About this file
This is an informational attachment to a Department of the Air Force Request for Solution (RFS) under Other Transaction Authority (OTA) for a Consortium Management Organization (CMO), specifically outlining available authorities and funding opportunities for energy commodity and energy services procurement.
The document lists ten federal statutory authorities that contractors may leverage for follow-on production contracts under 10 U.S.C. § 4022(f). These authorities enable the Department of the Air Force to procure energy commodities and services from third-party owned, operated, and maintained energy assets. The authorities include: 10 U.S.C. § 2667 (leases of non-excess military property); 10 U.S.C. § 2695 (acceptance of funds for administrative expenses); 10 U.S.C. § 2913 (Utility Energy Services Contracts); 10 U.S.C. § 2916 (sale of electricity from alternate energy or cogeneration); 10 U.S.C. § 2917 (geothermal energy development); 10 U.S.C. § 2919 (demand response programs); 10 U.S.C. § 2922a (power purchase agreements); 40 U.S.C. § 501 (utility services acquisition); 40 U.S.C. § 591 (electricity purchase); and 42 U.S.C. § 8287 (Energy Savings Performance Contracts). A critical restriction noted is that vendors cannot leverage 10 U.S.C. § 2688 (utility systems conveyance authority) for follow-on production contracts. Contractors are responsible for understanding the requirements and limitations of each authority they select.

Below are examples of these authorities, which we are providing for informational purposes only. Contractors will need to leverage one or more of these authorities for follow-on production contracts under 10 U.S.C. § 4022(f), and are responsible for understanding the use, requirements, and limitations of these authorities. Please note, vendors cannot leverage 10 U.S.C. § 2688, Utility systems: conveyance authority for a follow-on production contract under 10 U.S.C. § 4022.
