SECTION C – STATEMENT OF WORK (SOW)

Background The National Transportation Safety Board (NTSB) is an independent federal agency responsible for investigating and determining the probable cause of every civil aviation accident and significant accidents in other modes of transportation - railroad, highway, marine and pipeline. The Office of Government Ethics (OGE) requires certain executive branch employees to file confidential financial disclosure reports (OGE Form 450). Each agency determines who must file a confidential financial disclosure report, based on criteria established by OGE. The NTSB’s Designated Agency Ethics Official (DAEO), in coordination with other agency ethics officials and human resources officials, determines the positions of agency employees who must file the OGE Form 450.

NTSB employees who are required to file an OGE Form 450 must submit a new entrant report within 30 days of assuming the duties of their position, unless an extension is granted. Thereafter, employees are required to file an OGE Form 450 on an annual basis.

Employees required to file confidential reports currently submit a paper or pdf copy of the report with an agency ethics official. Ethics officials receive, review, and certify the reports, and store them securely in either paper or electronic format.

OGE regulations provide that the NTSB’s DAEO is responsible for determining whether the OGE Form 450 will be collected in an electronic or a paper format (5 C.F.R. § 2638.205.). In addition, OMB Memorandum M-19-21, Transition of Electronic Records, directs all Federal agencies to ensure that all Federal records are created, retained, and managed in electronic formats, with appropriate metadata. The General Counsel is the DAEO for the NTSB. The DAEO has determined that electronic filing of the OGE Form 450 is necessary to comply with OMB Memorandum M-19-21, and to manage the agency’s ethics program effectively and efficiently.

Scope of Work The NTSB has a need for a Commercial Off the Shelf (COTS) software to manage the collection, review, certification, and storage of electronic OGE Form 450 reports, beginning with the reports due in January 2022. The contractor shall implement a COTS solution that meets all the requirements below. The NTSB requires the software to perform the following functions:

• Be FedRAMP authorized and maintain the authorization throughout the period of performance.

• Require communications to be encrypted using HTTPS, Transport Layer Security (TLS) version 1.2 or later, and HTTPS Strict Transport Security (HSTS).

• Ability to support single sign on logins, multifactor authentication, and login via Okta.

• Ability to encrypt data consistent with Federal encryption standards.

• Ability to provide access to information required for security and privacy, continuous monitoring of the service, and the NTSB’s use of the service.

• Ability to use the most current version of the OGE Form 450.

• Ability to permit online access from any location with internet access.

• Ability to provide instructions through an interview wizard to allow filers to determine how to include reportable information in each section.

• Ability to automatically populate annual reports with data from previously submitted electronic forms.

• Ability to upload documents that can be attached to the OGE Form 450.

• Ability to save each draft and final versions of the form, for filers to securely submit and sign the report, and to permit filers and administrators to access certified reports throughout the year.

• Ability to permit reviewers to provide comments on submitted reports.

• Ability to define different access privileges and functions for different groups of users.

• Ability to permit reviewers to change and update the list of filers and filings as necessary.

• Ability for administrative users to return submitted reports to employees for revision.

• Ability to assign, track, and manage tasks by administrative users.

• Ability to provide report functions that can be customized by, among other things, date, filer, reviewer, or due date.

• Ability to provide for cataloging of forms, searchable access and storage, and notification options for filers and reviewers.

• Ability to retain all records for the required retention period.

• Ability to permit the automatic deletion of reports beyond the required retention period that can be adjusted as necessary to avoid deletion of reports when appropriate.

• Provide an online user manual.

• Provide technical support to users for issues the user may have while using the service.

Brand Name or Equal The NTSB has identified the brand of “FDOnline” as a software license subscription (SaaS) that reflects the characteristics and level of quality that will satisfy the government’s needs.

To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must-

• Meet the salient physical, functional, or performance characteristic specified in this solicitation;

• Clearly identify the item by-

(1) Brand name, if any; and

(2) Make or model number;

Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer;

and

Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.

The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.

SECTION M – EVALUATION FACTORS FOR AWARD

Basis for Award The Government intends to award one (1) purchase order to the responsible Quoter whose quote conforms to the RFQ, will be most advantageous to the Government, price and other non-price factors considered, such that it provides the best value to the Government. Best value is defined as the procurement process that results in the most advantageous acquisition decision for the Government that is performed through an integrated assessment and trade-off analysis between price and non-price factors.

The Government reserves the right to reject any or all Quotes if such action is in the public interest. Under a best value procurement, the NTSB may reasonably determine that the superior capability merits a higher price. The NTSB may also reasonably determine that the Quoter with other than the highest capability in non-price factors is the best value.

The Government may waive informalities and minor irregularities in Quotes. The Government reserves the right to award without discussions. Quoters are cautioned that they must submit a best quote with the initial quote.

Evaluation Process The following factors will be evaluated by the Government:

QUOTATION PART # FACTORS TITLE

I Technical Approach 1 Technical Approach II Price Quote 2 Price

The NTSB will evaluate the above factors for each quoter as well as conduct a comparative evaluation of quotes in accordance with FAR 13.106-2 Evaluation of quotations or offers to determine the Quoter that represents the best value to the NTSB.

Technical Approach is significantly more important than Price. Price will be evaluated by adding together the price of all items in Table #1-5. In order to be eligible for award, pricing quoted must be determined to be fair and reasonable.
