About this file
This is an Annual Affidavit form required by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state procurement opportunities. The affidavit serves as a compliance document with a maximum effective period of one year and must be executed under penalty of perjury by a duly authorized representative of the bidding entity. For all bids and contracts, signatories must confirm compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), disclosure requirements under KRS 45A.485, sales and use tax registration with the Kentucky Department of Revenue, non-delinquency on state taxes and fees, and adherence to prohibitions outlined in KRS 11A.236 over the previous ten years. The affiant must also acknowledge that the Commonwealth is relying on the accuracy of all statements and agrees to notify the Finance and Administration Cabinet, Office of Procurement Services immediately upon any non-compliance during the affidavit effective period.
For non-bid contracts such as sole-source, non-practical-to-bid, or emergency contracts, additional affidavit requirements apply. Contractors and their immediate family members with 10 percent or greater business interest must comply with gubernatorial campaign contribution limitations under KRS 121.056 and KRS 121.150. Further restrictions under KRS 121.330(1) and (2) prohibit contractors, their officers, employees, and affiliated entities, along with spouses of such individuals, from knowingly contributing more than $5,000 in aggregate to campaigns of elected candidates with jurisdiction over the contract award. Additional provisions under KRS 121.330(3) and (4) prohibit direct solicitation of contributions exceeding $30,000 in aggregate for such campaigns. The affidavit must be notarized and includes fields for vendor code, company information, and notary commission expiration details.
