About this file
This document is an Addendum to Solicitation Provision 52.212-2 for Commercial Products and Commercial Services. The government intends to award a single firm-fixed-price contract to the most advantageous quoter, with the intent to award without discussions. Quoters are expected to submit their most favorable terms.
The evaluation will be based on three factors: Technical Capability (rated from Outstanding to Unacceptable), Past Performance (rated from Substantial Confidence to No Confidence), and Price. Technical and past performance, when combined, are considered more important than price. The price evaluation will assess reasonableness through comparisons with other quoters and independent government estimates. The government will evaluate total pricing by adding both base requirement and option prices, with the ability to determine an offer unacceptable if option prices are significantly unbalanced. A written notice of award within the specified acceptance time will result in a binding contract.

Addendum to 52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021)
The Government intends to award a single firm-fixed-price contract to the responsible quoter whose quote represents the best value after evaluation in accordance with the factors in the solicitation.
The Government intends to award a contract without discussions with quoters. Accordingly, each quoter should submit its most favorable terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
The following factors shall be used to evaluate offers:
Factor 1: Technical Capability
Technical Capability will be evaluated as follows:
Adjectival Rating Description Outstanding Proposal demonstrates an exceptional approach and understanding of the requirements, contains multiple strengths and/or at least one significant strength.
Good Proposal demonstrates a thorough approach and understanding of the requirements and contains at least one strength or significant strength.
Acceptable Proposal demonstrates an adequate approach and understanding of the requirements.
Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements.
Unacceptable Proposal does not meet requirements of the solicitation, thus, contains one or more deficiencies, and is un-awardable.
Factor 2: Past Performance
Past Performance will be evaluated as follows:
Adjectival Rating Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Factor 3: Price
The quoted price will be evaluated on the basis of price reasonableness. The evaluation may include but is not limited to, price comparison with other quoters and comparison with independent Government estimates.
Technical and past performance, when combined, are more important than price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
