Performance Work Statement (Draft) Office of Naval Intelligence Shipping Industry Research

1.0 BACKGROUND

The US Navy is tasked to provide in-depth incite, analysis and assessments of the commercial merchant shipping/fishing industry to include commercial shipping/fishing companies, commercial port operations, vessel owners, and/or vessel managers, vessel construction, and vessel operations. To assist the US Navy in satisfying these tasks, the services of a company that routinely investigates commercial merchant shipping/fishing companies, vessel owners and/or vessel managers on behalf of commercial entities (e.g. banks, insurance companies, consignees, etc.) is required. This company must also be able to respond to tasks submitted by the US Navy in the form of queries by conducting research into commercial merchant shipping/fishing industry to include commercial shipping/fishing companies, commercial port operations, vessel owners, and/or vessel managers, vessel construction, and vessel operations worldwide.

2.0 SCOPE

This Performance Work Statement (PWS) describes the types of commercial merchant/fishing industry research tasks required of the Contractor and shall lead to a contract priced in US dollars. The research tasks shall be based on requirements of the US Government that focus on the commercial merchant shipping/fishing industry to include commercial shipping/fishing companies, commercial port operations, vessel owners, and/or vessel managers, vessel construction, and vessel operation. This includes providing an understanding of company ownership, reputation in the maritime industry, their personnel, total maritime shipping assets, connections to other maritime shipping companies, complete financial information, history of litigation/investigations/disputes, and any association to illicit activity. Tasks that require research into regional trends as they may relate to any of these issues may also be required.

The Contractor shall perform this work using Contractor supplied facilities, personnel, and equipment. In addition, if the Contractor deems it necessary, shall travel to locations worldwide in order to fully research a task, obtain firsthand knowledge and/or other information required to enhance the quality of the requested reports.

The Contractor shall, under this PWS, be required to communicate with the US Navy via encrypted Email.

3.0 REQUIREMENTS

3.1 The information provided by the Contractor to the US Navy in response to the query tasks shall enhance current intelligence analysis methodologies employed to support the U.S. Government, and their partners’ efforts in thwarting illicit maritime activities. In addition, the data provided within the reports shall also meet US Government’s criteria for timeliness, content, integrity, and coverage of the international commercial shipping/fishing industry, as will be stated in each task order.

3.2 The Contractor shall be recognized within the shipping community as company with a valid requirement for the type of information being requested. The Contractor shall perform all investigations and research in support of the tasks submitted by the US Navy in the same manner as any other normal investigative responsibilities on behalf of their commercial customers.

3.3 The Contractor shall have the ability to travel, as part of its normal business, worldwide to obtain data and/or information when and if required to enhance the quality of the requested reports. All travel shall be conducted without making any reference to the Contractor relationship with the U.S. Government, unless necessary to accommodate questions posed by U.S. Immigration.

3.4 In the event that the Government determines that Public Key Infrastructure

(PKI) encryption shall be utilized for exchanging emails between the Contactor and the US Navy, the Contractor shall be responsible for obtaining an approved PKI Key.

3.5 Prior to the Contractor starting any work on a submitted task the contractors estimate must first be validated by an appointed Technical Point of Contract and approved by the contract COR. Each submitted task shall include, at a minimum, the following information:

3.5.1 The type of research requested. This will include the name of the shipping/fishing company, owner and/or manager, the type of information needed, and the depth of research required.

3.5.2 The urgency of the request. There will also be a priority number given the query when needed.

3.5.3 A unique query tracking number.

3.6 Once a task is submitted by the designated representatives (indicated in section 3.6), the contractor shall respond back to these representatives within one (1) business day, providing an estimate on the total level of effort required to complete the task, to include estimates on the total man hours required, associated travel costs and any Other Direct Costs (ODC).

The Contractor shall work with the appointed US Navy representatives to establish a rough order of magnitude (ROM) for each query task order that includes an estimated time of completion. All query tasks shall be assigned a tracking number by the US Navy which shall be included in all correspondence between the Contractor and appointed representatives regarding the query. A designated representative (indicated in section 3.6) shall respond to the Contractor with an email approving task commencement. The Contractor shall not perform any work until they receive this email from the appropriate US Navy representative (indicated in section 3.6). If the Contractor determines an approved task requires additional costs of more than 5% the Contractor shall stop all work and notify the COR and TPOC of the potential cost overrun. The 5% increase shall be the estimated costs of the overall task or any one section (Man hours, travel, ODC). Once the Contractor notifies the COR and TPOC of a potential cost overrun the Contractor shall not incur any additional costs against the task. The designated representatives shall review the cost increase and determine whether to authorise the additional spending or settle on a partial task response. The COR/TPOC will then notify the Contractor, via email, of this decision and a new due date shall also be set, if required, as result of any delays caused by these processes. No invoice shall be submitted or approved for payment for greater than 5% of the original estimate without this prior approval, in writing, from the appropriate representatives. The contractor shall respond to all validated queries submitted by the US Navy via email, encrypted e-mail, and/or fax.

3.7 If two (2) or more query requests are active at one time, each active request will also be given a priority number with one (1) being the highest priority (The contractor should automatically assign a one (1) priority to a query if it is the only query they are investigating at the time). The US Government can also reassign priority numbers to active queries should the urgency and/or current events warrant the change. Once informed of the change the Contractor shall realign their assets within 2 weeks to follow the new priorities. Once notified of the priority change by approved representatives, the Contractor shall provide the US Navy updates to the task completion dates caused by the new priorities.

3.8 Once a task is completed and submitted to the US Navy the Contractor shall wait for approval from the COR/TPOC before invoicing for that task.

No tasks shall be invoiced before a deliv6rable is received and approved by the US Navy. In the event that tasks are submitted that require multiple months to complete, a schedule shall be agreed to by the Government and the Contractor so that subsets of the task can be provided each month and an invoice shall be submitted for the work completed during that month.

The Contractor shall, at their own discretion, invoice for each completed task after it is approved during the month or combine all task completed and approved during a calendar month into one monthly invoice.
