About this file
This Sole Source (Including Brand Name) Justification document details a procurement for two air-cooled chillers for buildings 1055 and 1005 at Creech Air Force Base. The requirement is for one 80-ton and one 170-ton Trane air-cooled chiller, with an estimated delivery of 90 days after receipt of order and full funding from Operation and Maintenance funds (3400). The 99th Contracting Squadron at Nellis Air Force Base will solicit the requirement as a Firm Fixed Price purchase order through SAM.gov, with a small business, name-brand set-aside.
The procurement is part of a broader Air Force initiative to standardize HVAC chiller systems, with the Air Force Civil Engineer Center directing Base Civil Engineers to identify a single manufacturer for chillers at their installations. Market research showed previous Trane chiller awards at other Air Force bases, and Trane was contacted directly to provide authorized resellers. The justification notes that at the end of the equipment's 10-year life cycle, Trane will be the only HVAC equipment brand on Creech AFB, with future requirements continuing the brand name requirement. The contracting activity anticipates multiple small-business quotes and will determine cost fairness through price comparison to recent similar awards.

I. Contracting Activity.
The Department of the Air Force, 99th Contracting Squadron, Nellis Air Force Base, NV, is responsible for this Brand Name Justification and Approval.
II. Nature and/or description of the action being processed.
The 99th Contracting Squadron intends to solicit a new requirement as a Firm Fixed Price purchase order through SAM.gov.
III. Description of supplies/services required to meet agency needs.
This requirement is for the purchase of two Air-Cooled Chillers for buildings 1055 and 1005 on Creech AFB.
Anticipated CLIN structure will be as follows:
CLIN 0001 - 80 Ton Air-Cooled Chiller - Qty 1 - $ CLIN 0002 - 170 Ton Air-Cooled Chiller - Qty 1 - $
Estimated Total Price: $
Estimated Delivery: 90 Days ARO.
This requirement will be fully funded with Operation and Maintenance funds, 3400.
IV. Statutory authority permitting other than full and open competition.
DAFFARS 5313.501 - 10 U.S.C. 3572, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Air Force Civil Engineer Center Director (AFCEC/CL), IAW with AFIMSC Memo 26 September 2018 Air Force Facilities and Construction Category Council Charter, directs all Base Civil Engineers (BCEs) to perform a comprehensive inventory analysis to identify a single manufacturer for HVAC chiller systems at their respective installation. This memo directed a phased approach in the standardization of the HVAC chiller systems located on each base. Existing non-standard HVAC chiller systems shall remain in operation until replacement as determined by the BCE. Acquisition of new HVAC chiller systems through maintenance, repair, and construction projects shall comply with the memorandum listed above. The 432nd Support Squadron, Civil Engineer Flight, conducted a series of analyses to justify use of brand name manufacturing for Heating, Ventilation, and Air Conditioning (HVAC) chiller units. As a result of their analysis, Trane was identified as the mandatory single manufacturer of chiller systems to be used on Creech AFB. A search within the Federal Procurement Data System (FPDS-NG), resulted in awards for chiller systems and similar products previously executed through the Air Force. The following have been awarded within the previous years:
FA465424P0002 -$298,336.00 at Grisson ARB, IN with 2 offers, FA446014T0059 - $295,025.72 at Little Rock AFB, AR with 6 offers, and FA468621P0018 at Beale AFB, CA with 1 offer. Additionally, Trane was contacted directly and they provided authorized resellers.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Per the direction of the AFCEC/CL, Creech AFB BCE has identified Trane as the mandatory brand for chiller systems.
Following market research, there is reasonable expectation we will receive multiple small-business quotes. Based on the market research, this will be solicited via SAM.gov, with a small business, name-brand set-aside.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Prior to award, the Contracting Officer shall determine costs to be fair and reasonable based on adequate price competition or through comparison to similar requirements recently awarded. Procedures outlined in FAR 13.106-3(a) shall be followed.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market Research was conducted to determine what competition and set-asides could be utlized for this requirement. A search within the Federal Procurement Data System (FPDS-NG), resulted in numerous Trane U.S. Inc brand product awards for chiller systems and similar products previously executed throughout the Air Force. The following have been awarded within previous years: FA465424P0002 - $298,336.00 at Grissom ARB, IN with 2 offers, FA446014T0059 - $295,025.72 at Little Rock AFB, AR with 6 offers, and FA468621P0018 at Beale AFB, CA with 1 offer. Additionally, Trane was contacted directly and they provided authorized resellers.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
In accordance with a previous approved Class J&A, to increase mission performance, costs savings, and innovation in business methods, chiller standardization supports the National Defense Strategy objective to innovate business decisions for saving taxpayer dollars. This strategy was implemented through the AFIMSC Memo 26 September 2018 Air Force Facilities and Construction Category Council Charter.
X. List of any sources that expressed, in writing, an interest in the acquisition.
Trane U.S. Inc., has provided a quote for each required chiller and also provided a list of authorized resellers.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
At the end of the equipment's 10 year life cycle, Trane will become the only brand of HVAC equipment on Creech AFB.
Future HVAC requirements, will continue the brand name requirement. The history of proven local and regional support have outweighed the cost of selecting to only use Trane brand equipment. The cost has also been found reasonable by using competitive solicitations. At the end of the 10 years, BCE's will conduct a new comprehensive inventory analysis to identify if they will stay with Trane or switch to a different manufacturer.
XII. Certification by the Contracting Officer.
As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
XIII. Certification by the technical/requirements personnel.
As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
