PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for Contractor Quality Control approval. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government.
Submit the following in accordance with Section 01 33 00 SUBMITTAL
PROCEDURES:

1.2 WORK COVERED BY CONTRACT DOCUMENTS
1.2.1 Scope of Work
The project consists of providing complete design and construction work necessary for a Design-Build (DB) project as required by this Statement of Work (SOW). It includes, but not limited to site investigations, design surveys, performing calculations, equipment selection, and developing "For-Construction" drawings and specifications as required. Upon approval of the "For-Construction" drawings and specifications, the government shall issue a construction NTP to the contractor. Upon receipt of the NTP, the contractor shall proceed to construct the new facilities in accordance with the approved "For Construction" documents. The Scope of Work is developed by the government, however, the contractor is encouraged to propose enhancements to the design to facilitate and expedite construction, subject to the government approval. The contractor is responsible for conducting surveys on the area where work will take place to verify existing dimensions and to assess site conditions This Scope of Work (SOW) sets forth the requirements for fabrication and assembly of CONEX- type boxes configured into structures to form a Tactical Training Simulator (TTS). The TTS shall be installed onto an existing concrete foundation, provided by Government and designed to accommodate the boxes.
1.2.2 Background
Naval Technical Training Center (NTTC) Lackland is located at Lackland Air Force Base, part of Joint Base San Antonio (JBSA), San Antonio, Texas. The mission of NTTC Lackland is to educate, train, and develop Naval Security Forces and Joint Corrections Specialists for world-wide assignment via various courses.
The courses are designed to provide security force training to Navy Master-at-Arms personnel to support shore based, afloat, and forward deployed Commanding Officers in support of Armed Sentry, Security Reaction Force, and Antiterrorism missions and duties, including security reaction force procedures, engagement tactics, and the prevention of threats to a unit, whether from the pier, small boat, or any other means. Students learn to
SECTION 01 11 00 Page 3 implement immediate actions to identify, assess, track, and deter potential threats, utilizing and demonstrating the proper tactics, techniques and procedures of the Use of Force Continuum. They also learn to perform as a Reaction Force Team Leader coordinating team responses in an asymmetrical environment, to include lighted, low-light, and no light situations.
1.2.3 General Requirements
In order to properly support course instruction, NTTC Lackland requires a multi-purpose TTS at Training Area 8 (TA-8) at JBSA that is capable of providing various 360 degree training scenarios using weapon fired marking cartridges to simulate actual rounds.
This requirement will be met with a design-build project to construct two CONEX-type structures, one to resemble a Navy ship and one to resemble a Navy Base shore facility, similar to a Port Operations waterfront building. Both structures shall be enclosed within a fabric netting sided structure with solid fabric roof for sun shading.
Contractor shall provide a written certification that they have constructed this type of facility a minimum of three times on a Department of Defense military installation or law enforcement facility.
1.2.4 Specific Requirements
The TTS structures shall be designed by a licensed engineer. They shall be constructed of CONEX-type shipping containers approximately 8'x 8'x 20' as self-sufficient structures which do not require auxiliary support.
Structures shall be capable of being disassembled and moved by the Government to other sites utilizing heavy lifting equipment such as cranes and/or forklifts normally used to move shipping containers.
Structures will be sited on a concrete foundation 64' x 60' in place at the project site with a minimum of 15' between each unit, which will serve as a pier. See enclosure (1) for the TA8 layout and pad design.
Training will involve the use of plastic cartridge, paint marking rounds, typical of what is used throughout the Department of Defense. For safety reasons, a fabric netting sided structure at least 35' high shall surround the two structures (approximately 90'x90') and the entrance to the pier. The entrance shall have a functional vehicle gate.
Electrical service must be provided via an underground feed from a nearby main distribution panel. Conduit stub-up is in place adjacent the pad. Each structure shall have a 120/208v, 200 amp electrical panel.
Each structure shall have commercial, wall-mounted HVAC units designed to adequately remove / capture particles via a HEPA filter system. Ductwork shall be insulated on the exterior to allow future duct cleaning, but must be able to withstand the impact of the training rounds.
1.2.5 Ship Configured Structure ("The Ship")
The Ship will be three stories with open deck areas similar to a ship to facilitate training drills. Railing shall be installed at the edge of all exterior trafficable areas. Rappel points with anchor system shall be incorporated on the exterior of the structure.

Spray applied foam insulation and paint shall be applied to the exterior for appearance and protection from the elements.
The Ship shall have spaces that represent or resemble shipboard configurations including a bridge, engine room, living quarters, galley and open deck space. One example of a configuration would be four CONEX boxes on the first level, three on the second level and one on the third level, which would be the bridge. Passageways shall contain framed oval-shaped openings with step over "Knee Knockers" typically found on ships.
The Ship shall have working ship shipboard hatches with single/individual "dog", quick-acting/single lever "dog", and wheel "dog" closures throughout interior spaces. Interior spaces shall also have regular inward opening metal doors, with a mix of left and right hand openings. Exterior hatches will all be quick acting/single lever with at least one each on the first and second levels, and two on the third level.
The Ship shall have at least one vertical and one horizontal escape scuttle large enough to pass through while wearing full tactical equipment. Vertical scuttle shall be paired with a vertical ladder. Horizontal scuttle shall simply allow passage from one space to another.
A typical ship "gangway" ladder and ramp with rails shall allow access from the "pier" to the second level open deck area.
The Ship shall have at least three glass-less porthole "window" openings with lockable operational shutters that face the outside decks. Bridge shall have fixed plexiglass windows and one operational portal.
There shall be two exterior vertical ladders, one between the first and second levels and one between the second and third levels.
The Ship shall have a high angle stair (ladder) with rails between the first and second levels. The Ship shall have paired white and red lighting fixtures as typically found on ships, capable of withstanding impact of training rounds.
The Ship shall have an emergency stop button and strobe/siren on each level.
1.2.6 Shore Facility Configured Structure (#The Building")
The Building will be two stories with a minimally designed metal roof, painted with direct to metal industrial primer and paint.
The Building shall have various types of rooms found in a typical office building with single and double metal doors. Rooms shall have multiple variations of door opening, handle, and feed configurations such as inward/outward opening, left/right handed opening, and center and corner-fed closures.
The Building must include hallways that allow for "L", "T", and "+"4-way" type intersections.
The Building emergency exits will be on the "pier" side of the building. The main first floor entrance shall face outboard. Building ends should also have entry doors on first and second floor.
There shall be at least two interior stairwells that provide different configurations such as a single stair that feeds into a hallway and a stair set with middle landing. There shall be an exterior stairwell from second
SECTION 01 11 00 Page 5 floor on each end. All stairways shall have closed risers.
The Building shall have multiple "window" openings on each floor with lockable operational shutters, minimum four on long sides and two on the short sides.
The Building shall have multiple metal doors on each floor with multiple types of operations including:
- At least 1 each inward opening left handed center-fed
- At least 1 each inward opening left handed corner-fed
- At least 1 each inward opening right handed center-fed
- At least 1 each inward opening right handed corner-fed
The Building shall have various lighting fixtures as typically found in office buildings, capable of withstanding impact of training rounds.
There shall be an emergency stop button and strobe/siren on each level.
1.2.7 Code/Regulatory Requirements
All work performed by the Contractor shall be in accordance with all local, State and Federal Codes. These include but are not limited to:

1.2.8 Site Supervision and Quality Control
The Contractor shall provide a site superintendent at the work location at all times work is being performed for this project. Contractor shall also
SECTION 01 11 00 Page 6 provide a site QC manager at the work site to implement and manage the QC Program. The site superintendent may perform the duties of the QC manager for this project.
1.2.9 Performance of Work
The Contractor shall arrange and hold a pre-construction conference prior to intention to start work with all applicable parties. All pre-requisite submittals, as listed earlier, shall be submitted at this pre-construction conference. The Contractor shall confirm the construction start date with the Contracting Officer Representative at least 48 hours prior to start date. Preparing and sending minutes of all meetings to the attendees are the responsibility of the Contractor.
All Occupational Safety & Health Act (OSHA) work standards shall be followed to include but not limited to all federal, state, national and local codes/construction standards. In performing the contract, the Contractor shall provide for protecting the lives and health of employees and other persons and for preventing damage to property, materials, supplies and equipment in accordance with the latest revision of the U.S. Army Corps of Engineers "Safety and Health Requirements Manuals" (EM 385-1-1) and "Occupational Safety and Health Standards" (29 CFR 1910).
1.2.10 Location
The work is located at JBSA Lackland in the 10000 area, The Training Training Simulator (TTS) will be constructed on an existing 60' X 65" concrete pad located on Haby's Street. The exact location of the concrete will be shown by the Contracting Officer.
1.3 EXISTING WORK
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.
1.4 LOCATION OF UNDERGROUND UTILITIES
Obtain digging permits prior to start of excavation, and comply with Installation requirements for locating and marking underground utilities.
Contact local utility locating service a minimum of 48 hours prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday. Verify existing utility locations indicated on contract drawings, within area of work.

1.4 SPECIAL SCHEDULING REQUIREMENTS
a. All medical and mission critical areas will remain in operation during the entire construction period. The Contractor must conduct his operations so as to cause the least possible interference with normal operations of the activity.
b. Permission to interrupt any Activity roads, railroads, and/or utility service must be requested in writing a minimum of 30 calendar days prior to the desired date of interruption.
1.5 CONTRACTOR ACCESS AND USE OF PREMISES
1.5.1 Activity Regulations
Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and cleared for such entry. Mark all Contractor equipment for identification
1.5.1.1 Subcontractors and Personnel Contacts
Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency, As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.5.1.2 Installation Access
Non DOD persons (Contractors, vendors, etc) requiring entry to JBSA Lackland Kelly Annex must be sponsored by an authorized DBIDS registered

DOD ID card holder. Sponsors must notify the 502nd Security Forces Visitor Control Center NLT 10 days prior to the requested entry date.
All construction contractor employees must have:
a. One form of picture identification
b. Provide personal (full name, date of birth, home address, and driver license number) and vehicle information.
c. A memo from the construction company on company letterhead stating the reason for entry, contract number, project start and end date, and the location at JBSA-Lackland Kelly Annex where the jobsite is located.
1.5.1.3 No Smoking Policy
Smoking is prohibited within and outside of all buildings on the installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation.
Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.
1.5.1.4 Government Housing Areas
a. Haul routes to and from constructions sites cannot go through the housing, residential areas.
b. When working inside a housing area, working hours are limited to 0800 (8 am) to 1600 (4 pm) unless otherwise approved by the Contracting Officer.
1.5.2 Permits and Requests
All permit requests must include at minimum the following:
a. Site Map (8" x 11" or 8" x 14") 5 complete copies
b. 100% Construction Drawings 5 complete copies
c. Project Name and Number
d. Contractor & Subcontractor Name
e. Brief Description of Work - Identify all buildings and/or facilities possibly affected.
f. Desired Date for Work to Begin
g. Estimated Duration of Work
h. 14 Day Advance Notice minimum, unless otherwise noted.

1.5.2.1 Utility Outage Permit
a. Contractor shall complete and submit a written request 14 days in
SECTION 01 14 00 Page 11 advance of the requested utility outage to CES Utility Manager through the 502 CES Construction Manager. The request shall include the utility service to be affected, proposed date, proposed time, and outage duration. Form 103 included in Appendix F can also be used for the request.
c. Provide CES Construction Manager a copy of the written Utility Outage request.
d. After submitting the request to the government, the Contractor must receive approval from the government prior to scheduling a utility outage.

1.2 VIEW LOCATION MAP
Submit, prior to or with the first digital photograph submittals, a sketch or drawing indicating the required photographic locations. Update as required if the locations are moved.
1.3 PROGRESS AND COMPLETION PICTURES
Photographically document site conditions prior to start and at completion of each construction task order. Digital photographs, .jpeg, shall be provided to the Contracting Officer for unrestricted use by the Government.
1.4 MINIMUM INSURANCE REQUIREMENTS
Procure and maintain during the entire period of performance under this contract the following minimum insurance coverage:
Comprehensive general liability: $500,000 per occurrence
a. Automobile liability: $200,000 per person, $500,000 per occurrence for bodily injury, $20,000 per occurrence for property damage
b. Workmen's compensation as required by Federal and State workers' compensation and occupational disease laws.
c. Employer's liability coverage of $100,000, except in States where workers compensation may not be written by private carriers,
d. Others as required by Texas law.
1.5 CONTRACTOR SPECIAL REQUIREMENTS
Accomplish all contract requirements of the Section assigned directly with the first tier subcontractor.

1.6 SUPERVISION
1.6.1 Minimum Communication Requirements
Have at least one qualified supervisor capable of reading, writing, and conversing fluently in the English language on the job site during working hours. In addition, if a Quality Control (QC) representative is required on the contract, then that individual shall also have fluent English communication skills.
The Project Manager in this context shall mean the individual with the responsibility for the overall management of the project and the Project Superintendent shall mean the individual with the responsibility for quality and production. Both the Project Manager and Project Superintendent are subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion. Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to such stop orders shall be made the subject of claim for extension of time for excess costs or damages by the Contractor.
1.7 AVAILABILITY OF CADD DRAWING FILES
After award and upon request, the electronic "Computer-Aided Drafting and Design (CADD)" drawing files will only be made available to the Contractor for use in preparation of construction data related to the referenced contract subject to the following terms and conditions.
Data contained on these electronic files shall not be used for any purpose other than as a convenience in the preparation of construction data for the referenced project. Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal exposure to the Government. The Contractor shall make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. The Contractor shall, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.
These electronic CADD drawing files are not construction documents.
Differences may exist between the CADD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CADD files, nor does it make representation to the compatibility of these files with the Contractors hardware or software. In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished CADD files, the signed and sealed construction documents shall govern. The Contractor is responsible for determining if any conflict exists. Use of these CADD files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project.
If the Contractor uses, duplicates and/or modifies these electronic CADD files for use in producing construction drawings and data related to this contract, all previous indicia of ownership (seals, logos, signatures, SECTION 01 30 00 Page 15 initials and dates) shall be removed.
1.8 ELECTRONIC MAIL (E-MAIL) ADDRESS
The Contractor shall establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments in Microsoft, Adobe Acrobat, and other similar formats. Within 10 days after contract award, the Contractor shall provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence. The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes, terrorist threats, etc. Multiple email address will not be allowed.
It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). The Contractor shall promptly notify the Contracting Officer, in writing, of any changes to this email address.

PART 1 GENERAL
1.1 Qualifications
The Contractor shall designate an authorized representative who shall be responsible for the preparation of all required project schedule reports.
1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;

3.1 Project Schedule
3.1.1 AF IMT 3064
Use of the AF IMT 3064 will be the normal requirement for contractor construction schedules under this contract.
3.1.2 Level of Detail Required
a. Government Activities: Government and other agency activities that could impact progress shall be shown. These activities include, but are not limited to: approvals, design reviews, environmental permit approvals by State regulators, inspections, and Notice to Proceed (NTP) for phasing requirements.
b. Responsibility: All activities shall be identified in the project schedule by the party responsible to perform the work. Responsibility includes, but is not limited to, the subcontracting firm, contractor work force, or government agency performing a given task. Activities shall not belong to more than one responsible party. The responsible party for each activity shall be identified by the Responsibility Code.
1. Work Areas: All activities shall be identified in the project schedule by the work area in which the activity occurs. Activities shall not be allowed to cover more than one work area. The work area of each activity shall be identified by the Work Area Code.
c. Scheduled Project Completion: The schedule interval shall extend from NTP to the Contract completion date.

1. Project Start Date: The schedule shall start no earlier than the date on which the NTP was acknowledged. The Contractor shall include as the first activity in the project schedule an activity called "Start Project". The "Start Project" activity shall have an constraint date equal to the date that the NTP was acknowledged, and a zero day duration.
2. Early Project Completion: In the event the project schedule shows completion of the project prior to the contract completion date, the Contractor shall identify those activities that have been accelerated and/or those activities that are scheduled in parallel to support the Contractor's "early" completion. Contractor shall specifically address each of the activities noted in the AF IMT 3065 at every project schedule update period to assist the Contracting Officer in evaluating the Contractor's ability to actually complete prior to the Contract period.
d. Interim Completion Dates: Contractually specified interim completion dates shall also be constrained to show negative float if the early finish date of the last activity in that phase falls after the interim completion date.
1. Start Phase: The Contractor shall include as the first activity for a project phase an activity called "Start Phase X" where "X" refers to the phase of work. The "Start Phase X" activity shall have a constraint date equal to the date on which the NTP was acknowledged, and a zero day duration.
2. End Phase: The Contractor shall include as the last activity in a project phase an activity called "End Phase X" where "X" refers to the phase of work. The "End Phase X" activity shall have a constraint date equal to the completion date for the project, and a zero day duration.
c. Phase X: The Contractor shall include a hammock type activity for each project phase called "Phase X" where "X" refers to the phase of work. The "Phase X" activity shall be logically tied to the earliest and latest activities in the phase.
e. Default Progress Data Disallowed: Actual Start and Finish dates shall not be automatically updated by default mechanisms that may be included in CPM scheduling software systems. Actual Start and Finish dates on the CPM schedule shall match those dates provided from Contractor Quality Control Reports. Failure of the Contractor to document the Actual Start and Finish dates on the Daily Quality Control report for every in-progress or completed activity, and failure to ensure that the data contained on the Daily Quality Control reports is the sole basis for schedule updating shall result in the disapproval of the Contractor's schedule and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes. Updating of the percent complete and the remaining duration of any activity shall be independent functions. Program features which calculate one of these parameters from the other shall be disabled.
f. Out-of-Sequence Progress: Activities that have posted progress without all preceding logic being satisfied (Out-of-Sequence Progress) will be allowed only on a case-by-case approval of the Contracting Officer. The Contractor shall propose logic corrections to eliminate all out of

g. Negative Lags: Lag durations contained in the project schedule shall not have a negative value.

Submittals are identified by Submittal Description (SD) numbers and titles as follows:

SD-06 Test Reports
Report signed by authorized official of testing laboratory that a material, product or system identical to the material, product or system to be provided has been tested in accord with specified requirements. Unless specified in another section, testing must have been within three years of date of contract award for the project.
Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work or prototype prepared for the project before shipment to job site.
Report which includes finding of a test made at the job site or on sample taken from the job site, on portion of work during or after

SD-07 Certificates

Document required of Contractor, or of a manufacturer, supplier, installer or Subcontractor through Contractor. The document purpose is to further promote the orderly progression of a portion of the work by documenting procedures, acceptability of methods, or personnel qualifications.
Confined space entry permits.
Text of posted operating instructions.
SD-11 Closeout Submittals
Documentation to record compliance with technical or administrative requirements or to establish an administrative mechanism.
Submittals required for Guiding Principle Validation (GPV) or Third Party Certification (TPC).
Special requirements necessary to properly close out a construction contract. For example, Record Drawings and as-built drawings. Also, submittal requirements necessary to properly close out a major phase of construction on a multi-phase contract.
1.1.2 Approving Authority
The Contracting Officer (CO) approves submittals.
1.1.3 Work
As used in this section, on- and off-site construction required by contract documents, including labor necessary to produce submittals, construction, materials, products, equipment, and systems incorporated or to be incorporated in such construction.
1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. Submit the following in accordance with this section.

1.3 SUBMITTAL CLASSIFICATION
Submittals are classified as follows:
1.3.1 Government Approved (G)
Within the terms of the Contract Clause SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION, they are considered to be "shop drawings."
1.4 PREPARATION
1.4.1 Transmittal Form
Prior to submittal, all items shall be checked and approved by the Contractor and each respective AF Form 3000 shall be signed and dated by the contractor certifying that the accompanying submittal complies with the contract requirements.
1.4.2 Source Drawings for Shop Drawings
The entire set of Source Drawing files (DWG) will not be provided to the Contractor. Only those requested by the Contractor to prepare shop drawings may be provided. Request the specific Drawing Number only for the preparation of Shop Drawings. These drawings may only be provided after award.
1.4.3 Electronic File Format
Provide submittals in electronic format, with the exception of material samples required for SD-04 Samples items. Compile the submittal file as a single, complete document, to include the AF Form 3000. Name the electronic submittal file specifically according to its contents, coordinate the file naming convention with the Contracting Officer.
Electronic files must be of sufficient quality that all information is legible. Use PDF as the electronic format, unless otherwise specified or directed by the Contracting Officer. Generate PDF files from original documents with bookmarks so that the text included in the PDF file is both searchable and can be copied. If documents are scanned, Optical Character Resolution (OCR) routines are required. Index and bookmark files exceeding 30 pages to allow efficient navigation of the file. When required, the electronic file must include a valid electronic signature, or scan of a signature.
Email electronic submittal documents fewer than 10MB to an email address as directed by the Contracting Officer. Provide electronic documents over 10MB on an optical disc, or through an electronic file sharing system such as the AMRDEC SAFE Web Application located at the following website:
https://safe.amrdec.army.mil/safe/ .
Provide hard copies of submittals when requested by the Contracting Officer. Three additional hard copies of any submittal shall be be provided.
1.5 QUANTITY OF SUBMITTALS

b. Submit one sample panel or provide one sample installation where directed. Include components listed in technical section or as directed.
c. Submit one sample installation, where directed.
d. Submit one sample of non-solid materials.
1.5.4 Number of Copies SD-05 Design Data and SD-07 Certificates
Submit four copies for review and approval by the Contracting Officers.
1.5.5 Number of Copies SD-06 Test Reports and SD-09 Manufacturer's Field Reports
Submit in compliance with quantity and quality requirements specified for shop drawings other than field test results that will be submitted with QC reports.
1.5.6 Number of Copies of SD-10 Operation and Maintenance Data
Submit two copies of O&M Data to the Contracting Officer for review and approval.
1.5.7 Number of Copies of SD-01 Preconstruction Submittals and SD-11 Closeout Submittals
Unless otherwise specified, submit two sets of administrative submittals.
1.6 INFORMATION ONLY SUBMITTALS
Normally submittals for information only will not be returned. Approval of the Contracting Officer is not required on information only submittals.
The Government reserves the right to require the Contractor to resubmit any item found not to comply with the contract. This does not relieve the Contractor from the obligation to furnish material conforming to the plans and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work;
and does not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical specifications so prescribe.
1.7 Deviation
All requests for deviations shall be clearly identified by the Contractor
SECTION 01 33 00 Page 25 on AF Form 3000. The Contractor shall set forth in writing the reason for any deviations and annotate such deviations on the submittal.
1.8 VARIATIONS
Variations from contract requirements require both Designer of Record (DOR) and Government approval pursuant to contract Clause FAR 52.236-21 and will be considered where advantageous to Government.
1.8.1 Considering Variations
Discussion with Contracting Officer prior to submission, after consulting with the DOR, will help ensure functional and quality requirements are met and minimize rejections and re-submittals. When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal (VECP).
Specifically point out variations from contract requirements in transmittal letters. Failure to point out deviations may result in the Government requiring rejection and removal of such work at no additional cost to the Government.
1.8.2 Proposing Variations
When proposing variation, deliver written request to the Contracting Officer, with documentation of the nature and features of the variation and why the variation is desirable and beneficial to Government, including the DOR's written analysis and approval. If lower cost is a benefit, also include an estimate of the cost savings. In addition to documentation required for variation, include the submittals required for the item.
Clearly mark the proposed variation in all documentation.
1.8.3 Warranting that Variations are Compatible
When delivering a variation for approval, Contractor, including its Designer(s) of Record, warrants that this contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of work.
1.8.4 Review Schedule Extension
In addition to normal submittal review period, a period of 10 working days will be allowed for consideration by the Government of submittals with variations.
1.9 SCHEDULING
Schedule and submit concurrently submittals covering component items forming a system or items that are interrelated. Include certifications to be submitted with the pertinent drawings at the same time. No delay damages or time extensions will be allowed for time lost in late submittals.
a. Coordinate scheduling, sequencing, preparing and processing of submittals with performance of work so that work will not be delayed by submittal processing. Allow for potential resubmittal of requirements.
b. Submittals called for by the contract documents will be listed on the register. If a submittal is called for but does not pertain to the contract work, the Contractor is to include the submittal in the
SECTION 01 33 00 Page 26 register and annotate it "N/A" with a brief explanation. Approval by the Contracting Officer does not relieve the Contractor of supplying submittals required by the contract documents but which have been omitted from the register or marked "N/A."
d. Carefully control procurement operations to ensure that each individual submittal is made on or before the Contractor scheduled submittal date shown on the approved "Submittal Register."
1.10 GOVERNMENT APPROVING AUTHORITY
The Contracting Officer is the approving authority.
a. Note date on which submittal was received.
b. Review submittals for approval within scheduling period specified and only for conformance with project design concepts and compliance with contract documents.
c. Identify returned submittals with one of the actions defined in paragraph REVIEW NOTATIONS and with markings appropriate for action indicated.
Upon completion of review of submittals requiring Government approval, two copies of the submittal will be retained by the Contracting Officer and one copy of the submittal will be returned to the Contractor.
1.10.1 Review Notations
Submittals will be returned to the Contractor with the following notations:
a. Submittals marked "approved" or "accepted" authorize the Contractor to proceed with the work covered.
b. Submittals marked "approved as noted" or "approved, except as noted, resubmittal not required," authorize the Contractor to proceed with the work covered provided he takes no exception to the corrections.
c. Submittals marked "not approved" or "disapproved," or "revise and resubmit," indicate noncompliance with the contract requirements or design concept, or that submittal is incomplete. Resubmit with appropriate changes. No work shall proceed for this item until resubmittal is approved.
d. Submittals marked "not reviewed" will indicate submittal has not been reviewed and approved by Contractor, or is not complete. A submittal marked "not reviewed" will be returned with an explanation of the reason it is not reviewed. Resubmit submittals returned for lack of review by Contractor or for being incomplete, with appropriate action, coordination, or change.
1.11 DISAPPROVED OR REJECTED SUBMITTALS
Make corrections required by the Contracting Officer. If the Contractor considers any correction or notation on the returned submittals to constitute a change to the contract drawings or specifications; notice as required under the FAR clause entitled CHANGES, is to be given to the Contracting Officer. Contractor is responsible for the dimensions and design of connection details and construction of work. Failure to point
SECTION 01 33 00 Page 27 out deviations may result in the Government requiring rejection and removal of such work at the Contractor's expense.
If changes are necessary to submittals, make such revisions and submission of the submittals in accordance with the procedures above. No item of work requiring a submittal change is to be accomplished until the changed submittals are approved.
1.12 APPROVED/ACCEPTED SUBMITTALS
The Contracting Officer's approval or acceptance of submittals is not to be construed as a complete check, and indicates only that
Approval or acceptance will not relieve the Contractor of the responsibility for any error which may exist, as the Contractor under the Contractor Quality Control (CQC) requirements of this contract is responsible for.
After submittals have been approved or accepted by the Contracting Officer, no resubmittal for the purpose of substituting materials or equipment will be considered unless accompanied by an explanation of why a substitution is necessary.
1.13 APPROVED SAMPLES
Approval of a sample is only for the characteristics or use named in such approval and is not to be construed to change or modify any contract requirements. Before submitting samples, the Contractor shall assure that the materials or equipment will be available in quantities required in the project. No change or substitution will be permitted after a sample has been approved,unless accompanied by an expanation of why a substitution is necessary.
