As a result of these conditions Appendix A designates “Core Items” which must be delivered without exception or delay. All other items must be delivered in compliance with Section 2.2, unless contract officer or ESF#13 technical point of contact has expressly granted permission, via email, for partial shipping. Equivalent items must be within 5% weight of the original specified items, and of an equivalent color, and quality.
For Emergency Delivery, substitutions may be approved without providing samples by receiving written (email) authorization from contracting officer or ESF#13 technical representative prior to shipping. No substitution authorization will be provided unless a specific substitution is named by Brand, model and/or style.
2.5 DISCONTINUED / OBSOLETE ITEMS
The government understands that over the life of the contract there is a strong possibility a handful of items will be discontinued and no longer available to deliver. At the soonest opportunity the Offeror will notify the ESF#13 technical point of contact of the unavailability of items, and recommend the closest equivalent replacement.
For all Core Items, as specified in Appendix A, a sample must be provided to ESF#13 technical point of contact for test and evaluation. No substitutions or replacements are allowed unless approved in advance.
2.6 SPECIAL SUBTITUTIONS
The government understands that under unique situations alternate items will need to be provided.
Examples of these situations include women’s sizing and models, and sizes outside the general normal standards of items specified in Appendix A. These special substitutions must be authorized in writing (email) in advance by the ESF#13 technical point of contact, and whenever practical a sample will be provided for test and evaluation.

The nature of the ESF-13 mission and disaster response means under some circumstances it may be necessary to acquire items and equipment not specified in Appendix A. These circumstances are the result of unforeseen hazards and would require items such as respirator masks, pallets of bottled water, chem-lights, specialty batteries, or other items as deemed necessary to complete the ATF/ESF#13 mission. As a result of these needs the government may order items from the Offeror not listed in Appendix A. Such orders will be communicated when necessary, with price and availability discussed with the ESF#13 technical point of contact. Specific item brand, style/color, and price will be provided in writing (email) prior to order submission.

The government expects these prices to include the cost to create any Kit or system from procurement through delivery to the ATF/ESF#13. The price to deliver one Basic Kit and one of each system shall be included on the “Kitting Line” of the Price Template. Some of the elements included in the delivery cost shall include labor, packaging, transportation, and other non-product costs. The government shall use the item prices as the fully
