a. Group I. Definition - Data which is not otherwise essential to the contractor's performance of the primary contracted effort (production, development, testing, and administration) but which is required by DD Form 1423.
Estimated Price - Costs to be included under Group I are those applicable to preparing and assembling the data item in conformance with Government requirements, and the administration and other expenses related to reproducing and delivering such data items to the Government.
b. Group II. Definition - Data which is essential to the performance of the primary contracted effort but the contractor is required to perform additional work to conform to Government requirements with regard to depth of content, format, frequency of submittal, preparation, control, or quality of the data item.
Estimated Price - Costs to be included under Group II are those incurred over and above the cost of the essential data item without conforming to Government requirements, and the administrative and other expenses related to reproducing and delivering such data item to the Government.
c. Group III. These estimated data prices shall be developed only from those costs which will be incurred as a direct result of the requirement to supply the data, over and above those costs which would otherwise be incurred in performance of the contract if no data were required. The estimated data prices shall not include any amount for rights in data. The Government's right to use the data shall be governed by the pertinent provisions of the contract.
DD FORM 1423-1 (BACK), FEB 2001
Instructions
Overall Instructions:
* All financial data/totals should tie to the monthly data dumps from your system of record and cumulate to the costs on the ITD (Inception to Date) Actuals tab for the current POP. If your contract has multiple POPs occuring at the same time, possibly certain CLINs/SLINs extended on a particular option year yet the current POP is for a new option year, then you are required to populate two separate cost reports. Do not mix cost/actuals for different periods of performance.
* Do not change the layout/any cells in this template. You may populate the report with either formulas of your choosing or hard coded numbers but all data (monthly and cumulative) must be supported and match the monthly actuals and cum actuals on the ITD actuals tab. Spot checks will be done to ensure totals match the data. You may add comments off to the side of cells or add a comment on a particular cell to provide the COR with additional information if needed.
* All cells/totals may not need to be populated depending on the costs incurred and work being performed contract by contract. If a cell or total doesn't apply to actuals incurred, leave the cell blank or enter a $0.00 value. Columns have been provided for all cost types, even where those particular costs types might not seem reasonable, to account for any mischarging and adjustments/corrections that might need to occur.
* Before receiving this cost report, the COR should have identified and created individual tabs for each effort/system/CLIN so you are aware of the cost reporting structure. If this hasn't been done please work with your COR to create the necessary tabs before populating the report.
Program Summary Instructions:
* This tab is to be populated with totals for the entire current POP, from Inception to date through the most recent month close actuals, and also requests totals for the most recent reporting period. Example: If the current POP is 1/1/2019 - 12/31/2019 and the most recent month close was April, the reporting period is 4/1/2019 - 4/30/2019 and the Cumulative Totals should be from 1/1/2019 - 4/1/2019.
* ITD actuals/funding by Funding Type should be pulled from and total the SLIN data on each effort/system tab. You can add a formula to calculate this, create a pivot, or manually calculate. Keep in mind not all funding types will apply to all contracts.
Contract Mods Instructions:
* As each new Mod is received (award, funding increase/decrease, admin, etc) you are required to populate a new Mod box to account for changes in that Mod.
Effort/Sytem Instructions:
* The total summary box, and data on each tab, is soley for the effort/system/CLIN identified. The estimated burn out date can be calculated using a formula/theory of your choosing but you must account for actuals to date, the remaining ETC (estimate to complete), known requirements, and known cost that is expected to post (such as lagging subcontractor invoices, labor adjustments, material/ODC costs to post once received).
* Each SLIN (or funding level) must have its own data set and as you receive additional funding, create a data set box for all SLINs for each effort/system. You must also identify the Mod in which the funding was provided and the Funding Type.
* All other cells should be self explainatory but if you require additional clarification please reach out to your COR.
Notes for Cost To Be Incurred Instructions:
*Identify major cost items that have not yet hit your system of record, and therefore are not in your ITD Actuals tab, on the "Notes for Cost To Be Incurred" tab. These types of cost can include subcontractor cost that did occur in a given month but has not formally been invoiced by the sub, large material/ODC expenses that are pending to post, and any other cost impacts to the funding balance and cost to be incurred on this program. These costs should have been taken into account in your effort/system estimated burn out dates. Once any of these costs formally hit in your system and post as actuals, please remove from this tab.
Program Staff Instructions:
*Populate this tab with lines of data for each employee (prime and subs) and ensure you are populating each column. This should account for the entire program staff (no govt personnel).
Indirect Rates Instructions:
*Populate this tab with all proposed and actual indirect rates, month to month. Please add or remove where needed for the specific indirect rates for your company's charging structure.
If you have questions or require additional clarification, please reach out to your COR.
Additional Notes:
*Documentation that supports any and all cost plus, fixed price, or T&M efforts can be requested at the discretion of the Government per the FAR regarding determination of fair and reasonable costs and validation of those costs.
*Please note below the following references from your contract that relate to how the government will be evaluating your cost on a monthly basis which will also impact your annual CPAR.
G.3 POST AWARD LoE CHANGES: Proposed changes to LoE in terms of hours, labor categories or proposed LoE pricing is expressly prohibited without written consent of the Contracting Officer (KO) which will come in the form of a formal modification to the task order or a written technical guidance letter. It is the intent of the Government not to allow deviations in the LoE except in rare and exceptional cases. With this in mind, Offerors should propose with the expectation that a deviation will not be granted.
G.4 CONTRACTING OFFICER MANAGEMENT REPORT: The contractors proposed direct and indirect rates by both the Prime and Subcontractor(s) will be compared and verified through the monthly reporting required through the Contractor Name-KO Monthly Report workbook, along with the Billing Invoice and payroll support documents provided to the Government in accordance with CDRL F001 and in excel format specified in the CDRL. Awardee is required to identify any overtime hours billed in a separate column designated and provided within the
KO Monthly Report workbook. In the excel workbook, the Offeror and its Subcontractor(s) shall provide a direct mapping of proposed direct labor categories and other supporting rate information to the corresponding SSES NexGen LCATs identified in the LCAT and Unique Identifier columns located within the KO Monthly Report, CDRL F001. Offerors are required to follow the SSES NexGen LCAT/Skill Level nomenclature prescribed for each proposed NexGen LCAT and to include the corresponding unique identifier in a separate column from the SSES NexGen
LCAT. For example, the first LCAT/Skill Level identified CDRL F001 reflects Budget Analyst Entry along with the corresponding unique identifier of NG101. When completing this worksheet, the Offerors shall not include extra spaces, forward slashes, dashes, parenthesis, or anything extraneous from the prescribed format of each SSES NexGen LCAT/Skill Level and Unique Identifier format.
G.5 INVOICING FOR RATES THAT DEVIATE FROM PROPOSED RATES:
G.5.1 If in any performance period the Contractor is projecting a cost overrun in excess of 10% of the proposed estimated cost for that period which is determined to not be a result of Government direction, and not attributable to Forward Pricing Rate Agreement (FPRA) changes, this may trigger a Show Cause or Termination For Default subject to the KOs discretion.
Note: Contractors proposing at current FPRA rates and invoicing at current Provisional Billing rates will not trigger a Show Cause or Termination for Default.
G.5.2 If in performance of the task order, the Contractor incurs a cost overrun of greater than 5% and less than 10% during that Contract Performance Assessment Reporting System (CPARS) evaluation period, which is determined not to be a result of Government direction or Contractor
Provisional Billing rates, the Contractor shall receive a Marginal rating for that periods CPARs cost element. G.5.3 If in performance of the task order, the Contractor incurs a cost overrun greater than 10% during that CPAR evaluation period, which is determined not to be a result of Government direction or Contractor Provisional Billing rates, the Contractor shall receive an Unsatisfactory rating for that periods CPARs cost element.
G.5.4 In regards to cost overruns and estimated costs mentioned in paragraphs G.5.1 thru G.5.3, the Government will be comparing actual cost of work performed to estimated cost at completion. Contractors are cautioned that costs should be directly proportional to hours expended, and if in excess may be considered a cost overrun by the Government.
