ATTACHMENT 1 – STATEMENT OF WORK/SPECIFICATIONS

Brackish Groundwater National Desalination Research Facility

As-Needed Security Guard Services

Statement of Work

1.0 GENERAL

The purpose of this requirement is to acquire security guard services for a minimum of ten hours per week with the potential for more on an as need basis to accommodate client request to work beyond regular business hours and for special events at the Brackish Groundwater National

Desalination Research Facility (BGNDRF). Special events requiring security services may include periodic cleaning of the facility, multi-day public events, and access monitoring during construction activities. The security guard is responsible for closing and securing the facility upon the departure of the clients and monitoring facility access during special events.

2.0 LOCATION AND DESCRIPTION

BGNDRF is located at 500 LaVelle Road, Alamogordo, New Mexico 88310. BGNDRF is a

43-acres research test facility comprised of a central research building, various indoor and outdoor test areas, and water/desalination research infrastructure. The central research building is a single-story building with 2 levels that consist of approximately 15,200 square feet. There is one main door in the front of the building that leads to the main building entrance, which is where the front desk/guard station is located.

3.0 SERVICES REQUIRED

This contract could require multiple security guards depending on facility operations and special events. The different types of work anticipated are summarized below. Each of the services will be individually priced and will only be invoiced when the work is requested and completed. The

COR will coordinate with the contractor to schedule the remaining services.

3.1 The Contractor shall provide one (1) unarmed security guard for a minimum of 10 hours per week for days and times requested by the COR. On request, provide site security for an additional designated period of time not to exceed 10 hours per shift and generally 2 to 8 hours per shift.

3.2 The Contractor shall provide one (1) unarmed security guard to provide site security during two annual public events. Shifts will not exceed 10 hours and will be a minimum of 7 hours per day.

3.3 If requested, the Contractor shall provide one (1) unarmed security guard to monitor vehicle access to the facility during scheduled construction activities. Scheduled activities may result in shifts up to 40 hours per week and may require a second guard.

3.4 Specific requirements for the security service include:

3.4.1 Security guards will be in uniform and will always carry a Security Guard Card while performing security services. The Security Guard Card is issued by the Private Investigation

Advisory Board of the State of New Mexico Regulation and Licensing Department.

3.4.2 Security guards will be in compliance with all local, state, and federal laws, rules and regulations applicable to the business within the city of Alamogordo, New Mexico.

3.4.3 Contractor employees providing security guard service will be licensed, bonded, and insured as required by the State of New Mexico and proof will be provided as an attachment to the proposal. Proof of license as a level 1, unarmed, security guard is required for each person employed in the performance of this contract as a security guard at BGNDRF.

3.5 Security guards will not consume any alcohol or controlled substances eight (8) hours prior to going on duty or while performing duties at the BGNDRF site. This will be verified through a random drug testing program implemented by the Contractor.

3.6 Security guards will monitor and observe building occupants and visitors for compliance with the Federal Management Regulations (41 CFR 102-74) and the facility’s posted rules and regulations. Security guards will identify and report to local law enforcement those persons who are suspected of trespassing, vandalism, and/or theft. The report to local law enforcement will be followed up with a call and written report to the Contractor’s home office and the BGNDRF

Research Facility Manager.

3.7 Security guards will maintain physical security as prescribed by New Mexico Administrative

Code (NMAC) 16.48. Security guards are responsible for detecting and/or preventing persons from gaining unauthorized access to Government property or otherwise violating laws and regulations.

3.7.1 Facility Security Officer will be determined at the time of contract award.

3.8 All incidents that violate laws and regulations will be reported to the Contractor employee’s supervisor and local law enforcement.

3.9 The security guard will prepare a daily guard log sheet that details the events during the shift to include: reporting and leaving duty, normal security checks, and all unusual occurrences or problems encountered. A copy of the report will be given to the COR.

4.0 ACCESS CONTROL TO FACILITY

4.1 Security guards will require picture identification before allowing access of authorized personnel to BGNDRF. Reclamation will provide a list of authorized personnel and the schedule of their time in the facility. External front doors and the external office corridor door will remain secured during the shift. External test bay doors will remain secured unless requested by authorized research personnel. If the test bay doors are open, the guard will periodically monitor the test bays to ensure the research personnel are present.

4.2 The security guard will secure external doors and arm the security system prior to leaving.

4.3 The security guard will secure the parking lot access gate upon leaving.

4.4 With advance approval from the COR, the security guard may open the vehicle gate for authorized personnel accessing the rear of the facility.

5.0 AUTHORITY AND JURISDICTION, PERMITS, LICENSES, AND ADHERENCE TO

LAWS

5.1 Prior to commencement of work under this Contract, and except where precluded by local law or ordinance, the Contractor will make and complete all arrangements with the appropriate officials in the state or local jurisdiction in which the services are to be performed to obtain, possess, and maintain all business and corporate licenses required to operate as a commercial security service within the entire geographic area covered under this Contract. The Contractor will furnish a legible copy of all legally required licenses and permits (including permits and licenses issued to individual Contract employees) to the Contracting Officer (CO) and COR prior to the

Contract start date and provide any revised licenses or permits during the Contract term.

5.2 The Contractor will certify that all legal requirements have been fulfilled prior to the commencement of any Contract work. The Contractor will provide updated records to the

Government upon request by the CO or COR. The Contractor will not be reimbursed for services rendered by a security guard lacking appropriate permits and certifications.

5.3 Failure by the Contractor to obtain all required licenses as of the Contract start date will be grounds for termination for default. Failure by the Contractor to maintain valid licenses and permits during the time period of the contract will be cause for the Government to take remedial contractual actions, up to and including termination for default.

5.4 The Contractor will pay all costs and fees associated with applying for, receiving, and maintaining all such permits and licenses throughout the term of the Contract. The costs associated with this requirement must be factored into the Contractor’s rate, as they will not be itemized or paid for separately by the Government.

5.5 The CO and COR will have the express authority to examine these documents upon request, at any time, during the duration of this Contract.

6.0 PERSONNEL QUALIFICATIONS

6.1 The Contractor will not employ illegal or undocumented aliens as guards for this contract. The

Contractor will expressly incorporate this provision into all subcontracts or subordinate agreements issued in support of this contract.

6.2 To be eligible to perform under this Contract, uniformed Contractor employees will meet, to the satisfaction of the CO and COR, the following requirements:

6.2.1 Be a citizen of the United States of America. The COR may approve Lawful Permanent

Residents who are currently members of the U.S. armed services (Reserves or National Guard) or who possess an Honorable Discharge from a U.S. Military component.

6.2.2 Have a Social Security Card issued and approved by the Social Security Administration.

6.2.3 Be at least 21 years of age. While there is no limit as to the maximum age of security guards, security guards must be able to withstand the physical demands of the job and must be capable of responding to emergencies. At the request of the COR, the CO may waive the minimum age requirement where the applicant meets all of the other minimum requirements and is legally eligible to perform the required duties.

6.2.4 Possess, at a minimum, either a high school diploma or a GED equivalency certificate.

6.2.5 Speak English fluently, read and comprehend written English, and compose coherent written reports in English. Bi-lingual security guards may be an asset to the Contractor.

6.2.6 Will possess all licenses and training as required by the state of New Mexico.

6.2.7 Will be able to pass the requirements in SLE 01-01, Personnel Security and Suitability, as it is applicable to guards. SLE 01-01 is included as Attachment S.

6.2.8 Have two (2) years of security experience and/or security related education within the past five (5) years.

6.2.9 A Contractor employee, that will access a Reclamation facility, will be required to have a

Department of Interior Access card. The Contractor will coordinate with the COR for application instructions.

6.2.9.1 The Government will pay the cost of obtaining the Department of Interior Access card and the background check that is included. The Contractor will respond to requests from the issuing authority and secure any necessary appointments in a timely manner, not to exceed two weeks from the initial request. The Contractor may request reimbursement for time and mileage required to obtain the Department of the Interior Access card.

6.2.9.2 The Government reserves the right to limit the number of Contractor employees with a

Department of Interior Access card to four (4) employees at any given time for the duration of the contract.

7.0 UNIFORMS

7.1 The contractor will furnish uniforms, a company cell phone and guard report forms. The

Contractor’s security guard force uniforms will be a color and style in general use by security guard or security organizations and will be readily distinguishable from those of state, local and

Bureau of Reclamation law enforcement personnel. Security guards performing under this

Contract will wear the same color and style of uniform and maintain a professional and neat appearance at all times during their tour of duty.

8.0 CONTRACTOR QUALITY CONTROL

8.1 The Contractor will use all methods deemed necessary to ensure that the Contractor’s employees are following the terms of the Contract. The Contractor will provide a Quality Control

Report within 15 days of Contract award regarding the following areas:

Employee qualifications, performance, uniform and appearance; attendance; possession of certification and company identification card(s) and possession of required licenses and permits.

8.1.1 Quality Control Reports will be prepared by the Contractor each time there is a change in

Contractor personnel utilized at the facility. A file will be maintained for all reports made during the entire Contract period. The Contractor will make those reports available to the CO or COR upon request.

8.1.2 The Contractor will brief the COR of any problems or deficiencies noted during a review and will inform the COR of all actions taken or planned to resolve the problem. If the Contractor’s performance indicates that additional quality control measures are needed, the CO and COR will meet with the Contractor to discuss the Contractor’s performance and any other areas of concern.

Through the CO, the COR may request that the Contractor take additional steps to improve both the overall performance of the Contract and adherence to the items required in the Quality Control

Report.

8.1.3 The Government will consider the Contractor’s adherence to their stated Quality Control

Plan during annual performance evaluations prior to exercising the option for the next contract period. Failure by the Contractor to adhere to their stated Quality Control Plan may result in

Contractual actions being taken by the Government.

8.2 Government Quality Control

8.2.1 The Government will use all methods deemed necessary to ensure that the Contractor’s employees are following the terms of the Contract. These methods may include surveillance by

Reclamation staff and surveys of Government employees regarding the security guards’ performance, including the security guards’ professionalism, courtesy, and knowledge of their assigned duties.

8.2.2 In the event a breach of assigned duty by the Contractor’s employee(s) is identified during a quality control exercise, the CO and/or COR will contact the Contractor to discuss the

Government’s findings and the steps the Contractor will take to correct the problem(s).

8.2.3 The Government may assess price deductions for each hour where services are not rendered according to the provisions of this Contract.

9.0 CONDUCT OF CONTRACTOR PERSONNEL

9.1 The Contractor will be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity, and will be responsible for taking such disciplinary action as may be necessary.

9.2 The COR may recommend to the CO that the Contractor immediately remove any employee the COR and CO deems incompetent, unqualified, irresponsible, careless, or otherwise objectionable or if the employee is in violation of any of the terms in this contract. In the event of a dispute, the CO will make the final determination. Specific reasons for removal of an employee will be provided to the Contractor in writing.

9.3 The Contractor’s employees will not sleep during the shift. Such action will result in disciplinary action. Contract employees may read, study, listen to music, or do other non-disruptive activities, when stationed in the reception area, if the actions do not interfere with performance of the security checks or monitoring access to BGNDRF. Reclamation computers will not be used for any reason.

9.4 All contact with the public will be courteous and helpful. Guards shall not receive personal visitors while on duty.
