About this file

This document is a template for Provisions and Clauses (Fill-In) that must be completed as part of solicitation FA700026Q0111.

The document contains two primary federal contracting provisions requiring contractor completion. First, DFARS 252.204-7017 addresses the Prohibition on the Acquisition of Covered Defense Telecommunications Equipment or Services, requiring offerors to represent whether they will or will not provide covered defense telecommunications equipment or services as part of their offered products or services to the Department of Defense. If an offeror represents that it will provide such equipment or services, it must disclose: (1) a detailed description of all covered defense telecommunications equipment and services offered, including brand, manufacturer, model number, and OEM information; (2) an explanation of the proposed use and factors determining permissibility under the prohibition; (3) for services, the entity providing the covered defense telecommunications services with entity name, unique entity identifier, and CAGE code; and (4) for equipment, the entity that produced or provided the equipment with similar identifying information and whether the entity was the original equipment manufacturer or distributor. Second, FAR 52.219-28 is a Postaward Small Business Program Rerepresentation clause applicable to long-term contracts (more than five years in duration, including options) that requires contractors to rerepresent their small business status upon occurrence of novation, merger, acquisition, or at the end of the fifth contract year. The assigned NAICS code is 333415 (Air-Conditioning and Warm Air Heating Equipment and Commercial and Industrial Refrigeration Equipment Manufacturing) with a small business size standard of 1,250 employees. The contractor representation block requires the contractor to indicate whether it qualifies as a small business concern, small disadvantaged business concern, women-owned small business joint venture, economically disadvantaged women-owned small business joint venture, service-disabled veteran-owned small business joint venture, or HUBZone joint venture, with signature and date required.
