About this file
This document is an addendum to FAR 52.212-2 establishing evaluation criteria for a federal contract solicitation for commercial products and services. The Government will award the contract to the responsible offeror whose offer is most advantageous based on lowest price technically acceptable consideration. Offerors must submit complete technical quotes addressing all requirements in the Performance Work Statement (PWS); partial quotes will be deemed technically unacceptable and eliminated from consideration. If subcontractors are proposed, offerors must provide subcontractor location, point of contact, and demonstration of ability to meet PWS requirements.
The evaluation utilizes a simplified process with a single non-price factor: Factor 1, Eligibility – Technical Acceptability. Offerors must demonstrate knowledge, understanding, and technical ability to successfully perform and manage PWS requirements, with demonstrated ability meeting or exceeding RFQ specifications. Quotes receive either an "Acceptable" rating (meeting minimum technical requirements) or "Unacceptable" rating (not meeting minimum technical requirements), with unacceptable quotes eliminated from further evaluation. Only the lowest-priced, technically acceptable quote will receive the official SF1449 form for award consideration. Option prices will be evaluated by adding total option prices to basic requirement prices, and the Government may reject offers with significantly unbalanced option pricing. Award is established through written notice of award within the offer's specified acceptance period, creating a binding contract without further action required.

Addendum to FAR 52.212-2 Evaluation—Commercial Products and Commercial Services.
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, lowest price technically acceptable considered. The following factor shall be used to evaluate offers.
Factor 1, Eligibility: Technical Acceptability- The Offeror shall demonstrate its ability to provide all the requirements addressed in the PWS by submitting a technical quote that clearly describes how they will meet it. Submitting only a pricing quote may eliminate you from potential award. If a subcontractor is proposed, Offeror shall provide details of its subcontractor (location and point of contact) as well as the subcontractor’s ability to demonstrate its ability to meet the services addressed in the PWS.
For evaluation and awarding purposes, to be considered technically acceptable, an offeror must quote all requirements identified in the PWS and submit a technical quote that clearly describes how you will meet
it. Partial quotes will not be reviewed and will be deemed technically unacceptable. Only the Offeror with the lowest and technically acceptable quote will be sent the official SF1449 for review/award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Beforethe offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
The Government will evaluate said quotations in a simplified process (efficient and minimally-burdensome fashion) using the below, evaluation criteria consisting of non-price factors and price factors.
The Government will determine which offerors propose the best value to the Government based on their demonstrated ability(ies) and capability(ies) in relation to this requirement as well as their demonstrated feasibility of successful implementation of said requirement.
The Government reserves the right to reject any quotation that’s non-compliant with the solicitation, unreasonable, or doesn’t comprehend the complexity or risks associated with the work to be performed.
Factor 1, Eligibility – Technical Acceptability
The Government will evaluate whether the Offeror demonstrated its ability to provide all the required services addressed in the PWS to include its subcontractor (if proposed). To be found “Acceptable,” the Offeror’s quote must effectively demonstrate its knowledge, understanding, and technical ability to successfully perform and manage the requirements of the PWS. The Offeror's demonstrated ability must meet/exceed the specifications provided within this RFQ to be further considered for award.
The Government will use the below ratings for this factor to assess its level of confidence in the Offeror’s technical ability to successfully fulfill/satisfy ATF’s requirement. If the Offeror receives and “Unacceptable”, the Offeror’s quote will not be further evaluated.
Rating Description Acceptable Quote meets the minimum technical requirements of the RFQ.
Unacceptable Quote does not meet the minimum technical requirements of the
RFQ.
