General Information

1.0 Background and Purpose: This is a non-personal services contract for road maintenance on the

Sitka Ranger District, Tongass National Forest. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.1 Outline of Services: The Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items necessary to provide the services outlined below and described in this Performance Work Statement

(PWS).

1.2 Project Location: The Sitka Ranger District is a part of the Tongass National Forest located in Southeast Alaska. This forest encompasses approximately 17 million acres spread out over the vast archipelago islands of Alaska’s panhandle. Tongass National Forest Engineering Roads Program which manages over 4,000 miles of logging access roads, many of which are located on remote islands. This program of work is tasked with developing and maintaining a network of low volume roads in support of commercial timber harvest and mining activities, along with providing access and safe use for the general public.

1.3 Background: The U.S. Forest Service is responsible for maintaining healthy, diverse, and productive National Forests. Part of these responsibilities include maintaining roads and the management of vegetation growth.

1.4 Period of Performance:

Base Items shall be: Award through 10/31/2023.

Option Items 1 may be: Award through 10/31/2023.

1.5 Government Regular Working Hours: The Government's regular working hours are from 0700 to 1700, five days per week, Monday through Friday, except observed Federal holidays. Exceptions to the regular hours of operation are detailed in subsequent sections of this PWS.

1.6 Federal Observed Holidays: The government observes the following holidays:

1.7 Service Interruptions: If any services must be interrupted (even temporarily) due to maintenance of contract work, the Contractor shall notify the CO, and COR at least three working days in advance. If the service is due to an emergency breakdown the Contractor shall notify the CO and COR as soon as practicable.

1.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to

Performance Work Statement (PWS) Page 2 of 8 attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation (FAR) Subpart

42.5. The CO and/or COR shall meet periodically with the contractor to review the contractor's performance.

1.9 Project Manager (PM): The Contractor shall provide a PM and designated alternate, as applicable, who has full authority to act for the Contractor on all contract matters relating to this contract. The PM or alternate shall be on-site during the Government's regular working hours and shall be available on-site within one hour after the Government's regular working hours.

1.10 Quality Assurance: The contractor shall comply with the quality assurance program as defined in the Performance Requirement Measures. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable quality level(s) (AQL). Government surveillance of contractor performance is not limited to the Performance Objectives as outlined in this PWS. The Government reserves the right to conduct compliance surveillance of any contractual requirement of this acquisition.

1.11 Contracting Officer’s Representative (COR): A COR may be assigned to this contract to monitor all technical aspects and assist in contract administration. The COR may be authorized to perform the following functions: Assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communication with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements (without increasing or decreasing contract scope), including Government drawings designs, and specifications; monitor Contractor's performance and notify both the CO and Contractor of deficiencies; and provide site entry of Contractor personnel. The COR is not authorized to change any of the terms and conditions of the contract or any task order.

Contractor Requirements

2.0 Technical Requirements / Tasks

2.1 General: Applicable Laws, Regulations, Specifications and Guidance

2.1.1 Standard Specifications for Construction of Roads and Bridges on Federal Highway

2.1.2 Attached are Special Project Specifications and Forest Service Supplemental Specifications (FSSS) to the FP-14 that shall be followed for performance of this Contract.

2.2 Contractor Furnished Equipment: All contractor furnished equipment and vehicles to be used at the job site shall be cleaned and free of invasive species (noxious weeds), seeds, external grease and oil and shall be inspected prior to entrance onto Federal lands. The restriction shall include equipment and vehicles intended for off-road use, whether they are owned, leased, or borrowed by the Contractor or Subcontractor.

2.2.1 Provide a list of all equipment to be used two (2) days prior to the start of performance of work under this contract.

2.2.2 All protective plating and armoring shall be intact and properly functioning on the equipment to reduce the potential for damaging hydraulic hoses or the undercarriage.

2.2.3 Spill kit approved by OSHA for petroleum product leaks shall be on site at all times.

2.3 Work Schedule: Contractor shall provide a work schedule to the COR and CO five (5) working days prior to commencement of work. The contractor shall notify the COR as soon as possible about any work schedule deviations.

2.4 Daily Activity Report: Contractor shall log road services performed during day-to-day performance on the Daily Activity Report. See Appendix 1 Daily Activity Report. Reports shall be submitted with invoice for payment.

2.5 Traffic Control Plan: Submit plan within 10 days of award. Plan should ensure the safety and convenience of the public and protects the residents and property adjacent to the project.

At a minimum address:

2.5.1 Accommodating public traffic on roads adjacent to and within the project until the project is accepted.

2.5.2 Warning signs shall be placed in accordance with the standards of the Manual on

Uniform Traffic Control Devises (MUTCD), current edition, while work is in progress.

This shall include “Slow Moving Equipment” signs attached to all road surface equipment.

2.5.3 After plan is accepted by the COR, warning signs shall be appropriately placed until after acceptance.

Contractor Required Tasks

2.6 TECHNICAL TASKS – All tasks to be performed shall be in compliance with the attached

Special Project Specifications and Forest Service Supplemental Specifications (FSSS) to the FP-14, and applicable laws, regulations, specifications and guidance referenced in section 2.1 of this PWS.

2.7.1 Mobilization: This work consists of moving personnel, equipment, material, and incidentals to the project and performing work necessary before beginning work at the project site. This work also includes obtaining permits, insurance, and bonds.

The Contractor is responsible for accounting for costs appropriately and for maintaining records, including supporting documentation, adequate to demonstrate that costs claimed have been incurred, are allocable to the contract, and comply with applicable cost principles in FAR subpart 31.2 and agency supplements. The contracting officer may disallow all or part of a claimed cost that is inadequately supported.

2.7.2 Road Grading, Compaction Method B (PBSC 811):

A. Contractor shall perform 6.1 miles of road grading services using method B, in accordance with (IAW) the FP-14 during grading window 1, date of award through 30 June 2023. Table 1 provides a consolidated listing of dates.

B. Contractor shall perform road grading services using method B, in accordance with (IAW) the FP-14 for District Office Parking Lot & Bunkhouse Dr. – Roads 7511, 75112 – 0.21 Miles, date of award through 30 June 2023. Table 1 provides a consolidated listing of dates.

2.7.3 Ditch Cleaning (PBSC 834):

A. Contractor shall perform 800 liner feet of ditch cleaning services in accordance with (IAW) the FP-14 for Starrigavan Campground. Completed ditches shall be a minimum of 3’ wide by 1’ deep. Approximately 60 cubic yards of material will be required to be removed. This material is generally located adjacent to fish stream. The COR will provide clarification if needed during performance.

i. 2.7.3.1 Load, Haul, Place Material (PBSC 832):

A. Contractor shall perform load, hauling and material placement service, IAW the

FP-14, utilizing 60 cubic yards of total material.

2.7.5 Roadside Brushing, Method A (PBSC 842):

A. Contractor shall perform 4.6 miles of roadside brushing utilizing method A, IAW the

FR-14, in the Harbor Mountains no later than 21 October 2023.

B. Road closures are not allowed on 14 July 2023.

A. Contractor shall perform 5.9 miles of road grading services using method B, in accordance with (IAW) the FP-14 during grading window 2, 01 September 2023 through 30 October 2023. The services are to be performed on roads 7513, 75132, 7515, 7576, 7581. Table 3 provides a consolidated listing of dates.

3.0 Deliverable / Schedule

3.1 The Contractor shall submit all deliverables for this PWS IAW within listed timelines outlined above. Below is a list of all deliverables outlining each objective and due date.

8.0 Definitions, Acronyms, and Applicable Publications

Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

Contracting Officer (CO): a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the contracting officer acting within the limits of their authority as delegated by the contracting officer. "Administrative contracting officer (ACO)" refers to a contracting officer who is administering contracts. "Termination contracting officer (TCO)" refers to a contracting officer who is settling terminated contracts. A single contracting officer may be responsible for duties in any or all of these areas. Reference in this regulation (48 CFR chapter 1) to administrative contracting officer or termination contracting officer does not-

• Require that a duty be performed at a particular office or activity; or

• Restrict in any way a contracting officer in the performance of any duty properly assigned.

Contracting Officer’s Representative (COR): means an individual, designated and authorized in writing by the contracting officer to perform specific technical or administrative functions.

Defective Service: A service output that does not meet the standard of performance associated with the Performance Work Statement.

Deliverable: Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

Equipment: A tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for the performance of a contract. Equipment is not intended for sale, and does not ordinarily lose its identity or become a component part of another article when put into use. Equipment does not include material, real property, special test equipment or special tooling.

Government Furnished Property: Property in the possession of, or directly acquired by, the Government and subsequently furnished to the contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes contractor-acquired property if the contractor-acquired property is a deliverable under a cost contract when accepted by the Government for continued use under the contract.

Non-Personal Services: The personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the government and its employees.

Non personal service contracts are authorized by the government in accordance with FAR 37.012, under general contracting authority, and do not require specific statutory authorization.

Quality Assurance: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

Quality Assurance Surveillance Plan: An organized document written by the government specifying the surveillance methodology used for surveillance of contractor

Workday: The number of hours per day the Contractor provides services in accordance with the contract.

Work Week: Monday through Friday, unless specified otherwise.
