3.7.3 Definitions

3.7.3.1 Hazardous Waste shall be defined as any solid waste that exhibits hazardous characteristics or is listed as defined by RCRA. Any solid waste intended to be discarded by the Contractor shall have a waste determination made as to whether or not the waste meets these hazardous characteristics or is listed. The physical properties of hazmats used by the Contractor shall be used by the government to initially determine whether or not hazardous waste can be expected to be generated by the use of a hazmat. The Contractor shall sample and analyze any wastestream in accordance with RCRA sampling requirements if the Contractor disputes any government waste determinations.

3.7.3.2 Empty Containers shall be defined by RCRA as containing less than one inch of residue in the bottom of a 55-gallon drum, as containing no more than film residue in smaller containers, and, for aerosol cans, as containing no propellant or product. Empty containers, by definition, are not hazardous waste. Some containers, by virtue of their shape and the properties of the hazmat contained, cannot be emptied (i.e. cartridges, tubes, etc.), but those that can be emptied shall be emptied through physical means by the Contractor so that all material is used.

3.7.4 Project Specific Hazardous Waste Management Plan (HWMP)

3.7.4.1 Prior to the use of any hazmat identified through submittal approval as potentially generating hazardous waste, the Contractor shall submit for approval to the Contracting Officer a project specific Hazardous Waste Management Plan (HWMP) (ref. submittal 3.7.2.1) describing how the Contractor plans to meet regulatory requirements for the proper collection, storage, labeling, secondary spill containment, signage, accumulation time, inspection schedules, transportation, and disposal of hazardous waste generated by the Contractor during the performance of the work under this project / task order, under this contract.

3.7.4.2 This Plan shall include:

3.7.4.2.1 the location and layout of the site to be established for the temporary storage of HW (hereafter referred to as a Satellite Accumulation Point ( SAP) ) - the site shall be located at or near the point of generation where waste initially accumulates, and under the control of the operator of the process generating the waste, in accordance with RCRA

SECTION 01 56 00 Page 13 regulation ( 40 CFR262.15(a) ) ;

3.7.4.2.2 the name of the designated person responsible for waste management activities and inspections of the SAP and container(s) within the SAP (to be known as the SAP site manager) and a current certificate of training indicating that the designated person has had RCRA Hazardous Waste training (reference 40 CFR 262.16(b)(9)(iii));

3.7.4.2.3 the specific procedures to be followed by Contractor personnel to collect, store, label, transport and dispose of hazardous waste (and the personnel training thereof);

3.7.4.2.4 the procedures to be followed by Contractor personnel to respond to a spill of hazardous waste, either from a container or from the SAP area;

3.7.4.2.5 the name, address, phone number and EPA ID number of the permitted Treatment, Storage and Disposal Facility (TSDF) to be used for the disposal of the hazardous waste, and a point of contact name and phone number; the chosen TSDF shall not be under consent order, cleanup order or have a recent history of operational violations, as recorded by the EPA database ECHO (Contractor may choose to use the same TSDF as the government, upon request, so that the government will provide this information to the Contractor);

3.7.4.2.6 the name, address, phone number and EPA ID number of the hazardous waste transporter to be used to transport the waste from Dobbins ARB to the TSDF, and a point of contact name and phone number (Contractor may choose to use the same hazardous waste transporter as the government, upon request, so that the government will provide this information to the Contractor);

3.7.5 Hazardous Waste Generation, Collection and Storage

3.7.5.1 No more than a cumulative total of 55 gallons of hazardous waste shall be allowed to be collected and stored in a SAP at any given time;

3.7.5.2 An accumulation log for each waste collection container stored within the SAP shall be used to record every addition of waste to each container, identifying the waste by name and description, the approximate amount added to the container, and the data added;

3.7.5.3 Every container stored within the SAP shall be uniquely numbered to enable its identification separately from other containers that may be stored concurrently;

3.7.5.4 Containers used to collect, store and transport hazardous waste shall be new, United Nations (UN)-certified hazardous waste shipping containers. Container materials shall be compatible with the hazardous waste being collected and stored within the container. Containers shall be filled to no more than 95% capacity to allow for headspace and expansion.

3.7.5.5 Containers shall be labeled "Hazardous Waste", and the label shall include the name of the wastestream and the applicable EPA Waste Codes. Container shall be labeled with an indication of the hazards of the contents ( e.g. OSHA GHS Pictograms; reference 40 CFR 262.15(a)(5) ) .No accumulation start date shall be recorded on the label until the container
