PERFORMANCE WORK STATEMENT
(PWS) FOR
21 CIVIL ENGINEER REAL PROPERTY SUPPORT SERVICES
4 March 2021
1. DESCRIPTION OF SERVICES. Provide non-personal administrative support for real property actions to include: inventory building customers, assist with inventory actions, validate real property Key Supporting Documents (KSD), review DD Form 1354s Transfer and Acceptance of DoD Real Property for completeness, review real property instruments including in-grants and out-grants/assist with processing, assist in developing off base lease package documents, Major Land Acquisition Waiver (MLAW) packages, Economic Analysis inputs, develop instruments for entities without Civil Engineer real property instruments in place, resolve problems with hard copy real property folders, generate DD Form 1354s for assets left to process/still need to be capitalized, go through hard copy real property folders and ensure folder contents match what is on the ground, ensure real property folders match Automated Civil Engineer System – Real Property (ACES-RP), rectify KSD discrepancies, review host tenant support agreements and incorporate new real property language into the agreements.
The contractor will provide Assistance Services (AS) to 21 Civil Engineer Squadron (21 CES) in the execution of this program. The contractor shall perform to the standards established in the PWS.
1.1 The contractor shall provide a full range of Assistance Services (AS) and deliverables in support of 21 CES. Services and deliverables will support real property actions. The contractor will be located at Peterson Air Force Base (PAFB) as described in paragraphs 4.1 and 4.2 below. In the future, an increased level of these same or similar services may be required, which will likely require additional labor hours. The Government will negotiate increased level-of-effort separately at the time the need arises.
2. MISSION. The 21 CES mission is to develop resilient engineers, optimize sustainable installations, safeguard the Front Range community and provide premier customer service to support global space superiority. This task order supports this mission.
2.1 ORGANIZATION BEING SUPPORTED.

3. OVERVIEW OF SERVICES REQUIRED
3.1 PAFB: The services described in paragraph 5.0 below will be performed at PAFB.
The Government anticipates the need for approximately 5,520 work hours per year. Workload will consist of processing and coordinating the following packages: legal instrument templates (100 each), AF Form 123 (100 each), DD Form 1354 (1,000 each), AF Form 300 (20 each), Existence and Completion facility site visits ACES-RP record annotation/corrections and
GeoBase ArcMap hardcopy annotations/ corrections (3,000 each), Physical Inventory facility site visits ACES-RP work with facility managers, annotate space changes, customer changes, new or modified real property corrections/updates, Inventory Form and Picture Packages (600 each), Host Tenant Support Agreement (HTSA) reviews and language incorporation (80 each).
Contractor is required to be on-site at PAFB during normal operating hours 0730 – 1630. Work shall consist of 40-hour work weeks, Monday through Friday, excluding Federal holidays and down days (See paragraph 16 for further information). Although expected to be extremely rare, in some cases the Government may direct the Contractor to work non-standard duty hours;
these will be handled on a case by case basis as the need arises and may be subject to separate negotiation.
3.2 ORGANIZATIONAL CONFLICT OF INTEREST. This PWS will require contractors to provide documents that support real property actions. Due to the nature of this requirement, there is an Organizational Conflict of Interest (OCI) for future acquisitions that may occur. Contractors will not be allowed to work on future acquisitions in accordance with FAR 9.5. According to AFFARS 5352.209-9000(a)(2) Alternate II, the Contractor shall participate in the technical evaluation of other Contractor’s proposals or products. To ensure objectivity, the Contractor is precluded from award of any supply or service contract or subcontract for any requirement developed under this contract. This restriction shall be effective for two years after the contract ends. The Contractor shall comply with requirements IAW FAR 3.11, Preventing Personal Conflicts of Interest for Contractor Employees Performing Acquisition Functions.
3.3 QUALIFICATIONS/EDUCATION/CERTIFICATIONS.
3.3.1 Real Property personnel hired under section 5.0 shall have, at a minimum 3 years of experience as a Real Property Accountable Officer (RPAO). Relevant experience includes, but is not limited to: a knowledge of the DD Form 1354 Transfer and Acceptance capitalization process, training tradesman, technicians, civilian workers and assisting them to walk through and prepare DD Form 1354s, assist RPAOs with review, validation, transfer, acceptance of new or improved real property assets. Update ACES-RP and NexGen IT records to achieve OSD Financial Improvement Audit Readiness (FIAR) goals. Perform physical inventory requirements and inspect necessary components including verifying equipment, facility occupants, correct category codes, review facility folder, annotate floor plan changes, space allocations, Real Property Installed Equipment (RPIE), linear segmentation and ensure ACES- RP, NexGen IT and GeoBase records accurately reflect updates. Initiate and complete real property instrument in-grants and out-grants, prepare real property appraisals, economic analysis (business case analysis), military land acquisition moratorium waivers (MLAW), work with in-grant and out-grant proponents, US Army Corps of Engineers (USACE), AFCEC/CIT, AFIMSC/RMC Financial Management Center of Expertise and GSA. Ensure real property transactions are cost effective and withstand close scrutiny from legal challenges. Assist RPAOs in preparing AF Form 300 disposal packages, completing HUD and McKinney Act checklists. Review host tenant support agreements and incorporate new real property language into the agreements. Additionally, personnel shall have experience utilizing NexGen IT, ACES-RP and Microsoft Office applications.
4. REAL PROPERTY PROGRAM MANAGEMENT – The contractor shall:
4.1.1 Provide assistance surveying buildings and developing documentation to resolve real property action discrepancies. The contractor will conduct ACES-RP and NexGen IT data entry, data quality assurance & data quality control in support of 21 CES.
4.1.2 Work with customers to update the inventory of building customers and prepare documentation in support of real property actions. The contractor’s work load will vary each month but will be expected to complete an average of 5-10 real property actions per month.
Coordinate with other governmental personnel, as necessary, to define real property requirements, ensure compliance with Federal, State, local and Air Force regulations.
4.1.3 The contractor will follow all applicable laws, Department of Defense issuances and Air Force Instructions when capitalizing project work.
4.1.4 The Contactor will perform Real Property Accountability and Reporting for a building or structure in accordance with AFI 32-9005, as required.
4.1.5 The contractor will complete requirements in accordance with AFCEC Real Property playbooks.
5. ADDITIONAL DELIVERABLES. Contractor shall submit a Project Status Report (PSR) which will include a running list of all projects programmed and prepared for acquisition. Report shall include the date project was assigned and completed, or estimated completion date for ongoing projects. Reports shall be delivered to 21 CES on the first business day of the month. Contractor format is acceptable as long as it contains all required information.

7. GOVERNMENT FACILITIES AND SUPPLIES. Government shall provide three (3) workspaces in Building 1324 on Peterson AFB and temporary workspaces at CMAFS.
Workspace will include desk space, chairs, with access to the Non-classified Internet Protocol Router Network (NIPRNET), and use of telephones, copiers and scanners.
8. GOVERNMENT FURNISHED INFORMATION. Government personnel shall be available for technical exchanges with the contractor. Government personnel shall provide technical input, answer questions, review and accept completed work, assist in any stalled coordination efforts and provide feedback regarding contractor efforts.
9. PRODUCT OWNERSHIP. All products produced by the contractor in the performance of this PWS are the property of the Government.
10. PROPRIETARY DATA. The contractor shall request Government approval prior to the use of any proprietary data or software tools to fulfill the requirements of this contract.
11. The contractor shall not retain unclassified material generated or received under this contract after the contract ends without approval of the appropriate office of primary responsibility.
12. The Government has rights to all deliverables developed under this PWS (see data rights clauses in contract itself). The contractor shall not use any materials pertaining to this Task Order (TO) for business development or any other vendor strategic purposes. However, the contractor is authorized to include summary performance information in proposals to be submitted to the Government to satisfy past performance information requirements.
13. GENERAL INFORMATION. The Contractor shall observe Federal holidays and other associated down-days identified in this section. Down-days are typically observed in conjunction with major federal holidays totaling approximately 6 per year. The list of specific down days will be distributed when released by the Air Force each year. The Government observes the following days as holidays:

If these Federal Holidays fall on Saturday, the preceding Friday will be observed. If these Federal Holidays fall on Sunday, the following Monday will be observed.
In addition to the days designated as holidays, the Government may also observe the following days: Any day designated by Federal Statute; Executive Order; or President’s Proclamation Notwithstanding holidays and Government closures, the Contractor shall perform in accordance with the terms established in OASIS and this PWS.
14. SECURITY REQUIREMENTS. The contractor personnel will not require access to any classified documents or information; however, ability to obtain a Common Access Card is required as described in Clause 5352.242-9001 Common Access Cards (CACs) For Contractor Personnel.
15. TRAINING REQUIREMENTS.
15.1. Antiterrorism (AT) Standards. IAW Department of Defense Instruction (DoDI) 2000.16, DoD Antiterrorism (AT) Standards, paragraph E3.18.6, a contractor with employees performing work on a DoD installation will meet DoD AT Level I training requirements. The contractor shall submit certificates of completion to the COR and to the CO, within 30 calendar days after contract start date. All new employees who begin performance under this contract during the contract period of performance must submit certificates of completion within 30 calendar days of performance start date. 15.2. DoD Information Assurance Awareness (IAA) Cyber Awareness. IAW DoD 8570.01-M, Information Assurance (IA) Workforce Improvement Program, contractors with access to DoD Information Technology systems are required to receive and complete IA orientation awareness training before being granted access to these system(s) and annual IAA to retain access. All personnel must complete the DoD IAA Cyber Awareness Challenge training in Air Force MyLearning (https://lms.jets.cce.af.mil).
15.3. ACES-RP and NexGen IT. The contractor shall submit certificates of completion for ACES-RP and NexGen IT to the COR and to the CO, within 30 calendar days after contract start date. All new employees who begin performance under this contract during the contract period of performance must submit certificates of completion within 30 calendar days of performance start date. 15.4. On-the-Job Training (OJT). Training for other applicable systems (e.g. ACES-RP, NexGen IT, etc.) will be provided by the Government during normal working hours.
16. TRAVEL. The contractor will not be required to travel.
17. MATERIALS AND OTHER DIRECT COSTS (ODC). None.
18. NON-PERSONAL SERVICES. Contractor shall understand the prohibitions imposed on the U.S. Government regarding personal services contracts and will report instances where the Government attempts to control or supervise contractor’s employees to the Contracting Officer (CO) immediately. Contractor shall ensure its personnel do not perform inherently governmental activities. Contractor shall ensure its personnel do not attempt to represent the Government of the United States to any other person or entity, U.S., or foreign, except for delivering a Government-approved message or position.
19. BASE CLOSURE/GOVERNMENT MORALE AND RECREATIONAL
ACTIVITIES. Situations may arise where Government facilities may not be available for performance of requirements (i.e., base closure due to weather, force protection conditions, etc.). There may also be occasions when support contractors are invited to participate in morale and recreational activities (e.g., holiday parties, golf outings, sports day and other various social events). Under these circumstances, contractor employees shall comply with individual company policy in accordance with company compensation system. Because the Government does not have an employer/employee relationship with contractor employees, it is not authorized to grant administrative leave or expend Government resources to compensate contractor employees for hours expended on activities not included in the PWS.
20. SERVICES DURING CRISIS. The performance of these services are not considered to be mission essential during times of crisis. Should a crisis be declared, the CO or their representative will verbally advise the Contractor if service is required or if temporary suspension of these activities is necessary, followed by a written notification. A representative of the CO will further notify the Contractor verbally when the crisis has ended with written notification to follow. Any price changes resulting from this crisis will be negotiated in accordance with FAR clauses for “Changes”.
21. CONTRACTOR MANPOWER REPORTING REQUIREMENT. The Contractor shall report all Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Department of the Air Force via a secure data collection site. The Contractor is shall completely fill in all required data fields at the data collection site. 21.1. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, the Contractor shall report all data no later than October 31 of each calendar year. Contractors may direct questions to the Contractor Manpower Reporting Application (ECMRA) help desk.
21.2. Uses and Safeguarding of Information. Information from the secure web site is considered to be proprietary in nature when the contract number and Contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the Contractor name and contract number associated with the data.
22. PUBLICATIONS
Publications, forms, memorandums, and policy letters that apply to the stand-alone contract are listed below. The Contractor can access unclassified forms and publications on the Internet at: http://www.e-publishing.af.mil/ Supplements or amendments to publications from any organizational level may be issued during the life of the contract. The Contractor shall implement those changes which will not result in a cost impact. Before implementing any change that will result in an increase in contract price, the Contractor shall submit to the CO a price proposal within thirty calendar days following receipt of the change by the Contractor. The CO and the Contractor shall negotiate the change into the contract under the provisions of the contract clause entitled "Changes." Failure of the Contractor to submit a price proposal within thirty calendar days following receipt of the change entitles the Government to performance according to such change at no increase in estimated cost or fee.
The following publications are being provided as guidance in performing the identified PWS requirements. All publications referencing a PWS paragraph require compliance when performing the task.
