About this file
This document is Attachment 1 - Provisions and Clauses for federal contract FA460826QC033, which serves as a template listing standard contract clauses incorporated by reference and in full text for a Department of Defense acquisition.
The clauses incorporated by reference cover critical compliance areas including compensation of former DoD officials, whistleblower rights, prohibition on covered defense telecommunications equipment, domestic source restrictions, hexavalent chromium prohibitions, Maduro regime business restrictions, Xinjiang Uyghur Region procurement prohibitions, electronic payment submissions, convict labor, child labor, equal opportunity for workers with disabilities, human trafficking prohibitions, sustainable products, Buy American provisions, text messaging restrictions while driving, payment by electronic funds transfer, small business accelerated payments, protest procedures, security prohibitions and exclusions, and commercial products and services terms. Payment submissions must be made through the Wide Area WorkFlow (WAWF) system using specific document types based on contract line item types: cost vouchers for cost-type items, invoices and receiving reports for fixed-price deliverables, Invoice 2in1 forms for fixed-price services, progress payment requests for customary progress payments, and performance-based payment requests as applicable. Contractors must register with the System for Award Management and WAWF at designated websites and use specific routing codes including Pay Official DoDAAC F87700, Issue By and Admin DoDAAC FA4608, and Inspect By/Service Acceptor/Ship To Code F1G3A2. Evaluation factors for award include price (lowest evaluated price including all line items) and technical acceptability, with the lowest three offerors undergoing technical evaluation and subsequent evaluation of additional quotes if necessary until three technically acceptable quotes are identified. Offerors must certify regarding domestic end products, Free Trade Agreement country products, Israeli products, and foreign end products in accordance with Buy American and trade agreement provisions.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Attachment 1 - Provisions and Clauses
52.225-4
Price: The total evaluated price will include the total price of all line items. The price will be evaluated based upon price and ranked lowest to highest. The price evaluation will determine whether the proposed price is complete, fair and reasonable, and not unbalanced.

The quotes will then be evaluated based upon ability to furnish the items requested in the CLINS outlined as well as any attachments associated with this solicitation. If any or all three of the lowest quotes are deemed unacceptable the next lowest quote(s) will be evaluated, and the process will continue until 3 quotes are found to be technically acceptable. If three or less quotes are received, then all quotes received will be sent for technical evaluation.

A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer ( or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
