PERFORMANCE WORK STATEMENT (PWS)
800 sqft, 2,000 sqft, 4,000 sqft and 7,500 sqft ≥ Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation/Generators NTC Rotation 25-07
Part 1
General Information
1. GENERAL:
This is a non-personnel services contract to provide five (5) 800 sqft, one (1) 4,000 sqft and four (4) 7,500 sqft ≥ Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation/Generators. One (1) 20-ton Generator and one (1) 25-ton generator. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Introduction: The Contractor shall deliver the specified quantities of 800 sqft, 2,000 sqft, 4,000 sqft and 7,500 sqft ≥ Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation/Generators for the dates required. All additional components must be operational in accordance with the manual. The Government reserves the right to extend or curtail the lease/rental for each 800 sqft, 2,000 sqft, 4,000 sqft and 7,500 sqft ≥ Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation/Generators and the Contracting Officer will notify the Contractor within 24 hours if such a requirement is needed.
1.2 Background: Fort Irwin & the National Training Center is a world class training center for America's Military, known for its excellent desert training, vast recreational opportunities, and history. The mission of the NTC is to provide tough, realistic, joint and combined arms training in multi-national venues across the full spectrum of conflict set in a contemporary operating environment to assist Commanders in developing trained, competent leaders and Soldiers by presenting them with current problem sets to improve the force and prepare for success in the Global War on Terrorism and future joint battlefields.
1.3 Scope: Each tent will include full sidewall panels, lighting, 120v GFCI protect receptacles, Astroturf flooring, fire extinguishers, and power generation sufficient to power the lights and HVAC system. Lighting fixtures shall be of adequate size and light disbursement as to operate an office facility inside the tent. GENERATORS MUST BE PROPERLY GROUNDED WITH GROUNDING ROD. Primary and backup generators shall be capable of using Diesel fuel. Each generator will have a minimum run time of 18 hours, under full load, with one (1ea) full tank of fuel. The primary generator shall be sized to supply the required 120 volt, AC power, to each structure, 24 hours a day, and 7 days per week for the duration of the contract. The backup generator shall be equal or greater in size and capability to the primary generator. The backup generator shall be used in the event of primary generator failure.
1.4 On Post Access: Contractor and all associated sub-contractor's employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

1.5 Period of Performance: NTC Rotation 25-07
The period of performance will be from: 8 APR 25 to: 27 MAY 25.
The Government also reserves the right to increase or decrease the Period of Performance (POP) dates due to mission requirements. In the event changes occur, the Contracting Officer (KO) will notify the Contractor within 24 hours to make adjustments accordingly. The Government will not be charged for decreasing quantities or POPs due to mission changes. Any changes will be prorated at the calculated daily amount to adjust for increasing or decreasing requirements.
1.6 General Information
Quality Control: The contractor shall maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services.
The contractor’s quality control program is the means by which he/she assures themselves that their work complies with the requirement of the contract.
1.6.1 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. Each location will contain a COR (Contracting Officer Representative) who will evaluate and inspect the quality of each item under their direct control.
1.6.2 Recognized Holidays: The contractor shall be required to perform services on holidays.

1.6.3 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0900hrs – 1700hrs. Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.4 Place of Performance: The work to be performed under this contract will be performed at Ft. Irwin, CA and the National Training Center (NTC).
1.6.5 Type of Contract: The government will award a Firm-Fixed Price contract.
1.6.6 Security Requirements: Contractor personnel performing work under this contract will need to have access to the National Training Center at the time of delivery/services.
1.6.7 AT Level I training. All contractor employees, to include subcontractor employees, requiring access Army installations, facilities and controlled access areas shall complete Level I AT Awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 5 calendar days after completion of training by all employees and subcontractor personnel. Training will be conducted annually thereafter, if applicable. AT Level I awareness training is available at the following website: http://jko.jten.mil.
1.6.8 For contractors that do not require CAC,but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.6.9 Per AR 530-1 Operations Security, contract employees must complete the initial OPSEC Level I Awareness training and annually thereafter. OPSEC training is available at: https://securityawareness.usalearning.gov/opsec/index.htm
1.6.9.1 PHYSICAL Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use.
1.6.10 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5.
The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.
Appropriate action shall be taken to resolve outstanding issues. Minutes shall be taken by the contractor These meetings shall be at no additional cost to the government.
1.5.8 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions:
assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract:
issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.5.9 Key Personnel: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 0700 hrs – 2000 hrs, Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.
1.5.10 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
1.5.11 Contractor Travel: Contractor will be required to travel throughout Fort Irwin, CA during the performance of this contract to load and unload equipment. The contractor is not required to travel to off-site locations.
Part 2 DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations.
This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor.
The Government does not have privity of contract with the subcontractor.
2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.12. WORK WEEK. Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:

Part 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1. General: Everything included in this paragraph and its subparagraphs is basic to the contract and should be included in the overhead of the Contractor.
4.1.1. The Contractor shall provide all labor, supervision, transportation, vehicles, supplies, equipment, materials, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS
4.2. Materials. The Contractor shall provide materials to meet the performance of this contract such as but not limited to: repair parts, fluids for generators(s) (oil/grease), and batteries.
4.3. Equipment. The Contractor shall provide equipment to meet the performance of this contract.
4.4. Responsibilities of the Contractor.
4.4.1. The Contractor shall provide a safe working environment for key consultants and all persons in his/her employ as prescribed by 29 CFR 1910 “Occupational Health and Safety”. The Contractor shall be responsible for all damages to persons and property that occur in connection with the work and service under this contract, without recourse again the government.
4.4.2. Contractor shall exercise extreme caution to protect building finishes, private property military property, etc., from damage during the performance of these contract requirements. Contractor shall be responsible for all loss or damage or whatever kind and nature to all government property, while in the performance of these contract requirements, which results in whole or in part from the negligence or missions of contractor, any of his subcontractors or any employee, agent or any representative of the contractor or subcontractor(s).
4.4.3. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, 50 State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor agrees to comply with federal, state, and local public health regulations and also will comply with DoD and Army Public Health Regulations and guidance.
Part 5
SPECIFIC TASKS
5. Specific Tasks:
5.1. General: The contractor shall ensure all equipment is delivered with all necessary parts in accordance with (IAW) the operators’ manual and deliver the equipment with a full tank of fuel (diesel operated). The Government will not be responsible for returning equipment with a full tank of gas or paying to refuel the equipment at the end of the Period of Performance.
5.2. Tent Requirement: All structure shall be Clear Span type or equivalent, which provide occupants a weatherproof environment. Structures must possess, at a minimum, a 70mph wind load rating, in accordance with International Building Code.
Each structure will be configured to provide two sealable doors, one at each end. The side walls must be properly secured along the full length of the bottom edge, in contact with the ground. All heat/cool ventilation ducting shall be installed through a penetration sidewall, which will have a collar to secure the ducting for proper insulation.
5.2.1 Generator Requirement: All generators shall accept Ultra Low Sulfur Diesel as a fuel source, with all necessary parts in accordance with the operator’s manual, and a full tank of fuel. All electrical connections are to be made in the structures’ interior, where possible. Power cables are to be buried, as needed, under roads, access ways or as designated by the Contracting Officer Representative. Electrical generation and all electrical components shall meet applicable requirements of the National Electrical Code (NEC) for temporary out of doors, wet and windy locations. All electrical power generation and any distribution equipment systems shall be grounded according to NEC requirements. To reduce downtime and outages, twist lock connections are required of all 120v AC electrical wiring and components.
5.2.2. HVAC Requirement: Each heating ventilation and air conditioning unit shall be sized to be able to maintain 65-80 degrees Fahrenheit temperature, in each structure.
All HVAC shall be safe for utilization in living and office areas. All HVAC shall be delivered with necessary parts and equipment, and a full tank of fuel.
5.2.3. Lighting Requirement: All lights will be sufficient to light the entire tent structure.
5.2.4. Cots: Cots will be 75-80 inches long, 25-30 inches wide, and 16-20 inches high.
Cots must be able to hold up to 300 pounds. 260 cots will be provided by the contractor in clean, good working order with no deficiencies.
5.2.5. The Equipment: Shall be able to operate in the high desert terrain of Ft. Irwin and be able to withstand wind gusts up to 70mph in locations throughout the training area.
Each piece of equipment shall have a minimum of one (1) 5lb fire extinguisher. The equipment shall operate on Ultra Low Sulfur Diesel (ULSD), as a fuel source. The Contractor shall label all equipment near the fuel tank with the wording “Diesel Fuel
Only”. Failure to label accordingly will invalidate contractor claims regarding use of incorrect fuel.
5.2.6. Regulatory Markings: All vendors looking to conduct business with the Government by leasing or renting vehicles and equipment to the Government ensure those vehicles have been reported to the California Air Resources Board (CARB) by providing the installation contracting agency, MICC or the KO, with a copy of the report or other valid documentation showing that the vehicles and equipment being leased or rented to the Government have in fact been reported to CARB.
5.2.7. Equipment Condition: Each item of equipment or property furnished under this contract shall be in safe operational condition and shall comply with the Federal Safety Standards, the American National Standards and State Safety Regulations applicable to this equipment or property. The equipment shall also have its’ service logs and calibration test to indicate it has passed inspection. If the Contracting Officer or their representative determines that any item of equipment or property furnished is not suitable for performance under this contract, the Contracting Officer shall promptly inform the contractor in writing.
5.2.8. Quantity: The Government reserves the right to vary quantities by +/- 30% due to operational requirements and to make multiple awards to meet said requirements. The Government also reserves the right to increase or decrease the POP dates due to mission requirements. In the event changes occur, the Contracting Officer (KO) will notify the Contractor within 24 hours to make adjustments accordingly. The Government shall not be charged for decreasing quantities or POPs due to mission changes. Any changes shall be prorated at the calculated daily amount to adjust for increasing or decreasing requirements.
5.2.9. The contractor shall provide familiarization training on the delivered equipment.
Soldiers to be trained will be licensed operators of similar equipment, but not necessarily the same equipment.
5.2.10. Delivery Instructions: All equipment shall be OPERATIONAL at the specified Ft. Irwin locations no later than 1000PST on the first day of the POP.
Equipment must be delivered on 9 April 2025 in order to ensure tents are operational on the first day of the POP. Delivery of equipment must be coordinated with the COR prior to delivery to confirm delivery times and location. The Contractor shall allow adequate time for a joint visual inspection. All set up must be complete and equipment ready for use at time of delivery.
NOTE: Increased installation security may delay Contractors’ delivery time. It is the Contractors’ responsibility to plan and prepare prior to the beginning of the POP to gain access to the post.
5.2.9.1. Pre-Inspection Requirements: The Contractor shall coordinate with the COR to assure all delivery confirmations prior to arrival. At time of delivery, the Contractor shall complete a joint pre-inspection with the COR verifying that items delivered are in the correct location and are operational in accordance with the contract requirements.
Contractor must be present until these joint inspections are complete.
5.2.9.2. Post-Inspections Requirements: The Contractor shall complete a joint post-inspection with the COR verifying that items have been returned in as-delivered condition with only normal wear and tear. The Government will not be responsible for returning the equipment with full fuel tanks or paying to refuel the equipment at the end of the POP.
5.2.9.3. POP or Quantity Change Inspections: In the event that the Contractor is not available for a joint inspection within 24 hours of being notified of a decrease change to the POP, the Government will conduct its inspection unilaterally and submit the inspection to the contractor as evidence that the Government’s POP is complete. The contractor shall adjust the invoice in accordance with the adjusted POP.
5.2.9.4. Inspection Sheets: All pre and post-inspection/acceptance sheets must be provided to the KO and COR after joint completion by the COR and Contractor.
Inspection sheets must be signed and dated. Both parties’ names must be printed legibly and signed. Pre & Post-Inspection Sheets shall be hard copies only and not by Portable Electronic Device or Portable Hand Held Device. The COR is not authorized to sign any electronic device that the vendor uses.
5.2.10. Emergency Services: The Contractor shall be available by phone to provide 24 hour emergency repair and/or replacement services for the leased equipment, including all weekends and holidays, at the Contractor’s expense. The Contractor shall provide emergency services upon notification from the KO and have repaired or replaced the equipment within four (4) hours. All repairs, replacement, delivery and pick-up costs not due to Government negligence shall be at no additional cost to the Government.
Repairs shall be on-site at the equipment’s location. All backup units utilized in the event of primary failure shall be at no additional cost to the Government.
5.2.10.1. 800 sqft, 4,000 sqft and 7,500 sqft ≥ Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation/Generators Service Package will include: The Contractor shall respond to all maintenance calls within four (4) hours and repair or replace the equipment within 12 hours. All repairs or replacements for the leased equipment not completed within 12 hours will not be charged to the U.S. Government. All equipment shall operate on Ultra Low Sulfur Diesel fuel and be capable of operating in rough terrain. All repairs and replacement costs are included in the price. Delivery/pick-up costs are included in the price.
5.2.10 Removal of Equipment: The Contractor shall coordinate with the COR for removal of equipment at the end of the POP. The Contractor shall remove all contracted/leased equipment from the installation within 48 hours after the POP.
Should equipment remain in place beyond 48 hours, the Government is not liable for returning the equipment refueled, usage, theft, loss, damage or replacement costs due to the Contractor's negligence to take possession of owned items. If for any reason the Contractor is unable to pick-up equipment, notify the KO in writing 24 hours prior to scheduled pick-up date.
5.2.10.1. Contractor’s Representatives or Supervisors Contractor shall have a company representative on call to respond to maintenance requests with full telephone coverage and authority to make decisions on behalf of the company on a 24 hour basis. The time for a required maintenance call starts when the Government calls the company representative. The Contractor shall have functioning voicemail. Lack of receiving capabilities by the Contractor does not relieve the Contractor of liability for the required service call timeframe to repair or replace equipment. Claims: If a claim is submitted, it will require the joint inspection pre-and post- inspection/acceptance sheets to accompany the claim form. Both must be provided to the Contracting Officer at the time of claim submission. The pre-and post- inspection/acceptance sheets must only be signed by the authorized receiving representative that is indicated in the contract. Inspection/acceptance sheets must be signed and dated. Both parties’ names must be printed legible and signed.
5.2.10.2. Foreign Objects: During rotations, there are occasional incidences of foreign objects being left in the tents. The contractor shall inspect tents to ensure that cans, bottles, rags, cloth or any foreign objects are not in the tents upon retrieval. The contractor shall provide documentation with photos to the KO and COR of the tents that foreign objects were found in. CAUTION: If any type of ordinance is discovered, the contractor shall stop work immediately and notify the emergency ordinance disposal squad at 760-380-4092 and or Range Operations at 760-380-3878. (24 hours a day.)
5.2.10.3. If a claim is submitted without the pre-and post-inspection/acceptance sheets, the claim is subject to be denied. The Contractor must submit their claim invoice in the following format:

Equipment Identification Numbers (EIN) labels will be:
- Color: The color of the EIN label is dependent on the type of fleet. Most EIN labels must be white on a red background.

CARB Regulations -Truck and Bus Engine:
- All mobile diesel trucks and buses must comply with the California’s Gross Vehicle Weight Rating (GVWR) for date of engine.
- Emission Control Labels must be affixed to engines of all commercial heavy-duty diesel vehicles, and must be legible as proof the engine, at minimum, meets U.S.

Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate.
All vendors looking to conduct business with the Government by leasing or renting vehicles and equipment to the Government will ensure those vehicles have been reported to the California Air Resources Board (CARB) by providing the installation contracting agency, MICC, with a copy of the report or other valid documentation showing that the vehicles and equipment being leased or rented to the Government have in fact been reported to CARB. In addition, the vendor shall show proof that each vehicle and/or piece of equipment to be leased or rented to the Government is compliance regulation(s) that is applicable to the vehicle or equipment:
1. CCR Title 13, Section 2477, Airborne Toxic Control Measure for In-Use Diesel- Fueled Transportation Refrigeration Units (TRU) and TRU Generator Sets, and Facilities Where TRUs Operate.
2. CCR Title 13, Section 2449, General Requirements for In-Use Off-Road Diesel- Fueled Fleets.
3. CCR Title 13, Section 2025, Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen and Other Criteria Pollutants, from In-Use Heavy-Duty Diesel-Fueled Vehicles.
4. CCR Title 13, Section 2275, Large Spark-Ignition (LSI) Engine Fleet Requirements.
5. CCR Title 17, Section 93116, Airborne Toxic Control Measure for Diesel Particulate Matter from Portable Engines Rated at 50 Horsepower and Greater.
Equipment applicable to these regulations, but not in compliance with these regulations, shall not be leased to the Government under any circumstances.
Upon inspections of equipment(s) and if found to be non-compliance, contract will be modified or terminated at the convenience of the Government.
The contractor label their equipment near the fuel tank with the wording “Diesel Fuel Only”.
TECHNICAL EXHIBIT 5
RANGE CLEARANCE & ROAD CLOSURES
A. UNFORESEEN POST/RANGE CLOSURES
1. When an unforeseen post closure occurs on a regular scheduled day of work, the contractor will not be required to perform the work scheduled for that day. Services shall be performed upon access to previously closed areas being granted. Failure to perform services could result in health and safety issues.
B. RANGE CLEARANCE & ROAD CLOSURES.
1. The Contractor shall obtain a Range Pass from Range Support and ensure Range Support is contacted before entering any range area. In addition, during Live-Fire Week, Contractor shall ensure employees contact the Live Fire Operations Non- Commissioned Officer in Charge. See NTC Maneuver Plan for details.
Communication with range control is the responsibility of the Contractor as the Government will not provide communication devices/radios to the contractor.
C. THE CONTRACTOR WILL NOT ENTER RESTRICTED OR OFF LIMIT AREAS.
D. INITIAL DELIVERY AND RELOCATION OF UNITS.
1. The contractor shall coordinate with the Contracting Officer's Representative (COR) at each site to assure placement at correct locations.
2. The contractor shall remove the Tents with HVAC, Lights, Floor, Electrical Outlets and Power Generation and Generators from training locations 48hrs after performance period has ended.
E. CONTRACTING OFFICER'S REPRESENTATIVE AND THEIR AUTHORITY.
1. The Contracting Officer may designate individual(s) to act as the Contracting Officer's Representative(s) (COR) under this contract. Such designations will be made by letter from the Contracting Officer with an information copy furnished the Contractor.
2. COR do not have the authority to take any action directly or indirectly that changes pricing, quantity, quality, place of performance delivery schedule or any other terms or conditions of the basic contract.
NTC Maneuver Area Control Plan Clause
1. Purpose. The National Training Center (NTC) and Fort Irwin have established Maneuver Area Control Operational Procedures and Activities within the NTC Training Area to ensure training fidelity, safety and compliance with NTC and Army Regulations. The Maneuver Area Control Operational Procedures ensure that NTC has control over personnel entering and using the NTC maneuver area for tactical, training and support purposes.
2. Applicability. Maneuver area control procedures are applicable to all personnel (both military and civilian) who enter the training area in a non-tactical vehicle.
3. Responsibility. Organizations and activities requiring military, civilians or contractors access to the range complex are responsible for all approvals required by range regulations, SOPs and this directive. Sponsors will ensure that users understand the requirements and have the required equipment. Sponsors are the first source of Range Communications Systems (RCS) radios. IF RCS radios are not available, Range Support will issue an RCS for the duration of the requirement only.
4. Range Passes. Range Access passes will be issued only when the following criteria are met and only for the duration of the requirement:
(a) Valid driver’s license for type vehicle used.
(b) Valid range briefing and safety card.
(c) Possession of training area access handbook.
(d) Proof of need to go down range (contract number and period of performance (not the contract ), work order, etc.,
5. Range Safety Briefings and Range Cards. All users of the training area are required to have received the range safety briefing within the last year and must carry and present the range card on demand. Range cards are valid for the calendar year from 1 January to 31 December. Personnel who do not have a range safety card must be escorted in the maneuver area by a range safety card holder who accepts the responsibility for their control while down range.
6. NTC Vehicle Markings. All NTVs that enter the training area are required to have the required Physical Markings. Vehicles will be marked on the left and right door and the front with markings that are clearly legible from 100 feet and indicate the parent or sponsor of the vehicle. Markings can be permanent, magnetic or other type signs that are temporarily used. Range Support will also have generic vehicle ID signs for vehicle not having other required markings. Rotation markings (such as UN or IP) may be used in addition to the identifying signs.
7. Range Communications. Range communications downrange must be maintained in one of two ways. FM communication may be used on the Range control frequency (38.90). The Range Communications System (RCS) radio is the other permissible means. Cell phones are not permissible communications means unless specifically approved by the NTC Chief of Staff. NTVs will not be allowed into the training area without an operating RCS or an escort of a vehicle with an operational RCS.
8. Checkpoints. Checkpoints will serve as the entry control points to the maneuver area for all non- tactical vehicles (NTV) entry into the maneuver area. The checkpoints may not be bypassed by non- tactical vehicles. All NTVs will be physically checked for compliance (marking, range pass, range safety card, commo means) before admittance to the maneuver area. All checkpoints will be clearly marked with warning signs and access instructions. Common bypass routes will be clearly marked with instructions to use the nearest checkpoint.

9. Violators and Enforcement. Military personnel and range patrols are authorized to require violators to leave the maneuver area. Other personnel are encouraged to report violations to Range Support for action. The Range Control Officer will withdraw or suspend installation training area privileges upon determination that any person, organization or agency willfully violated this directive, local range regulations and procedures; or from any person whose ability or conduct is incompatible with the safe use of Government range facilities
