3.0 Requirements

Appendix A of this PWS contains a listing of the items for repair that are applicable to this contract as well as categorization of each item according to the complexity of the item. A Cost Plus Fixed Fee (CPFF), covering sustainment support service costs, and costs submitted for repairs; and Firm Fixed Price (FFP), scaled to conduct initial Test, Inspection, and Categorization of repairs. The price to perform the Initial Test and Inspection and if product repair is required and authorized, the Repair of the item returned will be based on one of three categories in accordance with (IAW) the complexity of the item. The categories will be:

A –Is defined as having an involved technical process requiring significant labor and estimated replacement materials. This is the price associated with any repair that involves two or more subcomponents.

B –Is defined as having a typical failure common to the system with a known course of action (COA), materials and labor. This involves no more than one subcomponent.

C –Is defined as being fixed easily with simple actions.

Each period of performance will be 12 months.

The items listed in Appendix A are annotated with the appropriate category code.

3.1 Repair/Refurbishment Process

Upon receipt of an item(s) returned for repair/refurbishment and authorization from the Procuring Contracting Officer (PCO), the Contractor shall perform Initial Test & Inspection (T&I). Based on the T&I findings, the article shall be processed in accordance with paragraph

3.3 of this PWS.

Annual T&I and repair task orders are contemplated to enable an efficient and effective processing of articles for induction and final disposition.

3.2 Defense Contract Management Agency (DCMA) Concurrence

The Contractor shall present all T&I and Repair deliverables to DCMA for Government source inspection and acceptance prior to final disposition. All equipment on the JTT program that has any visible damage showing signs of misuse, mishandling, or abuse and expressly excluding normal wear and tear, is reviewed by the program Quality Engineer and DCMA. All damage is documented on a Report of Discrepancy (ROD), including photos of damage, and both parties sign.

3.3 Initial Inspection, Test & Inspection (T&I) and Repair

3.3.1 Initial Inspection

Upon receipt of an unserviceable item and the associated authorization from the Government, the Contractor shall proceed with inducting the item into the repair and maintenance program established in this contract, unless the item is covered under warranty. The Contractor has 30 days to perform an initial inspection of the item to verify identity, physical damage, mishandling, damage from irresponsible use, and completeness (i.e., no missing parts), as a minimum.

3.3.2 T&I

Following the initial inspection, the Contractor shall test the item, as needed, to determine the cause of failure. The Contractor shall classify the repair in one of the following three categories: Repairable, Beyond Economical Repair (BER), or No Evidence of Failure (NEOF). The definitions below apply to the categories. The contractor has a 30 day turnaround time to Test & Inspect each returned asset. Turnaround time shall commence upon receipt and induction of article and culminate upon Contractor completion of Test & Inspect efforts. Refer to Appendix B for shipping instructions by category Contractor will notify Contracting Officer Representative (COR) before any asset is shipped for approval.

3.3.2.1 Repairable

An item that, in the course of operation and use, is found to be non-functional or inoperable, does not satisfy its intended function, and/or does not perform within its design specifications. The repair process for an unserviceable item typically consists of troubleshooting, evaluating, repairing, and verifying its performance (recertification). Once an item is determined to be repairable, the Contractor shall notify the COR of repair determination and shall promptly induct article into repair after acceptance of the T&I CLIN, and conditioned upon availability of contract repair funding. When repair funding is not available, the PCO shall be so notified of funding needs prior to repair induction.

3.3.2.2 Beyond Economical Repair (BER)

An item whose damage is so extensive that repair of the item is impossible or economically impractical. Economically impractical means the cost of repair would exceed 65% of the acquisition price of a new item. Once an item is determined to be BER, the Contractor shall provide a determination of findings to the PCO and Contracting Officer Representative (COR) within 20 working days of determination with request for final disposition. This document shall provide supporting information that the repair price will exceed 65% of the contract’s negotiated acquisition price. After reviewing the determination of findings, the Government will decide on disposition of the item. The Government will inform the Contractor whether the item is to be scrapped in-place, sent for disposition as BER, according to instructions to be provided by the Government, or repaired despite the cost exceeding the BER threshold. The price of the BER will remain as established in the authorizing T&I CLIN unless the Government elects to proceed to repair, which shall be subject to repair change proposal and funding.

In the event that the Repair article exhibits any of the following conditions, such repair article may be recommended as Beyond Economical Repair (BER) without regard to acquisition cost:

• Material obsolescence, supplier discontinuance, or diminishing manufacturing resources for repair materials;

• Catastrophic damage arising for any reason including but not limited to fire, crash, immersion, internal electrical damage, etc.;

• Any condition that would render article beyond physical repair.

If one of these instances occurs, the Government shall be notified of Contractor’s Beyond Repair recommendation and article shall be placed on hold pending receipt of Government authorization and disposition instructions on the existing CLIN at the established price.

3.3.2.3 No Evidence of Failure (NEOF)

An item that is inspected, tested, and deemed to not require any repairs. The item is found to be fully functional, operable, satisfies its intended function, and performs within its design specifications. Once an item is determined to be in this category, the Contractor may charge the T&I fees to the Government. The Contractor shall promptly notify the COR and article shall be presented for acceptance and shipped in accordance with the NEOF disposition instructions IAW appendix B.

3.4 Repair/Refurbishment

The Contractor shall furnish the labor, materials, and equipment necessary to accomplish the inspection, test, repair, and verification of unserviceable items.

3.4.1 Form, Fit, and Function

The Contractor shall repair unserviceable items such that, following the repair, the item’s form, fit, function, and interface performance enable the JTT IBS to satisfy the requirements specified in document number 3014-0004 revision E dated 28 August 2017.

Best commercial practices shall be used where no overriding requirements existed. The Contractor shall use materials for repair as authorized in the current JTT technical data package with serviceability demonstrated by successful acceptance test.

The software configuration in the repair article delivery shall be the latest certified version released to the Contractor by the Government and verified by Contractor for production release. The effort to verify and implement the certified software into DRS’s production test environment will be authorized under paragraph 3.11 Technical Services.

3.4.2 Finishing and Marking

The Contractor shall repair all damaged protective finishes to the extent necessary to provide adequate protection during usage. The Contractor shall replace damaged markings, identification, and decals. Minor cosmetic finish defects, scratches, nicks, or dents, not considered to affect the installation or operation of the repaired item, shall not require correction.

3.4.3 Repair Turn-Around Time (RTAT)

3.4.3.1 Repair

Is defined as the time from Contractor induction after T&I CLIN acceptance, of an inoperative unit that has been determined to be reparable through Government DD250 acceptance of repair. The Contractor repair turnaround time (RTAT) is 120 days for category A, 90 days for category B, and 60 days for category C to repair each asset provided the material to repair is available. This time does not include time delays caused by the government. In the event the Contractor cannot make the necessary repairs within the required RTAT, the Contractor shall provide e-mail notice of any delay shall be given to the PCO and COR at the time delay becomes known.

In the event that a Work Stoppage event occurs during repair performance, the Government will be so notified and the contract delivery date promptly extended at no cost to either party.

a) Material availability for parts and/or assemblies necessary to implement repair, provided Contractor’s efforts to procure parts were performed in a timely manner;

b) Excessive procurement lead-time for parts and/or assemblies necessary to implement repair arising from market availability, to include diminishing manufacturing resources, obsolescence, supplier capacity constraints, demand surge or other such conditions outside of Contractor’s control.

c) Delay arising from receipt of requested contract direction and/or disposition instructions.

d) GFE delays arising from equipment availability, downtime, interference, and excessive capacity needs.

3.4.3.2 RTAT Breach

As soon as it is determined that a repair will exceed the repair Turn-Around Time (TAT) the contractor shall notify the COR within 24 hours. The contractor shall provide justification for the extended repair TAT. Based on the justification, the COR may grant relief from the “Poor” performance rating for the repair (e.g., if the

Government were responsible for task execution delays during the measurement period).

3.4.4 Expedited Repair and Shipment

The Government reserves the right to request the Contractor expedite repairs and shipments, with the desired repair TAT specified in the request. In the event the Contractor cannot comply with an expedited repair request, the Contractor shall notify the PCO and COR, and provide supporting rationale along with an alternative repair

TAT.

3.4.5 Over And Above Work Request

At any time during the course of repair performance under this Order, if the Repair activity required to return article to operational capability will exceed a normal repair based on the definitions set forth in this PWS, such additional effort shall be deemed to be Over and Above and will be subject to Over and Above Work Request (OAWR). The Contractor shall promptly notify the Government of such determination and all effort shall cease pending receipt of contract authorization to proceed. The Repair TAT shall likewise be suspended pending receipt of authorization and funding.

The Parties agree to work in good faith to reach mutual agreement on OAWR within 60 to 90 days of notification. If the Government elects not to proceed with repair, the Government shall provide disposition instructions for return shipment or scrap in accordance with Plant Clearance Automated Reutilization Screening System (PCARSS).
