About this file

This document is a Zoning Permit application for the City of Flint Planning & Zoning Department, specifically for a project at Mott Community College located at 1401 E. Court St. The project involves removing the existing parking garage and elevated pedestrian walkways, and replacing them with a surface parking lot within the building footprint, mill and replace the remainder of asphalt parking lot. The zoning permit application (ZP 25-86) was submitted by Rod Whitney, Executive Director of Facilities Services for Mott Community College, and was dated 6/5/2025 with a fee of $375 for commercial use. The property is zoned as IC (Institutional Campus) and the applicant is seeking a waiver for outdoor lighting requirements under Section 50-74(C)(2).

A waiver determination letter was issued on 7/17/2025 by Brian Acheff, Zoning Coordinator, granting relief from the lighting ordinance. The waiver was approved because the site is an institutional campus with no nearby residential uses, and the slight exceedance in footcandle measurements was deemed acceptable. The zoning staff supported the need for a well-lit parking area. The permit application was approved with the note that the contractor must obtain a Demolition Permit from the City of Flint Building and Safety Inspections Department before proceeding with work. The primary contact for the project is Dan Bartlett from ROWE Professional Services Company, who is listed as the engineering consultant.

Waiver Determination Letter

To:

RE: MCC Parking Garage Demolition & Redevelopment Photometric Plan Waiver

This letter serves as a formal determination regarding the requested photometric plan waiver for the project ZP 25-86 located at 1401 E. Court St, Flint, MI 48503.

The applicant is seeking relief from §50-65(C)(2) of the City of Flint Zoning Ordinance (Ordinance) as there are several areas along the parcel lines of the subject property that exceed the allowed maximum footcandles of 1.0; per the aforementioned section of the Ordinance “The intensity of light within a site shall not exceed ten (10) footcandles within any part of the site and one (1) footcandle at any lot line, except where it abuts or faces a residential Zone District or residential use, a maximum of 0.5 footcandles is permitted.”

Based on the response given by the applicant and due to the location, size, and nature of the site, the small exceedance in footcandles is warranted as the need for a well-lit parking area can be supported by City zoning staff. Further the land use of the site and the areas adjacent are institutional campus in nature with no residential uses within proximity, therefore a small exceedance in footcandles from the proposed lighting would not be detrimental or a nuisance. Waiver Granted

For any questions regarding this waiver determination please contact City of Flint zoning staff at

Respectfully, Brian Acheff Zoning Coordinator mailto:bacheff@cityofflint.com
