About this file
This is an Exception to Fair Opportunity (EFO) determination document for a non-competitive procurement by the U.S. Pacific Fleet. The procurement is for Cable TV and Internet services (Fiber Connect Plus) to be provided to U.S. Pacific Fleet Headquarters located at 250 Makalapa Drive, Pearl Harbor, Hawaii 96860. The requirement period of performance runs from July 1, 2026 through June 30, 2027, with an estimated start date of 07/01/2026 and end date of 06/30/2027.
The government seeks a contractor capable of providing continuous and uninterrupted cable television and high-speed internet access service 24 hours per day, 7 days per week to multiple buildings within the Pacific Fleet compound. The services must be delivered via secure, hardwired fiber optic connections and include five dedicated public access channels for government-originated military public affairs programming. The EFO justifies single-source procurement under 41 U.S.C. 1903 as implemented by FAR 13.106 1(b)(1)(i) citing "One Source Reasonably Available." The determination asserts that Spectrum (Charter Communications Operating LLC dba Spectrum) is the only qualified provider capable of meeting security requirements, historical district restrictions prohibiting new fixture installations, and technical infrastructure needs. The document notes that Spectrum's Fiber Connect Plus cable service has been discontinued, necessitating immediate service restoration. All required certifications and approvals sections are included, with technical certification dated 05/21/2026 and contracting officer signature dated 06/10/2026.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED ON THE FOLLOWING:
A. ONLY ONE RESPONSIBLE SOURCE Yes
1. Restrictive Rights No The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. Exclusive Licensing Agreements No The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. Other Reasons Yes Provide details on mission impact if requirement is not solicited from only one source
Spectrum TV is the only qualified and authorized provider capable of delivering both cable television and internet access through secure, hardwired fiber optic connections to all required areas within the U.S. Pacific Fleet compound. This capability is critical to maintaining operational security and meeting stringent security protocols that no other provider currently satisfies. The existing, government approved infrastructure for cable TV and internet services throughout the compound is exclusively owned and maintained by Spectrum. This infrastructure fully complies with all security criteria and operational requirements, making Spectrum uniquely positioned to continue uninterrupted service delivery.
Hardwired fiber connections are an absolute necessity due to strict prohibitions against modifying or installing fixtures on buildings located within designated historical districts - restrictions that are rigorously enforced across JBPHH and the Makalapa compound. Satellite or wireless alternatives are not viable, as they cannot meet either the regulatory constraints or the security standards required.
Moreover, the requirement includes five dedicated public access channels that allow the government to originate and distribute mission essential military public affairs programming from JBPHH facilities to all cable locations across the compound. This capability is indispensable for broadcasting authoritative content, and it is technically infeasible for satellite-based providers to replicate this service.
Previous inquiries to Hawaiian Telcom confirmed they are not licensed to provide cable TV services to Navy military offices and public spaces on base. Their only alternative - premium fiber internet to support third-party streaming - would require substantial capital investment and would not provide the secure, integrated cable TV solution essential for government operations.
These public access channels are vital for maintaining situational awareness by delivering real time global news feeds and source data necessary for informed strategic decision-making. Spectrum’s existing fiber infrastructure throughout the compound drastically reduces upfront costs and eliminates the risk and delay associated with new installations. Additionally, NAVFAC currently prohibits any other providers from installing new lines, cementing Spectrum’s exclusive position.
It is imperative to note that Spectrum’s Fiber Connect Plus cable service has been discontinued, necessitating immediate restoration of service. The operations floor and Flag Officers depend on uninterrupted access to Spectrum Fiber Connect cable TV and its associated news channels to remain fully informed of global events impacting operational decisions. This requirement carries 4-Star visibility, underscoring its critical importance to national security and command readiness.
In sum, Spectrum TV’s proven, secure, and fully compliant infrastructure is the only viable solution to meet the Pacific Fleet’s critical communications and information dissemination requirements efficiently, securely, and without disruption.
B. BRAND NAME No
Item required must be a brand name product, or feature of a product, particular to one manufacturer. Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government's requirements and why a "brand name or equal" purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies' similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency's needs
C. UNUSUAL AND COMPELLING URGENCY No
The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government's requirements and why a "brand name or equal" purchase description cannot be used (see FAR 11.1014). Describe how market research indicates other companies similar products and products lacking the particular feature do not meet, or cannot be modified to meet, the agency's need.
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance: 07/01/2026 to 06/30/2027
3. Explanation of why delivery/commencement of services by the date mentioned above is required: Explain the impact to the mission if the date above is not met, any special circumstances or conditions that exist which validate the requirement as "urgent," estimated production lead time for the item, etc.
4. If appropriate, include any additional pertinent information:
