About this file

This is an Annual Affidavit document required by the Commonwealth of Kentucky for all bidders, offerors, and contractors seeking state contracts. The affidavit serves as a sworn statement of compliance with Kentucky campaign finance laws and related statutory requirements. The document does not specify particular products, services, quantities, or project details, as it functions as a general compliance certification applicable across all state procurement opportunities. The affidavit has a maximum length of one year and must be renewed annually. Bidders and contractors are required to acknowledge their understanding of compliance obligations and notify the Finance and Administration Cabinet, Office of Procurement Services immediately if they become non-compliant during the affidavit effective period.

The affidavit requires certification of multiple statutory compliance areas, including adherence to Kentucky campaign finance laws (KRS 45A.110 and KRS 45A.115), proper disclosure and compliance with conflict of interest provisions (KRS 45A.485), current registration with the Kentucky Department of Revenue for sales and use tax collection, and non-delinquency on state taxes and fees. For non-bid contracts specifically, additional certifications are required regarding campaign contributions to gubernatorial candidates and elected officials with jurisdiction over the contract award, with limits specified in KRS 121.056, KRS 121.150, and KRS 121.330. Signatories must be duly authorized representatives who have fully informed themselves of the accuracy of all statements and acknowledge that the Commonwealth relies on these certifications in making contract award decisions. The document must be notarized and is subject to verification at any time during the contract period, with potential consequences for non-compliance including contract termination, repayment of funds, and other available legal remedies.
