STATEMENT OF WORK

FOR

PAVING IDIQ

1. DEFINITIONS:

a. 35% Design – A project submitted for solicitation which encompasses a 35% completed set of drawings, a Statement of Work (SOW), and the Paving IDIQ Master Specifications as technical supplement. The 35% design shows essential components of a full design and conveys the project intent to the contractor.

b. 100% Design – A project submitted for solicitation which encompasses a 100% completed set of drawings and specifications tailored to the specific project. With a 100% designed project, the summary of work will be identified in the individual project’s tailored specifications.

c. Authority to Advertise (ATA) – Under this authorization, the Contracting Officer may issue solicitations for paving project requirements when award of the contract is anticipated in the current fiscal year or early in the next fiscal year. Funds may not be currently available but are expected to be available during the current fiscal year, or early in the next fiscal year. If funds cannot be provided, the solicitation will be canceled.

d. Beneficial Occupancy - Revolutionary Federal Acquisition Regulation Overhaul (RFO) 52.236-11, Use and Possession Prior to Completion, allows for the use or occupation of a structure prior to final acceptance. The Contracting Officer must notify the contractor of the intent of the government to take Beneficial Occupancy in writing. If the Air Force utilizes the structure, the Contractor must ensure there is no alteration, repair, or change in any way to the facility or any equipment therein prior to the Government taking final acceptance. Changes of this nature could alter the Government’s rights under the contract clauses for warranty and inspection.

e. Best Value - A process used to evaluate proposals based on the quality of the overall construction approach in addition to the other criteria included in the request for proposal. When used, the “best value” evaluation factors will be included in the TO and may vary between projects. Award may be given to an entity other than the low offeror.

(1). Evaluation Factors – Those components of a project construction phase, as identified in the TO, which represent significant importance to the successful execution of the project and to the User’s mission, used to evaluate the overall quality of the proposed construction methodology.

(2). Deficiency – A material failure of a proposal to meet the TO requirements.

(3). Rating – The application of a scale of words, used in conjunction with the narrative, to denote the degree to which the proposal has met the requirements established by the TO.

f. Designer of Record (DOR) - The individual accountable for specific portions of the design documents. When professional certification is required for the design, the Designer of Record would be the individual providing certification for that portion of the design. When professional certification is not required, the Designer of Record would typically be the individual who provided the design or specifications for a particular aspect of the project (i.e., architectural, civil, structural, mechanical, or electrical).

g. Fair Opportunity Proposal Request (FOPR) – A FOPR will be issued to solicit all projects under the Paving IDIQ, subsequent to IDIQ contract award. The FOPR will define the project requirements and may require the contractor to perform internal design for projects solicited without a 100% completed set of drawings and specifications.

h. Government Furnished Equipment (GFE) / Government Furnished Material (GFM) – Items of equipment or material which the government will supply to the contractor for use in the construction of a project.

i. Investigative Costs – Those costs identified by the contractor which represent the portion of the overall project cost attributed to all investigative services necessary to prepare construction documents.

j. Investigative Services – For exterior work, the investigative services will typically include, but are not limited to, performing a survey of the project site including topography, cross sections, drainage survey, and bench level circuit. In addition, it may include verification and documentation of the location and size of all existing utilities and pertinent surface features for inclusion on the topographic survey map. For exterior work, the investigative services should also include verification of all existing conditions affecting the execution of the work as described in the FOPR.

k. Notice to Proceed (NTP) – The official statement authorizing the contractor to begin administrative, technical, and construction work on an individual project. The NTP shall be signed and dated by, at a minimum, both the Contracting Officer and the Prime Contractor.

l. Request for Information (RFI) – An RFI is an official document that the contractor must submit when discrepancies or unclear details are found between solicited document within a Task Order or between manufacturer specifications/recommendations and solicited documents within a Task Order.

RFIs shall contain a description of the discrepancy, a proposed solution(s), clear indication whether the proposed solution(s) will incur additional time and/or cost, the name and position of the individual requesting information, and the date/time stamp indicating when the request was submitted.

m. Statement of Work (SOW) – A document prepared by the Government and issued to the contractor as part of the FOPR for projects which have not been 100% designed which defines the specific technical requirements for the project.

n. Task Order (TO) – A document prepared by the government and issued to the contractor which contains the general requirements and parameters of the proposed project. Included in the Task Order is the Statement of Work or a 100% completed set of drawings and specifications defining specific technical requirements for the project, as well as information such as budget limitations, type of solicitation, design certifications, etc..

b. Authority To Advertise (ATA) Task Orders: A solicitation issued under ATA is not guaranteed an award, but there is reasonable expectation that funding will be made available. Contractors submitting a proposal/bid must provide an acceptance period as indicated in the solicitation that will allow award of the TO at the end of the fiscal year or early into the next fiscal year. If the project is awarded prior to expiration of the acceptance period, the contractor will be issued a TO to accomplish the construction. If funding to award is not made available, the solicitation will be canceled, and no award will be made.

c. Order Of Precedence: Nothing in this document supersedes applicable laws and regulations unless a specific exemption has been obtained in writing. This is to include, but is not limited to, the specifications, drawings, sketches, and other information provided within each individual TO. For conflicts between requirements included in the SOW, the most stringent requirements shall apply unless specifically requested in writing from the Government.

d. Work By The Government: The Government is not obligated to issue any particular type of work under this contract and reserves the right to accomplish work using Government workforces or by other contracts as the Government deems necessary or desirable, and to do so will not breach or otherwise violate this contract.
