About this file

This is a self-certification representation form for Indian Economic Enterprises (IEE) responding to solicitations issued by the Indian Health Service under the Buy Indian Act authority.

The form requires offerors to self-certify that they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined in HHSAR 326.601. Offerors must meet this eligibility requirement at three critical junctures: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any contractor that no longer meets eligibility requirements during these periods must immediately notify the Contracting Officer. The form applies to Sources Sought Notices, Requests for Information (RFI), and formal Solicitations. Successful offerors must also be registered with the System of Award Management (SAM) and may be required to provide documentation of eligibility before award. The representation requires the offeror to indicate whether it does or does not meet the IEE definition, with signature certification from the 51% owner of the firm. Required information includes the name of the federally recognized tribal entity, business name, DUNS number, and certifying official's printed name. False or misleading information submitted in connection with a Buy Indian Act set-aside award violates 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
