JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

PROJECT NAME:

NextGen/WinFlow

The following Justification for Other than Full & Open Competition (JOFOC) is prepared in accordance with FAR Subpart 6.302.

1. ORGANIZATION:

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

NextGen is an integrated pipeline hydraulic software suite. NextGen integrates both WinFlow (Steady-state) and WinTran (Transient) pipeline hydraulic software into one package.

3. DESCRIPTION OF REQUIREMENT & VALUE:

The Division of Pipeline Certificates (DPC), which is in the Office of Energy Projects, utilizes commercially available pipeline simulation software packages for hydraulic modeling purposes:

Gregg Engineering (WinFlow and WinTran) and DNV-GL Synergi Software. Both programs allow DPC engineering staff to analyze the operational designs (under both steady-state and transient conditions) of regulated, interstate natural gas pipelines systems which are a core responsibility of the DPC in analyzing certificate applications.

Gregg Engineering has developed a version of its steady-state and transient software; NextGen.

This software was developed as an upgrade to its existing software platforms for increased functionality regarding the flow dynamics of natural gas through the nation’s extensive interstate pipeline grid.

ANTICIPATED DOLLAR VALUE: $994,306.00 (Base + 4 Option Periods)

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2) in accordance with: (mark only one authority)

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

Gregg Engineering has been an industry leader in pipeline hydraulic software for nearly 35 years. During that time, Gregg Engineering has used its pipeline hydraulic software to provide pipeline simulation software to the gathering, transmission and distribution markets. Gregg Engineering’s NextGen Simulation Suite represents a new standard in pipeline modeling, brining enterprise level integration and performance to streamline everything from design to management.

6. SOURCES SOUGHT EFFORTS:

There are no other pipeline simulation programs that can be compared to either Gregg Engineering’s or DNV GL’s acceptance in the marketplace. Further, there are no compatibility options available to allow a hydraulic model to be imported from or to another software package.

As it currently stands, rarely does a regulated pipeline company provide pipeline hydraulic models which are not compatible with Gregg Engineering (WinFlow and WinTran) and DNV GL (Synergi) hydraulic modeling software.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

Based on the current contract and this being a sole source purchase, we added ten percent to the cost of the current contract due to inflation to obtain our pricing for this product.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:

This is a renewal for maintenance. We establish that this was a sole source purchase during the initial purchase: Market research indicated that this was not available through any other means or resellers. There is still only one vendor that can provide the functionality of NextGen to the interstate pipeline companies that have already made the financial commitment to purchase the NextGen software from Gregg Engineering. There are no other pipeline simulation software programs that can import a pipeline system. Without NextGen, FERC will not be able to conduct hydraulic analyses on nearly 50 percent of the FERC regulated interstate pipeline systems.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

We have licensed the NextGen software from Gregg Engineering for over 25 years. Due to the length of time FERC pipeline engineers have used these software programs, we have continued to invest in training our engineers every few years to keep our software knowledge up to date.

This has allowed our engineers in our division to keep their analysis skills sharp. If we don’t move forward with this acquisition, we will not be able to provide answers to the Commission in a timely manner. Further, FERC will need to re-invest into pipeline simulation software that the engineers have never seen or used before. Lastly, there is no substitute for Gregg Engineering’s NextGen software. Their pipeline simulation programs are not interchangeable due to the proprietary formats used by Gregg Engineering and the other pipeline simulation software packages currently available.
