Section C: Justification for Soliciting from a Single Source or Brand Name

FAR 13.106-1(b)(1) - For purchases not exceeding the simplified acquisition threshold.

(i) Contracting officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

(ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring the brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand-name.

Outdoor Recreation (ODR) is in the process of outfitting the entire shop with Winterstieger ski maintenance products to help limit the turnover time of maintenance/repairs by only having to call one repair technician instead of several different technicians for different products. Currently, ODR has the Wintersteiger Trimjet edger on hand and have budgeted to acquire the Wintersteiger Omega stone grinder via contract and Waxjet Pro waxer via GPC in FY25.

Historically, the location of the base in Cheyenne, WY has not had success in expeditiously booking repair technicians as the area is not a winter sport destination and the scope of maintenance is not required regularly in the area. Wintersteiger however, is based in Salt Lake City, UT with a satellite location in Denver, CO, within a 100 mile radius from FE Warren AFB. The customer service representative contacted through market research assured the Contract Specialist that Wintersteiger has four technicians servicing the area from Denver to Laramie area. ODR has used these providers in the past and report a 2 - 5 day turn around on service, versus the 2-3 week follow through with other brands not based within the local area. By consolidating all work to one service technician, turn around time on annual servicing is cut by 400%.

Wintersteiger is the industry leader in ski maintenance equipment making the requested Wintersteiger Safetronic Max machine a commodity that will keep equipment consistent and current while also cutting down on labor costs due to technology upgrades that surpass others within the industry.

The customer is requesting an automatic machine since a manual machine would take more physical effort to utilize, causing more dedicated man-hours, delayed return times, stress on team members. In addition, a manual machine takes two to three times longer to calibrate a binding, which slows down other ODR operations, hindering their ability to service more customers.

A Wintersteiger Safetronic Calibration Machine will cut down labor costs and allow ODR to keep within industry standards for maintaining and checking equipment more easily while providing better service the base community.

Wintersteiger's native compatibility and proprietary technology would best suit the fleet of existing and budgetted ski maintenance equipment, working in tandem with the other Wintersteiger machines on hand. The Safetronic Max would be an obvious choice in the outfit of ODR to a one brand shop, poising them to better service their annual 2,000 rental customers, generating over $45,000 in revenue for 90 FSS during the winter season.

Therefore, this purchase will be brand name only.

Section D: Efforts to Obtain Competition

Like products were researched through Google searches. Searches resulted in comparable equipment from equally compatible brands, but given its native compatibility and proprietary technology, outfitting the shop with machines that work in tandem and only require one service call is more rationale.

Market Research was conducted and it was found that there are two other ski calibration machines on the market that are comparable with the requested machine:

The Reichmann Profi B Professional meets the salient characteristics of the customer. However, this machine would not be compatible with the current Wintersteiger machine's proprietary technology. Additionally, Reichmann is based out of Germany with only two technicians listed in the Denver area.

The Montana Crystal Rock was also found to be a comparable machine but, it is a manually operated as opposed to the required automatic machine. Montana has locations throughout the United States but, it's closest technicians listed are based in Nevada and Idaho.

A sources sought on SAM.gov revealed two (2) interested, capable vendors, both of which are small businesses. It is speculated that the manufacturer is a small business but, further investigation is required. It is believed that suitable competition is available.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Though this equipment requires brand name only restrictions, there remains the opportunity of competition for other authorized vendors of Wintersteiger machines.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
