PERFORMANCE WORK STATEMENT

FOR

DEFENSE LOGISTICS AGENCY DISTIBUTION SAN JOAQUIN, CA

REFUSE COLLECTION AND DISPOSAL SERVICES

SECTION 1: INTRODUCTION

1.0 BACKGROUND

The Defense Logistics Agency (DLA) is the largest logistics support agency in the United States (U.S.)

Department of Defense (DOD). The DLA Director reports to the Under Secretary of Defense for Acquisition, Technology and Logistics (USD AT&L) through the Assistant Secretary of Defense for Logistics and Materiel Readiness (ASD L&MR). DLA provides worldwide logistics support, acquisition, and technical services to the military services, other federal and civilian agencies, and partner nations in peacetime and wartime.

The primary mission of DLA is to provide supplies and services to United States Military forces worldwide. Within the general scope of DLA’s mission involves managing and supporting DOD warehouse operations via a worldwide enterprise consisting of over 34 distribution centers and facilities. The scope of operations involves over 10,000 personnel who manage a $105 billion inventory of over 2.4 million items and process approximately 15 million transactions annually for over 243,000 customers.

1.1 REQUIREMENT

This Performance Work Statement (PWS) is for the service of solid waste collection and off-site disposal services at DLA Distribution San Joaquin, CA (DDJC). The DDJC site is approximately 448 acres and is located two miles southeast of Tracy, California. The services will be obtained through a firm-fixed price contract.

SECTION 2: GENERAL CONDITIONS AND REQUIREMENTS

2.0 PERIOD OF PERFORMANCE

The period of performance for this Contract shall be for a one-year base period with four (4), one-year option periods.

2.1 PLACE OF PERFORMANCE

The refuse collection and disposal services shall be performed at DDJC. The physical address is: 25600 S. Chrisman Rd. Tracy, CA 95304

2.2 CORE DUTY HOURS AND ACCESS TO THE INSTALLATION

A. The Contractor shall perform services required under this PWS during the operating hours of the

Government activity. The core hours for on-site maintenance activities are from 0700 (7:00 AM) to 1530 (3:30 PM) hours Monday through Friday, Pacific Standard Time (PST) local time, except Federal holidays. The Contracting Officer Representative will provide the Contractor a 48-hour notice for any working hours changes other than the core hours.

B. Due to changing traffic requirements brought on by construction, changing missions, and security concerns within the installation, access to the installation is subject to change, sometimes with little or no warning. Inbound and outbound traffic restrictions may exist.

2.3 FEDERAL HOLIDAYS

A. Federal holidays generally observed by the Government include:

B. In the event an Executive Order issued by the President of the United States declares Agencies of the Federal Government closed for a regularly scheduled workday, the Contracting Officer or the Contracting Officer Representative, will determine and advise the Contractor on whether services are required for that day.

2.5 RESOURCE REQUIREMENTS

2.5.1 KEY PERSONNEL

A. AUTHORIZED GOVERNMENT PERSONNEL

1. CONTRACTING OFFICER (KO)- A DLA employee that is the official individual that is authorized to enter into, administer and terminate contracts on behalf of the Government. Any changes to the authorized personnel will be issued via contract modification issued by the KO.

2. CONTRACTING OFFICER REPRESENTATIVE (COR) - A DLA employee shall be appointed to serve as COR. The COR’s name and contact information will be provided to the Contractor upon contract award.

B. AUTHORIZED CONTRACTOR PERSONNEL

1. CONTRACT MANAGER - The Contractor shall designate a Contract Manager who will have full authority to act for the Contractor on all matters relating to Contractor performance under this contract. The name of this person and an alternate, who shall act for the Contractor when the manager is unavailable, shall be designated and submitted in writing to the KO or COR.

2. The Contract Manager has the authority to resolve problems, allocate resources, manage personnel, and monitor operation performance taking direction from the Government to ensure complete satisfaction. In the performance of these duties, the Contract Manager shall possess the basic knowledge and skills required to plan, control, manage, and be responsible for the successful completion of any work and shall be qualified to be the Contractor’s on-site supervisor and POC for Government representatives.

3. The Contract Manager shall be able to provide overall supervision for Contractor employees to include, but not limited to, planning and managing the project professionally, ensuring that work is scheduled properly to obtain maximum use of resources; and cost and time-efficient methods and procedures, and quality controls are used to ensure the criteria of this Statement of Work are met or exceeded.

2.5.2 CONTRACTOR PERSONNEL / QUALIFICATIONS

A. Contractor personnel shall wear any Government-issued badges onsite and be easily recognized.

This may be accomplished by Contractor personnel wearing distinctive clothing bearing the name of the company and/or by wearing appropriate badges, which contain the company name and employee’s name. During performance of the service requirements set forth in this PWS, all Contractor personnel shall introduce themselves or shall ensure they are introduced as Contractor employees. Contractor personnel shall also appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

B. Contractor personnel shall comply with directives, guidance, rules and regulations pertaining to operation of commercial vehicles on base at DDJC and within the state of California.

C. The Contractor shall assure that Contractor personnel completely understand the requirements of this Statement of Work.

2.5.3 INTERACTIONS WITH OTHER GOVERNMENT ORGANIZATIONS

The Contractor’s primary interaction with the Government shall be through the KO and the COR. The COR will perform the following:

A. Perform quality assurance evaluations of the Contractor’s performance.

B. Provide the primary interface between the Contractor and the host installation and DLA

Headquarters.

C. Perform other inherently governmental functions or other functions not part of this support services.

2.6 SECURITY REQUIREMENTS

2.6.1 ACCOUNTABILITY

A. The Contractor or authorized representative shall submit to the COR a roster identifying all

Contractor personnel who will be performing under this contract. The roster shall contain the following information about each individual. An updated roster and individual information shall be provided to the COR when any Contractor personnel changes occur.

1. Name (last, first, middle initial), aliases

2. Status (type of employment)

3. Name of Company

4. Office phone number

5. Home address

6. Date of Birth

7. Length of anticipated employment

8. Citizenship

The roster shall be furnished to the COR within five (5) calendar days after the date of contract award. When any Contractor personnel changes occur, the Contractor shall provide an updated roster and individual information to the COR immediately. The prompt submission of this information will keep to a minimum any delay and inconvenience to the Contractor and Contractor personnel in performance of the contract.

B. All contractor personnel must be US Citizens; therefore, US Citizenship is a requirement. The

Contractor shall comply with all applicable DoD security regulations and procedures during the performance of this contract. No Foreign National will be employed on a Government contract requiring access to Government installations without the consent of the United Stated

Government.

C. All Contractor employees or any representative of the Contractor entering DOD installations as part of performing PWS requirements shall abide by all security regulations and may be subject to security checks. Contractor personnel and property are subject to search upon entering, while on, and upon leaving the DoD locations pursuant to installation regulations. The Installation Commander has the authority to bar individuals from the installation. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement to provide sufficient personnel to perform the services as required by this PWS. All Contractor personnel shall always conduct themselves with acceptable business decorum. The Contractor shall remove any individual from the site whose continued presence is deemed by the KO or the COR to be contrary to the public interest or inconsistent with the best interests of national security.

D. The Contractor and employees shall comply with all security requirements imposed by the installation commander while on the installation. Contractor personnel must bring personal identification and all completed forms to the Pass and ID Office for badge photograph and identification when notified by the COR. Contractor personnel involved in civil crimes and/or other incidents of misconduct may be restricted from entry to the installation. The contractor is responsible for ensuring all visitor badges are returned within three (3) calendar days of employee termination or contract completion.

2.6.2 PHYSICAL SECURITY

To be compliant with DoD and DLA regulatory guidance, the Contractor shall ensure the physical security of all Government property to assure that any accountable inventory or information in this contract is secured and protected against theft, sabotage or other acts constituting illegal destruction. The Government will not be responsible in any way for damage to the Contractor’s supplies, materials, equipment, and property or to Contractor employees’ personal belongings that are damaged or destroyed by fire, theft, accident, or other disaster.

2.6.3 REPORTING OF CRIMINAL VIOLATIONS

The Contractor shall report to the KO or COR, any suspected, alleged, or actual criminal incidents IAW DLAI 5105, Reporting of Criminal Incidents.

2.7 PROPERTY AND SERVICES

2.7.1 GOVERNMENT-FURNISHED PROPERTY AND SERVICES

A. The Government will provide emergency medical treatment and emergency patient transportation service for Contractor personnel. The Contractor shall reimburse the Government the cost of medical treatment and patient transportation service at the current inpatient or outpatient treatment rate as appropriate. B. The Government will provide a Truck Scale, located at Building 31 DDJC and Form 388 Refuse Weight Certificate for recording empty and loaded truck weights.

C. The Government will not provide any office space or operational facilities, nor any vehicles or trash container equipment for the Contractor’s use for the purposes of this contract.

2.7.2 CONTRACTOR-FURNISHED PROPERTY AND SERVICES

Except for those items and services specifically stated above to be Government-furnished, the Contractor shall furnish all property, equipment and services to perform this PWS.

2.7.3 REFUSE COLLECTION VEHICLES

A. All refuse collection vehicles shall be specifically designed for the purposes of these contract services and be compatible with the collection containers provided by the Contractor.

B. All vehicles shall be in good mechanical condition, rated, free of any fluid leaks and/or any other sources of environmental contamination.

C. The Contractor shall furnish and maintain all vehicles used under this contract in good repair, operationally safe and in a clean, painted condition. The Contractor shall make an adequate number of vehicles available to provide prompt, refuse collection and disposal services commensurate to the needs of DDJC.

D. Any equipment repairs that must be taken care of onsite will be limited to those that are minor. In the case of a major vehicle breakdown, the Contractor will have twenty-four (24) hours to remove the vehicle from the site. The Contractor shall perform all major vehicle maintenance off-site.

E. Failure to meet the above requirements may result in refuse collection vehicle(s) being restricted from entry to the installation.

2.7.4 REFUSE COLLECTION CONTAINERS

A. REFUSE CONTAINER INFORMATION

1. Type I Collection Containers (minimum 2 cubic yard (CY) to maximum 3 CY, and 4 CY capacity):

The Contractor shall position Type I collection containers at assigned locations.

Containers shall be designed so that trash may be placed in the container while standing on the ground. The container lid shall be the type, which can be completely opened or closed while standing on the ground.

2. Type II Collection Containers (10 CY, minimum 20 CY to maximum 30 CY, and 40 CY capacity):

The Contractor shall position Type II collection containers at assigned locations. These containers shall be the roll-off type without any lid.

3. Supplied Collection Container Quantities:

a. Type I Collection Container (minimum 2 CY to maximum 3 CY capacity): 2 Each

(EA)

b. Type I Collection Container (4 CY capacity): 73 EA

c. Type II Collection Container (10 CY capacity): 1 EA

d. Type II Collection Container (minimum 20 CY to maximum 30 CY capacity): 8 EA

e. Type II Collection Container (40 CY capacity and must hold up to 4.5 tons of waste): 24 EA

4. Supplied Collection Container Locations: The COR will give assigned collection container locations to the Contractor after contract award. The Contractor will generate a Collection Container Information List (listing identification information for 2.7.4, A, 3) and submit it to the COR after all containers have been properly placed at assigned locations.

B. All refuse collection containers shall be specifically designed for the purposes of these contract services and be compatible with the collection vehicles provided by the Contractor.

C. The Contractor shall furnish and maintain all containers used under this contract in good repair, operationally safe and in a clean, painted condition. The Contractor will make an adequate number of collection containers available to provide prompt, refuse collection and disposal services commensurate to the needs of DDJC.

D. Each container shall be painted a uniform color and plainly marked with the Contractor’s name and a numerical identification (ID) number on two sides.

E. The Contractor shall submit a list of container identification numbers to the COR at the outset of contract performance. Collection containers will be assigned by size to specific locations by the COR. The list will contain the size, type and location of each collection container. This list will also include the weights of all supplied Type II containers.

F. All containers shall be in good mechanical condition, acceptable visual appearance (no evidence of dilapidation or decay) and free of any fluid leaks and/or any other sources of environmental contamination. The KO or the COR may require repair or replacement of any container at the discretion of the Government where circumstances warrant this action. Collection container repair or replacement shall happen at no additional cost to the Government. The Contractor shall perform all container maintenance off-site.

G. When a collection container needs to be removed for any reason, the Contractor will notify the

COR in advance of the action. The Contractor shall also replace the collection container the same day and supply the replacement collection container information to the COR.

SECTION 3: DESCRIPTION OF SERVICES

3.0 DEFINITIONS

As used throughout this contract, the following terms shall have the meanings set forth below:

A. REFUSE: Includes all garbage, ashes, debris, rubbish, scrap wood, and other similar waste material. Not included are any hazardous waste as defined in 40CFR 261.3, explosive and incendiary waste, contaminated waste from medical and radiological processes, and recyclable waste as determined by the Government.

B. GARBAGE: Includes all animal and vegetable waste (and containers), resulting from the handling, preparation, cooking and consumption of foods. Edible or hog food garbage is the portion of waste food which has been segregated for salvage.

C. ASHES: Includes all residue from burned wood, coal, and other combustible material.

D. DEBRIS: Includes all grass cuttings, tree trimmings, stumps, street sweepings, roofing and construction wastes, and similar waste material.

E. RUBBISH: Includes a variety of unsalvageable waste material such as metal, glass, crockery, floor sweepings, paper, wrappings, containers, cartons, and similar articles not used in preparing or dispensing food.

Rubbish is further subdivided into:

1. Combustible rubbish which can be burned readily in an incinerator or burning pit.

2. Noncombustible rubbish, which cannot be burned at ordinary incinerator temperatures (800 to 1,800 degrees F).

F. SCRAP WOOD: Includes all pieces of wood used for packing and crating, pieces of wood used in construction, and sawdust.

G. RECEPTACLES OR CONTAINERS: Includes all cans, drums, bins, or similar receptacles, which can be handled easily, and multiple containers which are handled by mechanical truck mounted hoists.

H. REFUSE COLLECTION: The system of gathering and transporting refuse, including non-accountable salvage, from pickup stations to points of disposal. It includes hauling garbage to the transfer station when required by the terms of the salvage contract.

I. PICKUP STATIONS: Includes all designated locations where refuse may be conveniently and efficiently assembled and stored in containers for collection.

3.1 COLLECTION SERVICES

A. The Contractor shall provide Refuse Collection and Disposal Services for DLA Distribution San Joaquin, California. The Contractor shall furnish all labor, supervision, materials, supplies, permits and equipment necessary to collect and dispose of solid waste, including the collection and off-site disposal of refuse, garbage, ashes, debris, rubbish, and other discarded solid wastes resulting from industrial, commercial, and community activities.

B. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Government and the Contractor understand that the services to be provided under this contract by the Contractor are non-personal services and that no employer-employee relationship exists between the Government and the Contractor. The Government may provide technical direction which will assist the Contractor in accomplishing the PWS; however, the Government will not control the methods used by the Contractor to perform the service requirements set forth in the PWS.

3.2 REFUSE COLLECTION REQUIREMENTS

A. COLLECTION WEIGHT RECORDING.

Contractor refuse collection vehicles will be weighed at the truck scale located at Building 31 before and after refuse collection. A properly completed Form 388 Refuse Weight Certificate shall be submitted to the COR for every weighed truckload. The Form 388 Refuse Weight Certificate shall be dated for the day of pickup and shall be an accurate refuse/garbage pickup event record. Any Form 388 Refuse Weight Certificate submitted with incomplete information shall not be accepted by the COR and will not be a viable service record receipt instrument. Any incomplete Form 388 Refuse Weight Certificate shall not be recognized, accepted or paid by the Government.

B. REFUSE COLLECTION SCHEDULE.

1. The Contractor shall use the completed Collection Container Information List (Section 2.7.4, A, 4) to collect refuse at assigned locations on the assigned collection schedule.

2. Collection Schedule According to Container Size.

The 4 CY collection containers shall be emptied every Tuesday and Friday. If the base is closed, these containers shall be emptied on the next business day. A properly completed Form 388 Refuse Weight Certificate will be submitted for every weighed truckload. See Section 3.2, A.

The 10 CY, 20 CY to 30 CY, 40 CY shall be emptied when full or as directed by the COR. The Contractor shall empty the requested containers within 24 hours after notification by the COR.

The Contractor shall check all 10 CY, 20 CY to 30 CY, 40 CY on Tuesday and Friday pickup days. A properly completed Form 388 Refuse Weight Certificate will be submitted for every weighed truckload. See Section 3.2, A.

3. The Contractor shall return to pick-up any missed refuse collections within four (4) hours after notification by the COR or KO. A properly completed Form 388 Refuse Weight Certificate will be submitted for every weighed truckload. See Section 3.2, A.

4. SPECIAL COLLECTION REQUIREMENT - Medical Maintenance Building 255.

Any refuse collection containers placed in this area shall be weighed and reported separately when collected. Any Form 388 Weight Certificate forms submitted shall be clearly and properly marked for this collection area. A properly completed Form 388 Refuse Weight Certificate will be submitted for every weighed truckload. See Section 3.2, A.

3.3 DISPOSAL REQUIREMENTS

The Contractor shall dispose of the commercial, industrial, and community activity wastes collected in accordance with all applicable local, state, and federal laws and regulations. All fees associated with disposal shall be paid by the Contractor. The Contractor shall submit copies of all disposals permits or other written documentation of approval and suitability of landfill or other final disposal methods within fifteen (15) calendar days after contract award. Contractor shall not dispose of any hazardous waste as defined in 40 CFR 261.3.

3.4 SANITATION REQUIREMENTS

*If Installation is closed the containers shall be emptied the next business day.

A. The Contractor shall submit proposed container cleaning procedures and schedules for KO approval within fifteen (15) calendar days after contract award.

B. CONTAINER SANITATION

1. Steam Cleaning: All collection container steam cleaning shall be accomplished off-site as stated in Section 2.7.4, F.

2. Type I Containers, at the following locations shall be steamed-cleaned not less than twice each month:

a. Post Restaurant, Building 100 (2 Containers)

b. Post Restaurant, Building 16B (1 Container)

3. The Post Restaurant’s Type I collection containers mentioned above shall not be switched with any other containers located at the DDJC without being properly steam cleaned first.

C. COLLECTION AREA SANITATION. Refuse pickup stations shall be left in a clean, neat and orderly manner. The Contractor shall remove all solid waste within a 25-foot radius of the collection station, including any spillage and waste left or spilled in the area by the container user.

3.5 CODES AND REGULATIONS

Contractor and Contractor personnel shall comply with any/all applicable safety, fire, security, personal conduct codes, and regulations. Publications and regulations are available upon request from the COR. It is the Contractor's responsibility to obtain these regulations from the COR.

3.6 ENVIRONMENTAL CONTROLS

A. GENERAL

The Contractor shall comply with all Federal, State and Local environmental protection laws and regulations, the controls of this section, and all specific requirements stated elsewhere in contract specifications while performing work at DDJC. Local entities which may have jurisdiction include San Joaquin County, the Central Valley Regional Water Quality Control Board, San Joaquin Valley Air Pollution Control District (SJVAPCD) and California Air Resources Board (CARB).

B. SPILL NOTIFICATION

Any spills or releases of hazardous material or waste resulting from the Contractor's performance shall be reported immediately to the Depot Fire Department by calling *911 for DDJC (outside phone line emergency numbers to the Depot Fire Department at DDJC is (209) 839-4492. The Contractor shall be responsible for all cleanup costs and may arrange for cleanup action by qualified Contractor personnel or subcontractors. Cleanup must conform to regulation and proper procedures and meet Federal, State, and Local Governmental requirements; as well as meet the satisfaction of the Depot Environmental Office. Any unauthorized dumping of hazardous waste into dumpsters must be immediately reported to the Environmental Management Division.

C. STORM DRAIN SYSTEM AND LAND DISPOSAL RESTRICTIONS Absolutely no materials, solutions or wastewaters are to be disposed of via the storm drain system or by release on the ground.

D. SANITARY SEWER SYSTEM DISPOSAL RESTRICTIONS. Absolutely no concentrated materials, such as detergents, cleaning solvents, cleaning compounds, etc., are to be disposed of via the sanitary sewage system without prior approval from the Depot Environmental Office through the COR. Diluted solutions and waste waters resulting from normal use of cleaning and sanitary products in accordance with manufacturer’s instructions may be discharged to the sanitary sewer system via utility sinks, lavatories and toilets. Solutions shall not be discharged to floor drains without approval from the Depot Environmental Office through the COR.

3.7 QUALITY CONTROL PLAN.

A. The Contractor shall establish and maintain a complete Commercial Quality Control Plan to ensure the requirements of the contract are provided as specified.

B. The plan shall include an inspection system covering refuse collection and disposal services required by this contract. The plan must ensure that quality service levels are maintained throughout the entire period of contract performance.

C. The Contractor shall maintain records for all inspections conducted by the Contractor and any necessary corrective action taken. This documentation and all records and schedules, as described in the PWS, that are the responsibility of the Contractor, are the property of the Government and shall be made available to the Government during the term of the contract.

3.8 QUALITY ASSURANCE.

A. The COR is responsible for performing Government quality assurance functions for all services and supplies furnished under this contract. Contractor performance is subject to review by the COR and

KO.

B. The Contract Manager may be required to attend an initial quality meeting with the COR during the first month of the contract and thereafter as often as necessary as determined by the COR. The Government will be responsible for preparation of written meeting minutes which shall be signed by the Contract Manager and the COR, with a copy provided to the KO. Should the Contractor not concur with the minutes, the Contractor shall so state any areas of non-concurrence in writing to the COR within five (5) calendar days of receipt of signed minutes.

C. The COR will advise the Contract Manager in person when discrepancies occur and will request corrective action. The COR will make annotation of the discrepancy; the date and time the deficiency was noted and will request the Contract Manager (or authorized representative) initial the entry.
