About this file

This is a Sole Source Justification document under simplified procedures for a commercial items acquisition by the Department of Veterans Affairs (VA), Network Contracting Office 17, in support of the North Texas Veterans Health Care System (NTVHCS) at Dallas VAMC.

The procurement is for a brand name only ScriptPro robotic prescription medication management dispensing system to support the Outpatient Satellite Pharmacy in the Emergency Department at Dallas VAMC (4500 South Lancaster Road, Dallas, TX 75216). The requirement includes a fully integrated system comprising the robotic prescription medication dispensing system, ergonomically designed workstations, enterprise workflow management platform and software, custom fixtures tailored to the pharmacy layout, and support services including installation, training, and ongoing technical support. The system is essential to accommodate the expanded Emergency Department service, reduce wait times, improve accuracy, and support VA pharmacy standards compliance. The procurement will be awarded as a new firm-fixed-price contract with a twelve-month base period of performance.

Competition is restricted under RFO 12.102(b) based on the determination that only one responsible source exists. ScriptPro USA Inc. is the sole proprietor and Original Equipment Manufacturer (OEM) of the ScriptPro system, and Veterans Healthcare Supply Solutions (VHSS), a Service Disabled Veteran-Owned Small Business (SDVOSB), is the only authorized reseller. The justification establishes that the ScriptPro system is the only product compatible with the existing prescription dispensing systems currently in use at Dallas VAMC Pharmacy, Fort Worth Outpatient Clinic Pharmacy, Sam Rayburn Memorial Veterans Center (Bonham), and Tyler Outpatient Clinic Pharmacy. Extensive market research conducted from November 2025 through February 2026 across multiple databases (SBA DSBS, GSA Schedule, VA SCMC, NAC CCST, DLA ECAT, FPDS, SAM, UNICOR, and AbilityOne) identified no alternative vendors capable of meeting the full requirement. The contracting officer and one level above certification indicate approval for this sole source procurement, with the anticipated cost determined to be fair and reasonable through comparison to GSA pricelists and previously priced contracts for similar equipment and services.

BRAND NAME ONLY JUSTIFICATION

Acquisition Plan Action ID: 36C257-26-AP-1704

JOFOC: FY26 - NCO 17 – 618

1. Contracting Activity: Department of Veterans Affairs (VA), Network Contracting Office 17, located at 5441 Babcock Rd, Suite 302 San Antonio, TX 78240, in support of Veterans Integrated Services Network (VISN) 17, North Texas Veterans Health Care System (NTVHCS) located at 4500 South Lancaster Road, Dallas, TX 75216.

2. Nature and/or Description of the Action Being Processed:

This procurement is for a brand name only ScriptPro robotic prescription medication management dispensing system to support the Outpatient Satellite Pharmacy in the Emergency Department. With the upcoming expansion of the Emergency Department at Dallas Veteran Affairs Medical Center (VAMC) (4500 S Lancaster Rd, Dallas, TX 75216), there is a critical need for additional equipment to support the Outpatient Satellite Pharmacy. The Dallas VAMC Outpatient Satellite Pharmacy will require a fully integrated prescription medication dispensing system which includes a robotic prescription medication dispensing system, workstations, workflow management software, custom fixtures, and support services to manage the current workload and anticipated future increases, while enhancing patient safety, improving workflow, and supporting high-quality care delivery. This equipment is essential to accommodate the expanded service and ensure timely access to medications.

This action is being processed in accordance with Revolutionary FAR (Federal Acquisition Regulation) Overhaul (RFO) Part 12 – Acquisition of Commercial Products and Commercial Services, specifically RFO 12.102(b) – Restricting Competition and RFO 12.201-1 – Simplified Procedures, which allows for streamlined acquisition of commercial items while still requiring justification as described in RFO 6.104. The procurement will be awarded as a new firm-fixed-price contract with a twelve-month base period of performance.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: This procurement is for the acquisition and installation of a fully integrated ScriptPro robotic prescription medication management dispensing system at the Outpatient Satellite Pharmacy, Emergency Department, Dallas VAMC, which includes:

• Robotic Prescription Medication Dispensing System: Automates the selection, labeling, and dispensing of medications.

• Workstations: Ergonomically designed for pharmacy staff to efficiently manage prescriptions.

• Enterprise Workflow Management Platform and Software: Provides end-to-end visibility and control over pharmacy operations.

• Custom Fixtures: Ability to be tailored to fit the physical layout and workflow needs of the satellite pharmacy.

• Support Services: Includes installation, training, and ongoing technical support to ensure system reliability and staff proficiency.

This integrated system is expected to significantly reduce wait times, improve accuracy, and support compliance with VA pharmacy standards.

Total estimated cost is

4. Statutory Authority Permitting Restricted Competition:

RFO 12.201-1, Simplified Procedures. The statutory authority for applying the simplified procedures for commercial products and commercial service of FAR 12.201-1 is 41 U.S.C. § 1901 and is implemented by FAR 12.102(b) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Brand Name Only)

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The ScriptPro system is the prescription medication management dispensing system currently in use at Dallas VAMC Pharmacy, Fort Worth Outpatient Clinic Pharmacy, Sam Rayburn Memorial Veterans Center (Bonham), and Tyler Outpatient Clinic Pharmacy. The prescription medication management dispensing system and associated equipment and software being requested must be compatible in all aspects, form, fit, and function with the prescription dispensing system currently owned and in use at NTVAHCS. Procuring from a different vendor or use of a different brand prescription medication management dispensing system will not be compatible with the already owned/purchased and utilized equipment at NTVAHCS.

The ScriptPro system is the only product that can build upon the VA’s existing ScriptPro-based pharmacy management system. No other software and equipment is interoperable or compatible with the currently fielded ScriptPro system, as it communicates through proprietary source code unique to ScriptPro USA Inc.

ScriptPro USA Inc. is the sole proprietor of the robotic prescription medication dispensing system and software, and Veterans Healthcare Supply Solutions (VHSS), a Service Disabled Veteran-Owned Small Business (SDVOSB), is the only authorized reseller. Limited competition is therefore viable only between these two sources.

ScriptPro USA Inc.’s system is unique because it provides:

• Ability to build upon the VA’s existing ScriptPro-based pharmacy management system.

• End-to-end medication dispensing and workflow automation tailored for VA pharmacy operations.

• Integrated hardware and software ecosystem, ensuring seamless communication between dispensing units and ancillary devices.

• Compliance with VA security, reporting, and operational standards, reducing risk and improving efficiency.

• Required characteristics per the SOW—such as integrated barcode scanning, automated prescription verification, and compatibility with ScriptPro USA Inc.’s workflow automation.

These capabilities are essential to meet the technical and operational requirements outlined in the SOW.

Acquiring equipment from a different manufacturer would negatively impact patient safety and pharmacy performance metrics and would ultimately result in:

• Disruption to medication dispensing workflows, leading to delays in patient care.

• Increased risk of medication errors due to manual processes or incompatible systems, leading to patient safety issues.

• Operational inefficiencies, including longer turnaround times and increased staff workload.

The equipment being requested is fully compatible with the existing systems, which has an expected life span of 25 years. Alternate equipment would not be compatible with or integrate effectively into the established NTVHCS infrastructure and would require replacement of the entire medication dispensing system. Replacing the entire ScriptPro system with an alternative brand would require:

• Full removal of existing equipment.

• Purchase and installation of a new system, including hardware, software, and integration services.

• Estimated costs would be significantly higher than the current procurement due to entire system replacement, staff retraining, and extended downtime during transition.

ScriptPro USA Inc. is the sole proprietor and Original Equipment Manufacturer (OEM) of the ScriptPro system equipment and software. Based on market research, it was determined that limited competition is viable only among the OEM and one authorized reseller for this brand-name item, as this particular brand name product is essential to the Government’s requirements. Market research indicates similar products lack the particular needs of the Government. This constitutes a brand-name justification in support of RFO 11.204, Items Peculiar to One Manufacturer.

Based on the results of the market research, this requirement can only be satisfied by ScriptPro USA Inc.’s brand of equipment and software. Accordingly, ScriptPro USA Inc., and it’s authorized SDVOSB distributor VHSS, are the only firms capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: To ensure that offers were solicited from as many potential sources as practicable, market research was conducted from November 2025 through February 2026, using multiple resources. This research included searches of Small Business Administration’s Dynamic Small Business Search (SBA DSBS), the General Services Administration (GSA) Schedule, the Veterans Affairs (VA) Supply Chain Master Catalog (SCMC), the National Acquisition Center (NAC) Contract Catalog Search Tool (CCST), the Defense Logistics Agency (DLA) Electronic Catalog (ECAT), the Federal Procurement Data System (FPDS), the System for Award Management (SAM), Federal Prison Industries (UNICOR), and AbilityOne, as well as direct contact with the OEM, ScriptPro USA Inc. and its authorized distributor, VHSS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: This requirement is for a brand-name product, and market research identified only two capable sources: the OEM, ScriptPro USA Inc. and its authorized distributor, VHSS. The anticipated cost of the purchase order is expected to be fair and reasonable and will be determined through competition, comparing pricing to current GSA pricelists where prices are already determined fair and reasonable for the same and similar equipment and services, and by comparing to previously priced contracts for the same and similar equipment and services.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted pursuant to FAR Part 10 and VAAR Part 810 from November 2025 through February 2026, using multiple resources. This research included searches of Small Business Administration’s Dynamic Small Business Search (SBA DSBS), the General Services Administration (GSA) Schedule, the Veterans Affairs (VA) Supply Chain Master Catalog (SCMC), the National Acquisition Center (NAC) Contract Catalog Search Tool (CCST), the Defense Logistics Agency (DLA) Electronic Catalog (ECAT), the Federal Procurement Data System (FPDS), the System for Award Management (SAM), Federal Prison Industries (UNICOR), and AbilityOne, as well as direct contact with the OEM, ScriptPro USA Inc. and its authorized distributor, VHSS. The following market research efforts summarize the steps taken to identify capable sources that could fulfill the requirements of this procurement:

• Direct Vendor Outreach: The OEM, ScriptPro USA Inc., a small business under NAICS 339112, was contacted on January 15, 2026. The OEM stated that it utilizes an authorized SDVOSB distributor, VHSS, for the distribution and management of ScriptPro USA Inc. products. This authorization includes initial equipment orders, installation, workflow management software, and support services provided at the time of original purchase. The OEM further advised that the authorized SDVOSB distributor may not be used for support renewals or for orders that include upgrades to an existing ScriptPro system, such as a Microsoft Windows 11 upgrade. Additionally, a Sole Source letter dated January 2, 2026, states that ScriptPro USA Inc. is the only source capable of providing support renewals, equipment relocations, maintenance, updates, modifications, and system upgrades for existing ScriptPro USA Inc. systems.

The authorized distributor VHSS, an SDVOSB, was contacted on January 26, 2026, to confirm its capability to fulfill the requirement. VHSS confirmed that it is authorized by the OEM and capable of fulfilling requirements related to initial procurement, installation, and associated services permitted by ScriptPro USA Inc.

• SBA DSBS: A search under NAICS 339112 returned 14 small businesses, including two SDVOSBs/VOSBs and one WOSB. However, when the keywords “medication” and “dispensing system” were applied, the search returned no results.

• GSA database was searched using the keywords “ScriptPro” and “Robotic Prescription Dispensing System”. This search identified contract number 36F79719D0135 with ScriptPro USA Inc. While some of the required equipment is available under this contract, it does not include all items necessary to meet the full requirement.

• VA SCMC was searched using the keyword “Robotic Prescription Dispensing System”, which also identified contract number 36F79719D0135 with ScriptPro USA Inc. Similar to the GSA results, some required equipment is available, however, the contract does not include all items necessary to satisfy the complete requirement.

• NAC CCST was searched using the keywords “Robotic Prescription Dispensing System”, which produced no results. A subsequent search using the keyword “ScriptPro” identified contract number 36F79719D0135 with ScriptPro USA Inc. As with the GSA and SCMC results, the contract includes some, but not all, items required to meet the full requirement.

• ECAT was searched using the keywords “ScriptPro” and “Robotic Prescription Dispensing System”.

This search identified contract number SPE2D124DA006 with ScriptPro USA Inc., however, the required equipment and services are not available under this contract.

• FPDS was searched using the keywords “ScriptPro” and “Robotic Prescription Dispensing System”, which identified two vendors, ScriptPro USA Inc. and VHSS.

• UNICOR was searched using the keyword “Robotic Prescription Dispensing System”. This search returned no results.

• AbilityOne was searched using the keyword “Robotic Prescription Dispensing System”. This search returned no results.

• SAM was searched using the keyword “Robotic Prescription Dispensing System”. This search returned no results.

• Requiring Service Technical Review: While alternative products may exist, they do not meet the service’s requirements for full interoperability with the ScriptPro’s platform currently in use.

Substituting these items would compromise system integration, increase risk of medication errors, and disrupt pharmacy workflows.

The Buy American Act applies to this procurement. The majority of system components are manufactured in the U.S.; however, the below items are not produced domestically. These items are exempt from the Buy American Statute as they meet the definition of Information and Communication Technology (ITC) per RFO Part 2.101 and RFO 25.103(e).

• Zebra ZD621-2P Printer – China

• Electronic Signature Device – China

• SP Datapoint Monitor Add-on – China

• Rx Paperwork Printer Barcode Card – China

• Smart Card Scanner – Mexico

9. The ancillary components listed above (printers, signature pads, monitors, barcode cards, and smart card scanners) are provided by ScriptPro as part of a comprehensive, integrated package designed to work seamlessly with its automated dispensing system. Any Other Facts Supporting the Use of Other than Full and Open Competition: Per the ScriptPro USA Inc.’s sole source letter dated January 2, 2026, ScriptPro equipment and software is proprietary and may only be purchased through ScriptPro or from its authorized distributor, VHSS. ScriptPro is the sole source service provider of the ScriptPro Customer Technical Support Plan. ScriptPro supports the product direct throughout the United States under the Customer Technical Support Plan. ScriptPro also sells the Customer Technical Support Plan through VHSS if purchased with new Equipment orders.

As the OEM, ScriptPro is the only source for maintenance/updates, or modifications and upgrades to ScriptPro system(s).
