About this file
This document is a single source justification for construction period services for a project to replace damaged doors and upgrade a card access system at a Department of Veterans Affairs medical center. The Boston West Roxbury VA Medical Center Facilities Projects team is initiating construction of project 523A4-12-207 and seeks to contract with Harriman, who served as the architect/engineer for the design, to provide construction period services. Harriman is justified as the single source as they have intimate knowledge of the complex design requirements from executing the previous design contract. Procuring a different firm would significantly increase performance risks due to the steep learning curve required and potential lack of understanding of design intent. The total estimated value for Harriman to provide construction period services is $69,774.20.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Last Updated: 02/01/22 Page 1 of 2
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241-23-AP-4545
1. Contracting Activity Department of Veterans Affairs, VISN 01, VHA West Roxbury Healthcare
System, 523 VA Boston Medical Center, West Roxbury, MA; NCO 1 Contracting and Engineering Service Sole Source Proprietary Products
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The Boston West Roxbury VA Medical Center Facilities Projects team is initiating the construction of project 523A4-12-207 Replace Damaged Doors and Upgrade Card Access System WR. This sole source justification is to contract to Harriman who serves as the Architect/Engineer (A/E) Designer of Record to provide Construction Period Services (CPS) for the project. These services were previously awarded to the A/E Designer of Record but were descoped due to expired funding for construction. The proposed action is to provide follow on CPS during the construction phase of the project. Construction Period Services are to include, but are not limited to, review and approval of construction submittals, samples, shop drawings, schedules, phasing plans; response to Request for Information (RFI); change order review and recommendations; preparation of cost estimates to Request for Proposal (RFP);
cost/time/impact estimates and recommendations relevant to apparent construction plan deviations; site visits as required and/or requested by the VA Contracting Officer and Project Engineer for inspection of ongoing construction including final tests and inspections;
documentation of all necessary site visits to the VA Contracting Officer and Project Engineer within one (1) week after the visit; verification and preparation of as-built drawings from contractor supplied marked up prints which the VA will retain permanently. The design firm shall provide all labor, supervision, materials, and equipment to provide type C services for NRM project 523A4-12-207 Replace Damaged Doors and Upgrade Card Access System WR at the West Roxbury VA Medical Center.
The total estimated value of the proposed action is $69,774.20.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Harriman is the A/E Designer of Record and were previously awarded the design and CPS for this project but is being descoped due to expired funding. The AE IDIQ it was previously awarded on is now expired. Awarding this project to another A/E firm would add significant risk to the facility due to a loss of technical familiarity with the project.

The proposed sole source contractor has worked very closely with the technical and functional resources in the West Roxbury VA and gained significant knowledge of the requirements to facilitate the previously completed design. The exposure to the VA and design work will be crucial as the Replace Damaged Doors and Upgrade Card Access System is completed. Harriman has intimate knowledge of the design due to their execution of the design under a previous contract. If another vendor is selected, additional risk would be incurred as the new contractor’s staff may not fully understand the intent and context of the complex requirements included in this design. Furthermore, another source would require a steep learning curve while gaining familiarity with the design itself.
Additionally, the A/E designer of record needs to be retained for CPS for warranty and liability issues. CPS is a continuation of the design and procuring a different A/E for these services will relieve Harriman of their responsibilities and could forfeit VA’s total liability for faulty design and selection. Harriman is liable for making any corrections to the design if problems occur during construction.
4. Description of market research conducted and results or statement why it was not conducted:
The project’s design was produced by Harriman (A/E designer of record). CPS was provided within their initial project proposal which included Concept, Design, and CPS. Harriman is therefore best positioned to provide these services without additional delay and performance risk associated with engaging a different contractor. No additional market research was conducted.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
