text: The National Industrial Security Program Operating Manual (NISPOM) (32 CFR Part 117), dated 24 February 2021 applies.

Contractor will reference the appropriate security classification guidance when generating or deriving classified material or hardware. All classified information received or generated will be properly stored and handled according to the markings on the material. All classified information received or generated is the property of the U.S. Government. At the termination or expiration of the contract, the U.S. Government will be contacted for proper disposition instructions. Contractor will abide by and shall apply derivative classification and markings governed by the current version of the following security classification guidance:

Security classification guidance will be provided to the contractor under separate cover.

Prior to declassifying or downgrading information marked with a date or event on the "declassify on" line: The Contractor will confirm the OCA has not extended the classification period by reference to the applicable Security Classification or Declassification Guide or by consulting with the Program Office with the OCA.

Task ordering could require additional security classification guidance. Additional security classification guidance will be provided, maintained, and used by the contractor as required. Security classification guidance on information, hardware, and equipment not included in the security classification guides will be furnished to the contractor through the authorized contracting officer or authorized representative at the time the contractor is tasked with a classified project, furnished information, hardware, equipment or when classification changes occur.

The Contractor will notify the Program Security Officer (PSO), Government Contracting Activity, and Government Program Manager within 24 hours of any incident involving the actual or suspected compromise/loss of classified information to enable the Government to conduct immediate assessment of potential impact pending formal inquiry/investigation. Actual or suspected compromise of Covered Defense Information will be reported IAW DFARS Clause 252.204-7012.

SENSITIVE INFORMATION. Sensitive information is information that if lost, misused, compromised, or accessed by unauthorized persons could adversely affect the United States’ national interest, the conduct of DoD programs, or the privacy of DoD personnel. It comes in many forms such as personal data under the Privacy Act, personnel records, privileged data (chaplain and judge advocate records), investigative data, scientific and technical information, export controlled data (critical technologies), proprietary data, or CUI data. Sensitive information meets the criteria for exemption from mandatory public disclosure under the Freedom of Information Act.

Sensitive information must be protected. During working hours, reasonable steps must be taken to minimize risk of access by unauthorized personnel. After working hours, sensitive information can be stored in unlocked containers, desks, or cabinets if Government or Government-contract building security is provided. If Government or Government-contract building security is not provided after working hours, sensitive information shall be stored in locked desks, file cabinets, book cases, locked rooms, or similar items. Storage in a safe designed to secure classified information is not required. Sensitive records may be destroyed by any method that will prevent disclosure of contents or reconstruction of the document. For paper items, strip shredding is recommended with 3/16” being the maximum strip width.

The use of cellular phones, hand-held radios, beepers/pagers, cordless telephones, cordless microphones, and all wireless electronic devices shall be addressed in the Standard Operating Procedures (SOP) of the Information Security (IS) procedures for each computer facility where classified processing is accomplished.

International Security Requirements: Contract performance/tasking could require contact and involvement with foreign nationals and/or their representatives. Contractors must comply with export control laws, the 32 CFR Part 117 (NISPOM), and any clauses in the contract along with the Statement of Objectives (SOO)/Statement of Work (SOW)/Performance Work Statement (PWS).

Ref 10.a: COMSEC safeguarding requirements apply. See the 32 CFR PART 117/NISPOM, Section 117.21 for details. Access to COMSEC information is restricted to U.S. Citizens holding a final U.S. government clearance at the appropriate level. Personnel must receive the required COMSEC briefing. Prior approval is required from the Government Contracting Activity prior to granting access to COMSEC information to a subcontractor.

Ref 10.a, 11.h, and 11.i: For COMSEC and TEMPEST requirements and guidance see Attachment TEMPEST and COMSEC Requirements.

Ref 10.e.(1): All intelligence information required for this contract will be handled in accordance with special security requirements provided in the SCI Attachment and regulations listed in 13b. Prior approval of the contracting activity is required for subcontracting. Access to intelligence information requires special briefings and a United States Government clearance at the appropriate level. Contractors will complete the customer-provided Intelligence Oversight training as required by customer requirements and will report any Questionable Intelligence Activity (QIA), Significant/Highly Sensitive Matter (S/HSM), and/or Federal Crimes IAW procedures established in DoD Directive 5148.13, Intelligence Oversight, and AFI 14-104, Intelligence Oversight. For contracts involving cryptographic matters in addition to DoDD and AFI reference, USSID 18, Legal Compliance and US. Persons Minimization Procedures.

Ref 10.e.(2): Contractor will require access to intelligence information and must comply with directions provided by the Contracting Officer’s Representative (COR). The contractor is authorized access to SECRET//NOFORN information as it is required to support performance of assigned tasking for the designated program. The Program Manager has determined that disclosure does not create an unfair competitive advantage for the contractor or a conflict of interest with the contractor’s obligation to protect the information. The COR will identify what intelligence information is required for the contractor to satisfy the contract and will submit that information to the servicing Senior Intelligence Officer (SIO) for approval prior to granting access. Contractors will complete the customer-provided Intelligence Oversight training as required by customer requirements and will report any Questionable Intelligence Activity (QIA), Significant/Highly Sensitive Matter (S/HSM), and/or Federal Crimes IAW procedures established in DoD Directive 5148.13, Intelligence Oversight, and AFI 14-104, Intelligence Oversight. For contracts involving cryptographic matters in addition to DoDD and AFI reference, USSID 18, Legal Compliance and US. Persons Minimization Procedures.

Ref 10.g: To facilitate potential access to NATO classified information, all DoD military, civilian, and contractor personnel who are briefed on their responsibilities for protecting U.S. classified military information, shall also be briefed on the requirements for protecting NATO information. NATO briefing required prior to granting access. See 32 CFR Part 117 section 117.19 (g) (7) for details.

Ref 10.g.: Access to JWICS and CWAN is authorized. JWICS and CWAN users shall be briefed to NATO Secret IAW the 32 CFR Part 117 section 117.19 (g) (7), prior to access.

Ref 10.h: The contractor is permitted access to Foreign Government Information in performance of this contract. Access to Foreign Government Information requires a valid need- to-know and final U.S. Government personnel security clearance (interim or final). Prior approval of the contracting activity is required for subcontracting.

Ref 10.j: The contractor shall comply with DoDI 5200.48_DAFI 16-1403, Controlled Unclassified Information, DoDM 5200.01, Vol 1_AFMAN 16-1404, Vol 1, Air Force Information Security Program, and DoDM 5400.07-Air Force Manual 33-302, DoD Freedom of Information Act (FOIA) Program. The contractor shall monitor CUI aggregation and compilation based on the potential to generate classified information pursuant to security classification guidance addressing the accumulation of unclassified data or information.

Ref 10.k: Access to Secret Internet Protocol Router Network (SIPRNET) is authorized. SIPRNET users shall receive the Air Force North Atlantic Treaty Organization (NATO) Security Awareness Briefing and sign an acknowledgement prior to SIPRNET access. A formal NATO briefing is required when 1) the SIPRNET enclave, or other classified networks, is approved for NATO and no additional security measures are in place to preclude access or 2) Access to NATO information is authorized. Formal NATO briefings shall be accomplished IAW the 32 CFR Part 117 section 117.19 (g) (7).

Ref 10.k: STINFO information/documents required during contracting RFP Solicitation process shall be reviewed by the controlling DoD office of the information under request by contracting officer. The controlling office in conjunction with the contracting officer will determine if the STINFO distribution statement identifying information as unclassified (distribution B-F only) can be changed or removed by the controlling DoD Office prior to release to contractor through the solicitation process IAW DFARS 204.73; PGI 204.7303-1 General.

Ref 10.k: JWICS access is required for contractors working on a government installation. Access to JWICS, CWAN and SCWAN is authorized. Users of these systems shall be briefed to NATO Secret IAW the CFR Part 117 section 117.19 (g) (7).

Ref 11.c: Any classified information generated in the performance of this contract shall require the contractor to apply derivative classification and markings consistent with the source material.

Ref 11.d: The contractor must provide adequate storage for classified hardware and materials to the level of TOP SECRET which because of size or quantity cannot be safeguarded in an approved General Service Administration (GSA) approved security container.

Ref 11.h: A COMSEC account will be established and COMSEC will be protected per the 32 CFR PART 117/NISPOM, Section 117.21.

Any transfer or processing of classified or sensitive information via electronic methods (e.g. facsimile, telemetry, voice, computer) must be protected by implementing an appropriate combination of countermeasures such as encryption devices and sound practices and procedures. Specific countermeasures used must be coordinated by the project manager for approval through the appropriate communications activity.

The contract can require access to Government AIS in Categories IT-I, II, and III. At a minimum, contractor employees must be the subject of a favorable Single Scope Background Investigation Tier 5 (T5) investigation if granted access and performing in Category IT-I positions. For Category IT-II positions, at a minimum, contractor employees must be the subject of a favorable National Agency Check and Local Agency Check Tier 3 (T3) investigation. For Category III positions, contractor employees must be the subject of a favorable National Agency Check with Inquiries Tier 1 (T1) investigation. In the event the investigation is not adjudicated favorably, unit commanders are responsible for suitability determinations. Ref 12: Contractor is to submit requests through the Contracting Officer for OPSEC Program Manager review and public release authorization. The Contracting Officer will provide contractor with written approval/disapproval. Information requiring AF or DoD-level review will be forwarded by the entry-level public affairs office through the AFIMSC Public Affairs Office to the Secretary of the Air Force, Office of Public Affairs, Security and Review Division (SAF/PAX), 1690 Air Force Pentagon, Washington DC 20330-1690. Prior approval of the contracting activity is required for subcontracting. Access to intelligence information requires special briefings and a United States Government clearance at the appropriate level.

Explain and identify specific areas and government activity responsible for inspections.: Inspection oversight of all Air Force COMSEC materials is limited to the supporting COMSEC Account Manager, AFNIC/EVEI, and AFMC/CA624600.

Defense Counterintelligence and Security Agency (DCSA) is carved out of all inspection responsibility for SAP performance under this contract. OSI PJ retains security cognizance for all SAP performance as well as collateral information used in the development of SAP information/materials under this contract.

Ref Item 10.e.(1): AFLCMC/INMS, 101 West D Ave., Suite 102, Eglin AFB, FL, 32542-6830 has exclusive security responsibility for all SCI classified material released or developed under this contract. See SCI Attachment, Item 13.a.

Ref Item 10.e.(2): AFLCMC/INMS, 101 West D Avenue, Suite 102, Eglin AFB, Florida, 32542-6830 has exclusive security responsibility for all SCI classified materials released or developed under this contract. See SCI Attachment, Item 13.a. The Defense Counterintelligence and Security Agency (DCSA) retains review responsibility for all Non-SCI materials released or developed under this contract off Government installations.

Ref 10.f.: The Defense Counterintelligence and Security Agency (DCSA) has been relieved of inspection oversight responsibilities for SAP programs associated with this contract. The Air Force is identified as the Cognizant Security Authority (CSA) with the AFOSI PJ fulfilling the execution role for all contractor inspections under the purview of SAF/AAZ.
