of the Plains Indians, building #90, was constructed in 1940. The two story Building #90 which includes a basement, has footprint of 16,502 square feet. The exterior is brick and mortar. Interior walls and ceilings are generally finished with plaster, and floors are typically vinyl composite tile (VCT) on the first and second floors. A basement occupies the entire footprint under the building. The basement walls, ceilings and floors are primarily poured concrete with concrete masonry units (CMU) and brick-and-mortar. A natural gas boiler that provides radiant heat to the facility is located within the basement, and exposed insulated hot and cold-water lines are routed along the ceiling throughout the basement. The second floor was used for storage during the time of the survey, and the first floor was used to display arts and artifacts of various Northern Plains Tribal peoples. The building is heated by a steam one-boiler system. The manufacturer of the boilers is Burnham Model #V1111. The unreliability of the boiler burner operation in a one-boiler system creates a significant risk for catastrophic failure. Such a failure could lead to extensive damage not only to the museum building itself but also to the inventory of priceless artifacts stored within. It is crucial to address this vulnerability to ensure the safety and preservation of both the structure and its valuable contents. A Boiler assessment was completed, and the findings stated, the boiler was in good condition however there were some maintenance items that require replacement parts. The Burnham boiler’s burner (Iron Fireman) presently operates intermittently and requires replacement. The steam traps require maintenance work.

1.3 PROJECT SCOPE:

The scope of this project is to remediate/removal by removing the RACM pipe insulation material in the entire basement only and replace it with environmentally friendly insulation with meets or exceed R-Value the replaced pipe insulation. NESHAP regulation 40 CFR 61.145 (c)(1)(i), any Regulated Asbestos-Containing Material (RACM) or Category I or II ACM that may be rendered friable during demolition or renovation activities must be properly remediated/removal prior to beginning the project. Remediation must be overseen by someone with training as a “competent person” per OSHA. Planning must occur, which should outline the methods for safe handling, removal and proper disposal of ACMs. Cleaning and Monitoring: The work area must be thoroughly cleaned to remove and residual asbestos fibers. Air monitoring must be conducted to ensure safe re-entry levels. Clearance testing must confirm the area is safe for occupancy.

Additionally, the project will involve the repair of the existing steam one-boiler system. A Boiler assessment was completed, and the findings will become a part of this contract and will also be addressed by the awarded contractor. The Burnham Boiler’s burner (Iron Fireman) presently operates intermittently and requires repair. The steam traps, condensate unit, and radiator require maintenance work as well.

1.4 OBJECTIVE:

The objective of this SOW is to define and establish a general scope of services necessary for the Asbestos mitigation and the repair of the existing one- boiler system to keep heating system operational that will heat the Museum of the Plains Indians, building safely and efficiently. The repaired boiler system provides reliable and sustainable heating throughout the building. The boiler assessment states:

“The boiler itself is a great boiler and is in great shape. I recommend that the burner is replaced with a new updated one as the existing burner is no longer manufactured or supported for replacement parts. A new burner would be a great improvement to the boiler and its operation. The burner heating system itself needs maintenance. There are many steam traps leaking causing live steam to enter condensate tank and overheating the pumps to the point of causing damage. The electric zone valves for heating control need to be replaced to help stop areas of overheating in the building.”

1.5 PERIOD OF PERFORMANCE:

The period of performance shall begin at Notice to Proceed and until 30 September 2026.

3.0 REQUIREMENTS

The contractor shall provide all labor, equipment, materials, and other incidentals necessary for the performance of the work required under the SOW.

The Contractor shall provide oversight to complete the project in accordance with manufacturer’s recommendations and the attached plans.

NESHAP also requires that any demolition or renovation activities be free of visible dust or fugitive emissions from any regulated substances, including asbestos.

All building materials should be adequately wet to prevent the release of particulates.

Depending on the type of future remediation work planned, OSHA regulations may require personal air monitoring and the use of engineering controls.

Asbestos remediation/removal for RACM must be performed by a state-accredited remediation contractor.

All personnel involved in the disturbance or removal of building components assumed to contain asbestos, or identified as asbestos containing, must adhere to EPA asbestos certification criteria.

All asbestos removal/remediation-related work shall be conducted in compliance with Tribal, State, and Federal guidelines. Adherence to these standards is essential to ensure the safety and health of all individuals involved, as well as to protect the environment during the remediation/removal process.

The contractor is responsible for locating disposal sites and the transportation of the ACM, RACM and any contaminated materials and cost and fees associated with this materials disposal. Estimated weight of dispose material shall be reported to the COR.

The contractor shall install new pipe insulation which has a R-Value that meet or exceeds the replaced insulation.

The contractor shall verify all replacement equipment dimensions, and material required to complete the project, and shall provide the boiler repaired system to include all costs associated with the repair of boiler system.

The manufacturing, shipping, and storage for the boiler replacement parts is the responsibility of the contractor.

If the contractor determines pipe installation shall be disturbed, sealing or replacement of pipe is the contractor’s responsibility

Contractor shall be responsible for storage, final shipping, and delivery costs from the factory to the materials final site.

The Contractor shall furnish all supervision for his project until project close out.

The contractor shall perform field measurements and identifying work items, so the replacement parts are anchored and attached securely and a system without leaks.

The contractor shall provide a work plan two weeks in advance of the proposed start date, to the BIA Region Facilities office and the Museum of the Plains Indians facility manager so that proper planning and provisions can be made for the protection of artifacts, public and staff.

The contractor shall provide a 48-hour advance notice to the BIA Region Facilities office and the Museum of the Plains Indians facility manager onsite before beginning the repair work on the boilers and shall proceed until completed.

All material with technical specifications shall be submitted to be approval before installation.

All work shall be in accordance with NFPA 101 Life safety Code (2018 Edition).

Substitution request shall be submitted if specified material changes.

Work shall proceed during normal business hours (7am-5pm). Exceptions are extremely rare.

OSHA requirements shall be enforced on this project.

If damages occur and it is determined by the BIA the damages are the result of work done by the Boiler Replacement contractor, the contractor will be responsible for permanent correction of the damage area to the satisfaction of the BIA.

The contractor is required to ensure that all electrochemical reactions are effectively eliminated throughout their work on the boiler repair project.

The contractor is responsible for all fees and permits and proper disposal of refuse.

The contractor shall set the boiler to manufacturers specifications to provide heat throughout the Museum.

Daily construction reports shall be submitted to the COR on a weekly basis.

Project schedule shall be submitted for approval prior to the start of any work.

The contractor is responsible for all quality control for this project.

The contractor shall be responsible for auxiliary heating during the boiler project as the facility may be occupied while work is proceeding.

The contractor shall be responsible for the removal and disposal of all debris created by the repair of the existing boiler, to include any pipe insulation that may be an environmental hazard. The estimated weight of debris shall be reported to the COR.

DESIGN REQUIREMENTS

3.1 TASKS:

The contractor shall provide digital copies of each submittal for review and approval by the BIA.

The contractor shall contact the local TERO Office before beginning project work. (406) 338 -7887

3.2 End Results/Deliverables

All work shall have a professional and finished appearance.

The contractor shall provide a report, with costs, on any work he may deem necessary to the boiler system, to keep the boiler running effectively and efficiently.

The work area shall be free of debris and material that was generated by the Boiler project.

Warranty forms and information shall be completed by the contractor and presented to BIA on final completion of project.

3.3 Other Considerations

A Site visit is encouraged before the proposal is submitted.

Persons, firms, or corporations shall be licensed by the State of Montana, shall perform all boiler installation.

It is a requirement under NESHAP regulation that at least ten working days prior to an asbestos remediation project, a written notification must be provided to the EPA.

In the Tribal Territories in Montana, notification of asbestos remediation shall be mailed to EPA Region 8 Asbestos NESHAP Coordinator in Denver, Colorado.

COVID 19 Federal protocol shall be enforced.

4.0 Government Furnished Materials:

5.0 Operation and Maintenance Manuals and Warranties:

The Contractor shall provide the BIA with both electronic files of the Warranties.

The warranty period of this project is 365 days.

The number and type of electronic files shall be mutually agreed upon between the BIA and the contractor.

6.5 Completion Report:

Not Applicable

6.6 Construction Contract Closeout:

The Contractor shall be responsible for the closeout of the contract with the subcontractors. Close-out procedures shall conform to those in the contract clauses. The BIA shall be provided with a copy of the signed original report prepared by the Contractor, documenting the closeout.
