SAN DIEGO SECTOR

Statement of Work (SOW)

Pest Control Management Service Requirement

1. BACKGROUND:

The U.S. Customs and Border Protection (CBP), U.S. Border Patrol San Diego Sector (San Diego Sector) has a requirement for commercial Pest Control Management Services throughout the surrounding stations, checkpoints, and facilities.

2. SCOPE:

It is the intent of CBP to establish a Purchase Order for an environmentally sound and effective Pest Control Management service to inspect, treat and prevent general arthropod, vertebrate pests, and disease vectors from adversely affecting San Diego Sector installation operations (facilities identified in Section 7).

3. APPLICABLE DOCUMENTS:

• National Environmental Policy Act of 1969

• Federal Insecticide, Fungicide, and Rodenticide Act (as amended) with the Federal

Environmental pesticide control Act

• The contractor shall comply with all Federal, (Occupational Safety and Health

Administration (OSHA), Environmental Protection Agency (EPA)), State, and Local Laws, installation regulations, and orders as applicable to this type of service.

• Commercial standards shall be utilized.

• The contractor shall hold and maintain applicable licenses and permits throughout the duration of the contract.

• 7 U.S. Code § 136r–1. Integrated Pest Management

4. SPECIFIC TASKS:

The Contractor shall perform the following tasks, as related to pest control services. A specially trained Certified Technician for the State of California will render the services at each of the facilities as identified in Section 7.

4.1 Pest Management Service:

• Preventing and controlling common pests, including but not limited to, scorpions, cockroaches, termites, ants, fleas, stored product pests, mosquitos, mice, rats, bats, bees, and wasps.

• Thoroughly inspecting and treating all areas suspected of pest infestation(s) and surrounding areas/facilities up to 25 feet, as necessary.

• Perform treatment of standing water for the control of mosquito larvae.

• Communicating constantly with the government Point of Contact (POC) regarding planned actions and recommendations.

• Recommending structural and procedural modifications to reduce food, water, harborage, and access used by pests.

• Using appropriate non-chemical technologies to control pests, where possible.

• Judiciously using pesticide products, formulations and application methods that present the lowest potential hazard to human health, non-target animals and the environment.

• Recording and reporting all integrated pest management operations including surveillance, inspections, non-chemical and chemical control.

• Pest Control Unscheduled Services – Due to “unpredictable” circumstances with pests; The vendor will respond to urgent requests within (24) twenty-four hours of notification to remedy or exterminate pests which will allow Border Patrol to continue operations.

• The Vendor will provide two (one back-up) phone numbers. These numbers will be answered after normal business hours in the event of urgent requirements.

• The Contractor shall use best management practices and recognized industry standards for managing pests such as those established by national pest management organizations, and follow the guidance provided by State Pesticide Regulatory agencies and State institutions of higher learning.

4.2 Contractor Work Plan

The Contractor shall develop and maintain a detailed Contractor’s Work Plan (CWP) for each location. The CWP shall specify the schedule, technical approach, and resources required for the planning, execution, and completion of the SOW tasks. Contractors may review the installation’s historical records of pest activity and abatement actions, survey facilities and grounds, and consult with the POC in development of a plan. The CWP shall address continuous monitoring, pest response and removal procedures, record keeping, warranties, education, and communication to installation personnel to prevent nuisance pests and disease vectors in and around specified buildings. The CWP shall include labels, Safety Data Sheet (SDS), and the planned pesticide use proposal and comply with all applicable local, state, and Federal regulations.

As part of the CWP, the Contractor shall develop a schedule that fully supports the identified technical approach. The Contractor shall coordinate activities with the POC to ensure that the proposed project schedule does not conflict with other Contractor activities on site, or interrupt installation mission activities.

The CWP is to be provided with five (5) days after contract award and evaluated on an annual basis.

4.3 Expertise and Necessary Personnel

The Contractor shall have the background and experience to be capable of identifying pest and knowledgeable about pest life cycles, habits and the conditions that affect pest populations. Additionally, the Contractor shall have a written Integrated Pest Management (IPM) Policy describing their overall objectives relating to IPM.

Contractor shall ensure to have the necessary personnel to cover all requirements of this contract. In addition, Contractor shall provide a list of all personnel anticipated to work on this contract within three (3) days of contract award. The Government reserves the right to require Contractor personnel to "sign-in" upon entry and "sign-out" upon departure from the facilities. It is the Contractor's responsibility to notify the Government Authorized Representative before commencement of work and immediately after removal, when a Contractor employee is dismissed, terminated, or assigned to duties not within the scope of this contract.

4.4 Licensing and Certification

The Contractor shall possess a business license issued by the State of California to provide pest control services. The Contractor shall provide proof of licensing to the government within five (5) days after contract award.

All Contract personnel employed who will apply or supervise the application of pesticides under this contract shall possess commercial certification by the State of California in the appropriate EPA-approved State categories for the work requirements of the contract. All Contractor personnel who apply pesticides shall have full commercial certification. Neither private applicator certification nor registered technician certification is acceptable. Proof of State certification shall be provided to the government within five

(5) days after contract award along with a list of vendor personnel.

4.5 Pesticide Approvals

Prior to use, the Contractor shall request approval for all pesticides. The Contractor shall ensure that all pesticides proposed for use on U.S. Border Patrol installations are EPA registered and registered with the Department of Agriculture. Approvals may be made and limited to specific pests/sites. All approvals shall be made in writing to the POC for review and approval by the designated U.S. Border Pest Management Advisor. The Contractor shall not deviate from the approved listed pesticides without prior approval from the POC. The pesticides list being used shall reflect only the currently approved pesticides for application on the installation and updated as additional products are approved and/or as other products deleted.

4.6 Contractor Vehicles

All Contract vehicles used in connection with this contract shall be clearly marked with the company logo and include additional markings as required by the State of Arizona and the State of California. Vehicles shall be always secured to prevent unauthorized access. All pesticides carried on vehicles shall be stored in a locked compartment separate from the cab of the vehicle. Vehicles shall be equipped with a fire extinguisher, emergency wash water, a portable emergency eye wash and a portable spill and decontamination kit.

4.7 Equipment

The Contractor shall repair and maintain all equipment in accordance with manufacturer’s instructions. Equipment shall be in good operating condition, free of visible deterioration, shall not leak, and shall be calibrated to apply pesticides in accordance with the pesticide product label. Proof of calibration may be requested by the government. Broken or deteriorating equipment shall be replaced and/or repaired by the Contractor prior to use. The Contractor must clearly and plainly mark all pesticide application equipment including rodent bait stations and glue traps with the company’s name, a point-of-contact, and phone number. The Contractor shall assume responsibility for all Contractor-owned equipment or other items.

4.8 Pesticide Storage, Mixing and Disposal

The Contractor shall procure, handle, store, and apply pesticides in strict accordance with the EPA registered pesticide label. Only certified applicators shall operate pesticide application equipment.

The Contractor shall not store pesticides on Government property. All pesticides shall be stored off Government property, or inside of the secured Contractor vehicle(s).

All pesticides, rinse water, and containers shall be disposed of in accordance with label directions. The Contractor shall dispose of any pesticides, pesticide containers, pesticide residue, pesticide rinse water, or any pesticide contaminated article at an authorized disposal area off Government property.

4.9 Pesticide Spills

The Contractor shall immediately report all spills of hazardous materials to the POC and shall be financially responsible for the clean-up of any spills. Contractor shall have a documented Spill, Prevention, Control, and Countermeasure (SPCC) plan Prevention, Control, and Countermeasure (SPCC) plan, which shall be provided within five (5) of contract award. Spills shall be managed by the Contractor in accordance with this plan.

The Contractor shall have on-hand spill containment equipment and materials necessary to contain spills of pesticides and other pest control materials and supplies that are on the installation.

4.10 Personal Protective Equipment

The Contractor shall provide Personal Protective Equipment (PPE) to each of their pest control applicators. This equipment shall include, at a minimum, the PPE required by the applicable pesticide labels and MSDS.

4.11 Occupied Spaces

All indoor chemicals shall be odorless and compliant with all federal, state, and local regulations. Dust pesticide formulations shall not be applied in occupied spaces if the dust can be carried by air currents to people. Gel baits, cockroach, rodent and ant bait stations or other pesticide formulations that do not volatize or carry-on air currents may be applied in occupied spaces.

4.12 Records and Reports

The Contractor shall prepare, submit, and maintain pest management records and reports for each pest management service provided to include surveillance, non-chemical controls, and pesticide applications. Records shall be accurate and complete. All pest management records shall be submitted electronically (in PDF format) to the POC monthly. Records shall include:

• Installation name, building number, and location of service

• EPA Registration Number

• Target pest

• Name (common name) and amount of pesticide spray, dry formulation, or application applied

• Date of application

• Pest controller’s name and certification number.

5. DELIVERABLES AND DELIVERY SCHEDULE:

The Contractor shall perform monthly Pest Control Services on a regular scheduled basis as identified in Table 1. If the regular scheduled day falls on a holiday, prior arrangements for rescheduling service will be made. Vendor will not deviate from the delivery schedule below without prior approval from the POC. In addition to the monthly services provided, if applicable;

the Contractor will respond for additional services during the year, if deemed necessary by the station Contract Specialist or POC.

6. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION:

The Government does not anticipate providing any Government Furnished Equipment (GFE) or Government Furnished Information (GFI).

7. PLACE OF PERFORMANCE:

Service shall be performed at the facilities listed during normal business hours (0600 to 1430 Monday thru Friday) at a minimum of once a month, and as needed, depending on the service required. Service may require more than one visit to eliminate pest issues. Note: All building data are estimated square feet (SF) gross areas.

8. PERIOD OF PERFORMANCE:

The period of performance for the resultant Purchase Order shall be a base period of one-year plus four option years as follows:

Base: 09/15/2021 – 09/14/2022 Option Year 1: 09/15/2022 – 09/14/2023 Option Year 2: 09/15/2023 – 09/14/2024 Option Year 3: 09/15/2024 – 09/14/2025 Option Year 4: 09/15/2025 – 09/14/2026

Exercising of option years is dependent on the needs and requirements of the Government (i.e., within the Government’s discretion)

9. SECURITY:

The Contractor shall be escorted by a Government employee while performing pest control services. For all employees performing work on this contract, the Contractor shall provide the employee’s name and other pertinent information so each employee may be vetted by CBP.

10. SPEICAL CONSIDERATIONS

11.1. Contracting Officer’s Authority:

No changes to this SOW or price increases shall be incurred without written prior approval of the Contracting Officer. Any changes or cost increases will not take effect until the Contracting Officer executes a written modification. The Contracting Officer is the only individual with the authority to amend the solicitation or modify the contract.

11.2. Environmental Management:

To comply with federally mandated environmental preference programs and Department of Homeland Security (DHS) “Green Procurement Program” (GPP) policy, US Customs and Border Protection requires the use of environmentally preferable products and services. These program elements include recovered material products, energy and water efficient products, alternative fuels and fuel efficiency, bio-based products, non-ozone depleting substances, priority chemicals, and environmentally preferable products. These program elements are described on the Office of the Federal Environment Executive website (http://www.ofee.gov).

Product or service must be in compliance with Environment, Energy and Water Efficiency, Renewable Energy Technologies, Occupational Safety, and Drug-Free Workplace FAR 52.223-1 through 52.223-17, 52.204-4 and 52.211-5.
